Article 1 These Regulations are formulated in order to effectively prevent, timely control and eliminate the hazards of public health emergencies, safeguard public health and life safety, and maintain normal social order. Article 2 Public health emergencies mentioned in these Regulations (hereinafter referred to as emergencies) refer to sudden major infectious diseases, group diseases with unknown causes, major food and occupational poisoning and other events that seriously affect public health. Article 3 After the occurrence of emergencies, the State Council established the National Emergency Response Command, which is composed of relevant departments and the army of the State Council, with the competent leader of the State Council as the commander in chief, responsible for the unified leadership and unified command of the national emergency response. The health administrative department of the State Council and other relevant departments shall, within the scope of their respective duties, do a good job in emergency response. Article 4 After an emergency occurs, the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall set up a local emergency emergency headquarters, with the main leaders of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government as the chief commander, responsible for leading and directing the emergency work within their respective administrative areas. The health administrative department of the local people's government at or above the county level shall be responsible for organizing the investigation, control and medical treatment of emergencies. The relevant departments of the local people's governments at or above the county level shall, within the scope of their respective duties, do a good job in dealing with emergencies. Fifth emergency work should follow the principle of giving priority to prevention, always standing by, and implement the principles of unified leadership, graded responsibility, timely response, decisive measures, relying on science and strengthening cooperation. Article 6 The people's governments at or above the county level shall organize scientific research on the prevention and control of emergencies, and establish a reserve of related materials, equipment, facilities, technology and human resources for emergency epidemiological investigation, isolation of infectious sources, on-site disposal, supervision and inspection, monitoring and inspection, and health protection, and the required funds shall be included in the fiscal budget at the corresponding level. The state provides financial support for emergency work in remote and poor areas. Article 7 The State encourages and supports international exchanges and cooperation in emergency monitoring, early warning and response technologies. Article 8 The relevant departments of the State Council and the local people's governments at or above the county level and their relevant departments shall establish a strict responsibility system for emergency prevention and emergency handling, earnestly perform their respective duties, and ensure the normal emergency handling. Ninth people's governments at or above the county level and their health administrative departments shall give appropriate subsidies and health care allowances to medical and health personnel who participate in emergency treatment; Commend and reward those who have made contributions in emergency response; In accordance with the relevant provisions of the state, corresponding subsidies and pensions shall be given to those who are sick, disabled or killed because of participating in emergency handling.
Chapter II Prevention and Emergency Preparedness
Article 10 The health administrative department of the State Council shall, in accordance with the requirements of classified guidance and rapid response, formulate a national emergency plan and submit it to the State Council for approval. The people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall, in accordance with the national emergency plan and in light of local conditions, formulate emergency plans for emergencies in their respective administrative regions. Eleventh national emergency plan shall include the following main contents: (1) the composition of emergency headquarters and the responsibilities of relevant departments; (2) Monitoring and early warning of emergencies; (three) the system of emergency information collection, analysis, reporting and notification; (four) emergency handling technology and monitoring institutions and their tasks; (five) emergency classification and emergency treatment work plan; (six) emergency prevention, on-site control, emergency facilities, equipment, treatment drugs and medical devices, as well as other materials and technology reserves and scheduling; (seven) the construction and training of emergency handling professional team. Twelfth emergency plans should be revised and supplemented in a timely manner according to the changes of emergencies and problems found in the implementation. Article 13 Local people's governments at all levels shall, in accordance with the provisions of laws and administrative regulations, do a good job in the prevention and control of infectious diseases and other public health work to prevent the occurrence of emergencies. The health administrative department of the people's government at or above the county level and other relevant departments shall carry out special education on emergency knowledge to the public, and enhance the awareness and ability of the whole society to deal with emergencies. Article 14 The State shall establish a unified emergency prevention and control system. The local people's governments at or above the county level shall establish and improve the emergency monitoring and early warning system. The health administrative department of the people's government at or above the county level shall designate an institution to be responsible for the daily monitoring of emergencies and ensure the normal operation of the monitoring and early warning system. Fifteenth monitoring and early warning work should be based on the types of emergencies, to develop monitoring programs, scientific analysis and comprehensive evaluation of monitoring data. The potential hidden dangers and possible emergencies discovered early shall be reported in a timely manner in accordance with the reporting procedures and time limits stipulated in these