Methods for the administration of air sports

Article 1 The present Measures are formulated in accordance with the Basic Rules of Flight of the People's Republic of China, the Provisional Provisions of the State Council on the Administration of General Aviation and the Regulations on the Administration of Airworthiness of Air Vehicles of the People's Republic of China in accordance with the Regulations on the Administration of Air Vehicles of the People's Republic of China. Regulations on the Administration of General Aviation and the Airworthiness of Chinese People's*** and National Aircraft, the present measures are formulated.
Article 2 These Measures shall apply to all units and individuals using civil aircraft and air sports equipment to engage in air sports within the territory of the People's Republic of China.
Civil aircraft used in air sports include airplanes, helicopters, gliders, manned balloons and airships.
Aerospace sports using air sports equipment, including parachutes, paragliders, hang gliders, model aviation and winch car, rope and other traction equipment.
Article 3 of the aviation sports sports to implement the National Sports Committee and the provinces, autonomous regions and municipalities directly under the Central Sports Committee hierarchical management system.
Article 4 The National Sports Commission shall unify the management of air sports throughout the country. The main responsibilities are:

Article 5: The sports commissions of provinces, autonomous regions and municipalities directly under the central government shall manage air sports in their respective regions. Article 8 Units engaging in aviation sports shall have the following conditions:
(1) The technical level of the aircraft flight instructor and the teaching task he or she is engaged in shall be compatible with the civil aircraft flight pilot license issued by the Civil Aviation Administration. Those who serve as parachuting and hang gliding instructors shall hold the instructor's certificate issued by the State Sports Commission.
(2) The aircraft used and aircraft maintenance work must be in accordance with the "Regulations on Airworthiness Management of the People's Republic of China*** and National Civil Aircraft" and the relevant regulations issued by the CAAC.
(3) The training ground must conform to the technical requirements of the air sports program engaged in.
(d) The flight area and airspace must be approved by the air traffic control department.
(v) Air sport airports shall be linked to the local air traffic control authority by wire and electric communication.
(vi) Those using civil aircraft to engage in business activities shall obtain a business license in accordance with the relevant provisions of the "Regulations of the People's Republic of China on the Registration and Administration of Enterprise Legal Persons" and its implementing rules and the "Procedures for Approval of Starting a General Aviation Industry". Those who use aviation sports equipment to engage in business activities for profit shall apply for registration with the local sports administrative department and obtain a business license from the administration for industry and commerce.
Article IX of the aviation sports units and participate in aviation sports training shall implement the aviation sports syllabus, training rules, competition rules and aircraft, sports equipment, the use of maintenance regulations.
Article 10 to participate in air sports to make aircraft flights and the use of air sports equipment to lift off, shall comply with the following provisions:
(a) to participate in the aircraft parachuting must be 15 years of age, and alone to make the aircraft or hang glider flights must be 16 years of age. Under the age of sixteen years old to fly an aircraft must have a trainer (instructor) with the passenger, and is responsible for its safety.
(2) Must have a certificate of passing the physical examination.
(c) Must hold a civil aircraft pilot's license, except during the student's study period.
(d) Must hold a flight manual for the aircraft being flown.
(v) Athletes participating in the sports of parachuting and hang gliding shall hold a sports certificate.
Article 11 The coaches and athletes engaged in air sports athletes must undergo a comprehensive airborne body checkup once a year. Receive civil aviation with a pilot's license pilot, flight instructor's physical examination can only be in the Civil Aviation Administration recognized medical units. Aviation sports unit of the aviation doctor is responsible for the flight crew, parachutist medical supervision and daily physical examination and treatment work.
Aircraft maintenance personnel undergo routine physical examination once a year.
Article XII flight drivers engaged in air sports must undergo systematic training in aviation theory and driving techniques, and apply to the Civil Aviation Administration (CAA) for pilot's licenses for all kinds of aircraft in accordance with the provisions of the civil aircraft pilot license system.
Navigation dispatchers shall apply for licenses in accordance with the provisions of the CAA.
Athletes in parachuting and hang gliding shall apply for the relevant sports certificates in accordance with the regulations of the State Sports Commission.
Article XIII of the aviation sports all aircraft and aircraft use, maintenance work, must comply with the "Chinese People's *** and national aircraft airworthiness regulations" and the Civil Aviation Administration of the relevant airworthiness management regulations issued by the relevant provisions of the Civil Aviation Administration of the aircraft nationality registration certificate, certificate of airworthiness, maintenance personnel licenses and maintenance permits to the Civil Aviation Administration.
The initial airworthiness management of aircraft used in air sports is centralized and managed by CAA.
The continuing airworthiness management of aircraft used for air sports in the sports system with more than two crew members (excluding two crew members) shall be directly managed by the CAAC and the airworthiness management department of the Civil Aviation Regional Administration of the place where the aircraft is located; the continuing airworthiness management of other aircraft shall be managed by the specially appointed airworthiness representative appointed by the CAAC in accordance with the rules and regulations issued or finalized by the CAAC on the continuing airworthiness management. The other aircrafts are managed by specially appointed airworthiness representatives appointed by the CAA in accordance with the regulations issued or finalized by the CAA on the continuous airworthiness management.
