Article 46: The State guarantees the right of persons with disabilities to enjoy all forms of social security.
The Government and society take measures to improve social security for the disabled and to safeguard and improve their lives.
Article 47 Persons with disabilities and their organizations shall participate in social insurance in accordance with the relevant provisions of the State.
Mass self-government organizations at the grass-roots level in urban and rural areas where persons with disabilities live, and the families of persons with disabilities, shall encourage and help persons with disabilities to participate in social insurance.
Subsidies for social insurance shall be granted in accordance with the relevant provisions of the State to persons with disabilities who have genuine difficulties in making ends meet.
Article 48 The people's governments at all levels shall, through a variety of channels, provide living, education, housing and other social assistance to persons with disabilities who have genuine difficulties in life.
Local people's governments at or above the county level shall take other measures to safeguard the basic livelihood of families of persons with disabilities who are still experiencing special difficulties in life after receiving the minimum subsistence guarantee.
Local people's governments at all levels shall, in accordance with the regulations, provide assistance to poor persons with disabilities for basic medical care, rehabilitation services, and the configuration and replacement of necessary assistive devices.
Local people's governments at all levels shall, in accordance with the circumstances, provide nursing care subsidies to persons with disabilities who are unable to take care of themselves.
Preferential policies implemented by the New Deal:
1. Working Procedures. The two subsidies for people with disabilities are issued upon application. Persons with disabilities or their guardians or relevant principals can apply to the street (township) where their household registration is located. In accordance with the "one-door acceptance, coordinated processing" mechanism, the grass-roots government will coordinate civil affairs, the Disabled Persons' Federation and other relevant departments to carry out the examination and approval of the two subsidies for persons with disabilities.
2. System convergence. In line with the principle of fairness and integration, the "Opinions" on the two subsidies for persons with disabilities and the relevant social welfare, social assistance and social insurance systems have made provisions for convergence. Eligible persons with disabilities can apply for the living allowance for persons with disabilities in difficulty and the nursing allowance for persons with severe disabilities at the same time. Persons with disabilities who meet the conditions for both subsidies for persons with disabilities, as well as those who meet the conditions for welfare living allowances (allowances) and nursing allowances (allowances) for the elderly, persons with disabilities who have been disabled in the line of duty, and persons who have left the service, may apply for one of the categories of living allowances (allowances) and nursing allowances (allowances) at a higher level.
Children with disabilities who are covered by the Orphans' Basic Livelihood Guarantee Policy are not entitled to a living allowance for persons with disabilities, but to a nursing allowance for persons with severe disabilities. The two subsidies for persons with disabilities are not counted as family income for the urban and rural minimum subsistence guarantee. Persons with disabilities who are covered by the life care allowance under the Workers' Compensation Insurance and the special hardship case support guarantee already have a corresponding system in place to provide protection, and are not entitled to the two subsidies for persons with disabilities.
3. Implementation guarantees. After the implementation of the two subsidies for persons with disabilities, the central financial administration will provide local support by increasing general transfer payments. After the official issuance of the Opinions, the Ministry of Civil Affairs, in conjunction with the Ministry of Finance and the China Disabled Persons' Federation, will convene a national video and telephone conference for deployment and implementation, and will formulate practical measures for implementation and enforcement to ensure the smooth implementation of the two-subsidy system for persons with disabilities.
Provinces that have already established the system need to adjust the system against the requirements of this Opinion, and provinces that have not established the system need to formulate implementation measures and create relevant systems in accordance with the requirements of this Opinion.