regulations. Sixteenth the relevant departments of the State Council and the local people's governments at or above the county level and their relevant departments shall, according to the requirements of the emergency plan, ensure the reserve of emergency facilities, equipment, rescue drugs and medical devices. Seventeenth people's governments at or above the county level shall strengthen the construction of emergency medical service network, equipped with corresponding medical treatment drugs, technology, equipment and personnel, and improve the ability of medical and health institutions to deal with various emergencies. Local people's governments at or above the municipal level with districts shall set up specialized hospitals for infectious diseases that meet the needs of prevention and control of infectious diseases, or designate medical institutions with conditions and capabilities for prevention and control of infectious diseases to undertake the task of prevention and control of infectious diseases. Article 18 The administrative department of health of the local people's government at or above the county level shall regularly train medical and health institutions and personnel on the knowledge and skills related to emergency handling, regularly organize medical and health institutions to conduct emergency drills, and popularize the latest knowledge and advanced technology.
Chapter III Report and Information Release
Article 19 The State establishes an emergency reporting system. The health administrative department of the State Council shall formulate emergency reporting standards and establish a major and emergency epidemic information reporting system. Under any of the following circumstances, the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall report to the health administrative department of the State Council 1 hour after receiving the report: (1) An outbreak or epidemic of infectious diseases has occurred or may occur; (two) the occurrence or discovery of unexplained group diseases; (3) Loss of infectious virus strains and viruses; (4) Major food and occupational poisoning incidents have occurred or may occur. The administrative department of public health of the State Council shall report to the State Council immediately for emergencies that may cause significant social impact. Twentieth emergency monitoring institutions, medical and health institutions and relevant units shall report to the health administrative department of the local people's government at the county level within 2 hours if they find any of the circumstances stipulated in Article 19 of these regulations; The health administrative department that receives the report shall report to the people's government at the same level within 2 hours, and report to the health administrative department of the people's government at the next higher level and the health administrative department of the State Council. The people's government at the county level shall report to the municipal people's government with districts or the people's government at the next higher level within 2 hours after receiving the report; The municipal people's government with districts shall report to the people's governments of provinces, autonomous regions and municipalities directly under the Central Government within 2 hours after receiving the report. Article 21 No unit or individual may conceal, delay reporting or make a false report about emergencies, or instruct others to conceal, delay reporting or make a false report. Twenty-second local people's governments and health administrative departments that receive reports shall immediately organize forces to investigate, verify and confirm the reported matters, take necessary control measures, and report the investigation in time. Article 23 The administrative department of health in the State Council shall, according to the emergency, promptly notify the relevant departments of the State Council, the administrative departments of health of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government and the relevant departments of the military. The health administrative department of the people's government of the province, autonomous region or municipality directly under the Central Government where the emergency occurred shall promptly notify the health administrative department of the people's government of the neighboring province, autonomous region or municipality directly under the Central Government. The health administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall, when necessary, promptly notify the medical and health institutions within their respective administrative areas. The relevant departments of the local people's governments at or above the county level shall notify the health administrative department of the people's government at the same level in a timely manner when they have occurred or found any situation that may lead to emergencies. Article 24 The state establishes an emergency reporting system and publishes a unified emergency report and telephone number. Any unit or individual has the right to report the hidden dangers of emergencies to the people's government and its relevant departments, and to report to the people's government at a higher level and its relevant departments that the local people's government and its relevant departments fail to perform their emergency response duties or fail to perform their duties in accordance with regulations. The relevant people's governments and their relevant departments that receive reports and reports shall immediately organize the investigation and handling of hidden dangers of emergencies, failure to perform or failure to perform emergency handling duties in accordance with regulations. The people's governments at or above the county level and their relevant departments shall reward the units and individuals who have made meritorious contributions to reporting emergencies. Article 25 The State shall establish an emergency information release system. The health administrative department of the State Council is responsible for releasing emergency information to the society. When necessary, the health administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government may be authorized to release emergency information within their respective administrative areas to the public. Information release should be timely, accurate and comprehensive.