All kinds of air sports equipment used in air sports (except model airplanes) must have product certificates of conformity and product maintenance manuals validated and issued by the competent national production department and the competent sports department before they can be used. The maintenance of all kinds of air sports equipment should be carried out in strict accordance with the provisions of the maintenance and use manual.
Article XIV of the units and individuals engaged in air sports (except for aviation modeling projects), shall be insured by the People's Insurance Company of China for airframe insurance and third-party liability insurance. Flight and parachute jumpers shall take out personal accident insurance.
Article 15 The units of air sports shall use, protect and manage the airports in accordance with the relevant regulations of the State and the Civil Aviation Administration of China on airports. The construction, abandonment, co-location or conversion of airports for air sports shall fulfill the approval procedures in accordance with the relevant state regulations.
Air sports units sharing airports with the army and civil aviation shall abide by the agreements signed by both sides, maintain the airspace and facilities of the airports, and maintain the air and ground order of the airports.
Any unit or individual is prohibited from encroaching on or destroying air sports venues and facilities.
Article 16 The flight activities of the air sports units shall apply to the local air traffic control department in accordance with the regulations, and the flights shall be allowed only after approval. The navigation dispatcher of an air sports unit shall be specifically responsible for the navigation management of the unit.
Article 17 When foreign pilots and parachutists participate in air sports within the territory of the People's Republic of China, they must fulfill the following approval procedures.
(1) Those belonging to the invitation of the Chinese Air Sports Association or the application of foreign air sports organizations or individuals to the Chinese Air Sports Association shall be declared to the State Sports Commission, which shall approve them in conjunction with the relevant departments.
Those invited by provincial, autonomous regions or municipalities directly under the central government aviation sports associations, or applied to provincial, autonomous regions or municipalities directly under the central government aviation sports associations by foreign aviation sports organizations or individuals, shall be declared to the sports commissions of the provinces, autonomous regions or municipalities directly under the central government, which shall report to the people's governments of the provinces, autonomous regions or municipalities directly under the central government and to the relevant state departments for approval.
(2) foreigners flying in China (including the use of their own aircraft), the organizer should be in accordance with the relevant provisions of the state declaration procedures, and copy the Civil Aviation Administration and the relevant units, approved before entering the flight. (3) foreigners using their own aircraft to fly into or out of China's national boundaries and flights within China, the organizer should also be in accordance with the "Rules for the Administration of Flight of Foreign Civil Aircraft", "Provisional Provisions for the Licensing of Civil Aircraft Flight Crews", the Civil Aviation Administration for the declaration formalities, and can only be allowed to fly after permission is granted.
Article 18 Foreign pilots and parachutists participating in air sports within the territory of the People's Republic of China shall comply with the following provisions:
(1) Holding a valid pilot's license (or sports certificate) of their own country (region), and the technical standards recorded shall be in line with the content of the flight activities they are engaged in. The pilot's license shall be examined and approved by the Civil Aviation Administration.
(2) Hold a valid medical examination certificate.
(c) Holding proof of personal insurance. Those who fly sports aircraft, gliders, power gliders, manned balloons, hang gliders, and ultralight aircraft shall also be insured by the organizer or the pilot himself with airframe insurance and third-party liability insurance.
(d) Bring their own aircraft or parachute to participate in air sports, the safety and reliability of their equipment by the user's own responsibility. If you bring your own aircraft, its airworthiness certificate shall be examined and approved by the Civil Aviation Administration.
Article 19 When foreign pilots take part in air sports in the territory of the People's Republic of China, the organizers shall explain to them the relevant provisions of China on flight, radio management and use as well as aerial photography, and supervise their implementation.
Article 20 The investigation of flight accidents occurring in the use of aircraft in air sports shall be carried out in accordance with the Regulations on the Investigation of Flight Accidents in Civil Aviation of China issued by the Civil Aviation Administration of China (CAAC) and commissioned by the CAAC.
First-class flight accidents shall be sent by the State Sports Commission to participate in the provincial, autonomous regions and municipalities directly under the Central Government Sports Commission to organize the investigation and handling, and report to the State Sports Commission and the Civil Aviation Administration. Second and third class flight accidents by the provincial, autonomous regions and municipalities directly under the Central Sports Commission is responsible for the investigation and handling, and report to the State Sports Commission and the Civil Aviation Regional Administration.
The first, second and third class accidents of parachuting and hang gliding sports, respectively, by the provincial, autonomous regions and municipalities directly under the Central People's Sports Commission to organize or designate an accident investigation team to investigate and deal with, and report to the State Sports Commission.
Article 21 of the aeromodeling sports management methods, in accordance with the provisions of the aeromodeling training syllabus, training rules, competition rules.
When the flight altitude and airspace of model airplanes are associated with the flight activities of other aircraft, the unit or individual hosting the model airplanes activity shall contact the airport authorities or local flight control department to delimit the flight altitude and area of the model airplanes.
Article 22 These Measures shall be interpreted by the State Sports Commission.
Article 23 These Measures shall come into force on the date of promulgation.
