Legal analysis: mainly civil disputes, except for some cases affecting social stability. Copyright infringement disputes are mostly economic disputes, or infringement of the interests of the copyright holder, most of these cases are economic disputes, are individuals to individuals, or citizens to citizens, are equal between the subject of economic relations and personal relations, so it is a civil dispute.
Legal basis: "Chinese People's *** and State Copyright Law" Article 52 of the following infringing acts, depending on the circumstances, shall bear the civil liability to stop the infringement, eliminate the impact, apologize, compensation for damages and other civil liability:
(a) without the permission of the copyright owner, the publication of his work;
(b) without the permission of the co-authors, will be co-created with others to publish their works as their own works. (ii) without the permission of the co-author, publishing a work created in collaboration with others as if it were his own work;
(iii) without participating in the creation of the work, signing the name of another person's work for the purpose of personal gain or fame;
(iv) distorting or tampering with the work of another person;
(v) plagiarizing the work of another person;
(vi) without the permission of the copyright owner, using the work by way of an exhibition, a photographic or audiovisual work, or (viii) using a work by means of adaptation, translation or annotation without the permission of the copyright owner, unless otherwise provided for in this Law;
(viii) using another's work for which remuneration should be paid but is not paid;
(viii) renting out the originals or copies of an audio-visual work, computer software or sound recording and video recording without the permission of the copyright owner, the performer or the producer of the sound recording and video recording of such a work. Except as otherwise provided in this Law;
(ix) using the layout design of a book or periodical published by a publisher without his permission;
(x) broadcasting live or publicly transmitting his live performance from a site or recording his performance without the permission of the performer;
(xi) any other infringement of copyrights and rights related to copyrights.
Article 53 Anyone who commits the following acts of infringement shall, depending on the circumstances, bear the civil liability provided for in Article 52 of this Law; if the infringement also damages the interests of the public ****, the department in charge of copyright shall order the cessation of the infringing acts, give a warning, confiscate the illegal income, confiscate, harmlessly destroy and dispose of the infringing copies as well as the materials, tools, equipment, etc., which are mainly used in the production of the infringing copies. If the amount of illegal business is more than 50,000 yuan, it may also impose a fine of not less than double and not more than five times the amount of illegal business; if there is no amount of illegal business, or if the amount of illegal business is difficult to calculate or is less than 50,000 yuan, it may also impose a fine of not more than 250,000 yuan; if the act constitutes a crime, it shall be investigated for criminal liability in accordance with the law:
(a) without the permission of the copyright owner, reproducing, distributing, performing, screening, broadcasting, compiling, disseminating its works to the public through an (a) without the permission of the copyright owner, reproducing, distributing, performing, showing, broadcasting, compiling, or transmitting his or her work to the public through an information network, unless otherwise provided for in this Law;
(b) publishing a book in which another person enjoys the exclusive right of publication;
(c) without the permission of the performer, reproducing, distributing, or transmitting his or her performance through an information network, unless otherwise provided for in this Law;
(d) without the permission of the producer of the sound recording, reproducing, distributing, or distributing the sound recording (D) without the permission of the producer, copying, distributing, or disseminating to the public through an information network the sound and video recordings produced by him, unless otherwise provided for in this Law;
(E) without the permission of the producer, broadcasting, copying, or disseminating to the public through an information network the radio or television broadcasts, unless otherwise provided for in this Law;
(F) without the permission of the copyright owner or the owner of the rights related to the copyright, deliberately avoiding or destruction of technological measures, intentionally manufacturing, importing or providing to others devices or components primarily for the purpose of avoiding or destroying technological measures, or intentionally providing technical services for others to avoid or destroy technological measures, unless otherwise provided by laws or administrative regulations;
(g) without the permission of the copyright owner or the copyright-related right holders, intentionally deleting or altering the work, layout design, performance, sound and video recordings or rights management information on radio or television, knows or should know that the work, layout design, performance, sound and video recordings or rights management information on radio or television has been deleted or altered without permission, and still provides it to the public, except as otherwise provided by laws and administrative regulations;
(h) to produce or sell a work that is counterfeited to another person's signature. .