Chapter IV should be dealt with urgently.
Twenty-sixth after the occurrence of emergencies, the administrative department of health shall organize experts to make a comprehensive evaluation of emergencies, preliminarily judge the types of emergencies, and put forward suggestions on whether to start emergency plans for emergencies. Twenty-seventh national emergency plans launched nationwide or across provinces, autonomous regions and municipalities directly under the central government shall be implemented after being reported to the State Council for approval by the health administrative department of the State Council. The people's governments of provinces, autonomous regions and municipalities directly under the Central Government decided to start the emergency plan and report to the State Council. Twenty-eighth national emergency headquarters to supervise and guide the emergency handling work, local people's governments at all levels and their relevant departments shall cooperate. The emergency response headquarters of provinces, autonomous regions and municipalities directly under the Central Government shall supervise and guide the emergency response work within their respective administrative areas. Twenty-ninth professional and technical institutions designated by the health administrative department of the people's government at or above the provincial level or other relevant departments shall be responsible for the technical investigation, confirmation, disposal, control and evaluation of emergencies. Thirtieth the State Council health administrative departments shall, according to the degree of harm and epidemic intensity, in accordance with the provisions of the People's Republic of China (PRC) Law on the Prevention and Control of Infectious Diseases, promptly declare the newly discovered sudden infectious diseases as legal infectious diseases; If it is declared as a Class A infectious disease, it shall be decided by the State Council. Thirty-first before the start of the emergency plan, the relevant departments of the people's governments at or above the county level shall, according to the actual situation of emergencies, make good preparations for emergency treatment and take necessary emergency measures. After the emergency plan is started, the relevant departments of the people's government at the place where the emergency occurs shall, in accordance with the requirements of the responsibilities stipulated in the plan, obey the unified command of emergency headquarters, immediately arrive at the designated post and take relevant control measures. Medical and health institutions, monitoring institutions and scientific research institutions should obey the unified command of emergency headquarters, cooperate with each other, and concentrate on carrying out relevant scientific research. Thirty-second after an emergency, the relevant departments of the State Council and the local people's governments at or above the county level and their relevant departments shall ensure the production and supply of medical rescue equipment, rescue drugs, medical devices and other materials needed for emergency treatment; Railway, transportation and civil aviation administrative departments shall ensure timely delivery. Thirty-third according to the needs of emergency handling, emergency handling headquarters has the right to urgently mobilize personnel, reserve materials, vehicles and related facilities and equipment; When necessary, evacuate or isolate people, and may block epidemic areas of infectious diseases according to law. Article 34 emergency headquarters may take measures to control food and water according to the needs of emergency treatment. The health administrative department of the local people's government at or above the county level shall take control measures on the scene of emergencies, publicize the knowledge of emergency prevention, and take emergency vaccination, preventive medication, group protection and other measures for vulnerable people and other vulnerable people in time. Thirty-fifth staff involved in emergency treatment should take health protection measures in accordance with the provisions of the plan and work under the guidance of professionals. Article 36 The professional and technical institutions designated by the health administrative department of the State Council or other relevant departments have the right to enter the scene of emergencies for investigation, sampling, technical analysis and inspection, and provide technical guidance for the emergency treatment of local emergencies, and the relevant units and individuals shall cooperate; No unit or individual may refuse for any reason. Thirty-seventh of the newly discovered sudden infectious diseases, unexplained group diseases, major food and occupational poisoning incidents, the health administrative department of the State Council should organize forces to formulate relevant technical standards, norms and control measures as soon as possible. Article 38 In case of an infectious disease patient or a suspected infectious disease patient who needs to take emergency control measures according to the regulations of the administrative department of health of the State Council, the person in charge shall notify the front stop in the fastest way and report to the vehicle operation unit. The stopping point in front of the vehicle and the operating unit shall immediately report to the administrative department of the vehicle operating unit and the health administrative department of the local people's government at or above the county level. After receiving the report, the health administrative department shall immediately organize relevant personnel to take corresponding medical treatment measures. Those who have close contact with patients with infectious diseases on the means of transport shall be controlled by the health administrative department of the people's government at or above the county level or the administrative departments of railways, transportation and civil aviation in accordance with their respective functions and duties and in accordance with the provisions of laws and administrative regulations on the prevention and control of infectious diseases. If it is necessary to take emergency control measures for people, vehicles, goods, containers, luggage, postal parcels and other infectious diseases at border ports and entering or leaving the country, it shall be handled in accordance with the provisions of frontier health and quarantine laws and administrative regulations. Thirty-ninth medical and health institutions should provide medical aid and on-site rescue for people who are sick due to emergencies, and must give medical treatment to patients and write detailed and complete medical records; For patients who need to be transferred, a copy of the patient and his medical records shall be transferred to a consultation or designated medical institution. Medical and health institutions should take health protection measures to prevent cross-infection and pollution. Medical and health institutions should take medical observation measures for close contacts of patients with infectious diseases, and close contacts of patients with infectious diseases should cooperate. Medical institutions should report to local disease prevention and control institutions according to law when accepting patients with infectious diseases or suspected patients with infectious diseases. The disease prevention and control institution that receives the report shall immediately investigate the personnel who may be harmed and take necessary control measures as needed. Article 40 When an infectious disease breaks out and is prevalent, streets, towns, residents' committees and villagers' committees shall organize forces to unite and cooperate with each other, prevent and treat it by groups, assist the health administrative department and other relevant departments and medical and health institutions in collecting and reporting the epidemic situation, evacuate and isolate people, implement public health measures, and publicize relevant knowledge on the prevention and treatment of infectious diseases to residents and villagers. Forty-first local people's governments at or above the county level shall do a good job in the prevention of infectious diseases and floating population in epidemic areas, and implement relevant health control measures; On-site isolation, on-site observation and on-site treatment measures should be taken for patients with infectious diseases and patients suspected of infectious diseases. In need of treatment and referral, it shall be implemented in accordance with the provisions of the first paragraph of Article 39 of these regulations. Forty-second relevant departments and medical and health institutions should find, report, isolate and treat infectious diseases early, cut off the route of transmission and prevent their spread. Forty-third people's governments at or above the county level shall provide necessary funds to ensure that people who are sick or disabled due to emergencies receive timely and effective treatment. The specific measures shall be formulated by the financial department, health administrative department and labor security administrative department of the State Council. Forty-fourth patients who need isolation treatment and medical observation measures in emergencies, close contacts of suspected patients and patients with infectious diseases should cooperate when the health administrative department or relevant institutions take medical measures; Refuses to cooperate, the public security organ shall assist in enforcement according to law.
Chapter V Legal Responsibilities and Responsibilities
Article 45 Where the local people's governments at or above the county level and their health administrative departments fail to perform their reporting duties in accordance with the provisions of these Regulations, and conceal, delay reporting or make false reports about emergencies, or instruct others to conceal, delay reporting or make false reports, the principal leaders of the government and the principal responsible persons of the health administrative departments shall be given administrative sanctions of demotion or dismissal according to law; Those who cause the spread and epidemic of infectious diseases or cause other serious harmful consequences to public health shall be given administrative sanctions of dismissal according to law; If a crime is constituted, criminal responsibility shall be investigated according to law. Article 46 If the relevant departments of the State Council, local people's governments at or above the county level and their relevant departments fail to complete the production, supply, transportation and storage of facilities, equipment, medicines, medical instruments and other materials needed for emergency treatment in accordance with the provisions of these Regulations, the principal leaders of the government and the principal responsible persons of government departments shall be given administrative sanctions of demotion or dismissal according to law; Those who cause the spread and epidemic of infectious diseases or cause other serious harmful consequences to public health shall be given administrative sanctions of dismissal according to law; If a crime is constituted, criminal responsibility shall be investigated according to law. Article 47 After an emergency occurs, if the local people's governments at or above the county level and their relevant departments do not cooperate with the investigation of the relevant departments of the people's governments at higher levels, or obstruct or interfere with the investigation in other ways, the principal leaders of the government and the principal responsible persons of the government departments shall be given administrative sanctions of demotion or dismissal according to law; If a crime is constituted, criminal responsibility shall be investigated according to law. Article 48 Where the health administrative department of the people's government at or above the county level and other relevant departments neglect their duties, dereliction of duty or dereliction of duty in the investigation, control and medical treatment of emergencies, the relevant departments of the people's government at the corresponding level or the people's government at a higher level shall order them to make corrections, and informed criticism shall give them a warning; The main person in charge, the responsible person in charge and other responsible personnel shall be given administrative sanctions of demotion and dismissal according to law; Those who cause the spread and epidemic of infectious diseases or cause other serious harmful consequences to public health shall be given administrative sanctions of dismissal according to law; If a crime is constituted, criminal responsibility shall be investigated according to law. Article 49 If the relevant departments of the people's governments at or above the county level refuse to perform emergency duties, the relevant departments of the people's governments at the corresponding levels or the people's governments at higher levels shall order them to make corrections, and informed criticism shall give them a warning; The main person in charge, the responsible person in charge and other responsible personnel shall be given administrative sanctions of demotion and dismissal according to law; Those who cause the spread and epidemic of infectious diseases or cause other serious harmful consequences to public health shall be given administrative sanctions of dismissal according to law; If a crime is constituted, criminal responsibility shall be investigated according to law. Fiftieth medical and health institutions have one of the following acts, the health administrative department shall order them to make corrections, and informed criticism shall give them a warning; If the circumstances are serious, the practice license of the medical institution shall be revoked; The main person in charge, the responsible person in charge and other directly responsible personnel shall be given demotion or dismissal according to law; Causing the spread and epidemic of infectious diseases or other serious harmful consequences to public health, which constitutes a crime, shall be investigated for criminal responsibility according to law: (1) failing to perform reporting duties in accordance with the provisions of these regulations, concealing, delaying reporting or making false reports; (2) Failing to take timely control measures in accordance with the provisions of these Regulations; (3) Failing to perform emergency monitoring duties in accordance with the provisions of these Regulations; (4) refusing to accept patients; (five) refused to obey the dispatch of emergency headquarters. Article 51 In the emergency handling of emergencies, if the relevant units and individuals fail to perform their reporting duties in accordance with the provisions of these Regulations, conceal, delay reporting or make false reports, hinder the emergency handling staff from performing their duties, refuse the professional and technical institutions designated by the health administrative department of the State Council or other relevant departments to enter the scene of emergencies, or fail to cooperate with the investigation, sampling, technical analysis and inspection, the responsible persons concerned shall be given administrative sanctions or disciplinary sanctions according to law; Violation of the "People's Republic of China (PRC) Public Security Administration Punishment Law", which constitutes a violation of public security administration, shall be punished by the public security organs according to law; If a crime is constituted, criminal responsibility shall be investigated according to law. Article 52 Whoever spreads rumors, drives up prices, deceives consumers and disturbs social order and market order in an emergency shall be given administrative punishment by the public security organ or the administrative department for industry and commerce according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
Chapter VI Supplementary Provisions
Fifty-third China People's Liberation Army, armed police medical and health institutions to participate in emergency handling, in accordance with the regulations and the relevant provisions of the army. Article 54 These Regulations shall come into force as of the date of promulgation.
