Regulations of Fushun Municipality on the Administration of Fireworks and Firecrackers (revised on 20 15)

Article 1 In order to strengthen the management of fireworks and firecrackers, ensure the safety of the public and people's lives and property, and create a good social environment, these Regulations are formulated in accordance with the Regulations of the State Council Municipality on the Safety Management of Fireworks and Firecrackers and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the administration of fireworks and firecrackers within the administrative area of this Municipality. Article 3 The public security organ is the competent authority in charge of the management of fireworks and firecrackers. Safety production supervision and management, urban management, industrial and commercial management, real estate management, quality and technical supervision, environmental protection and other departments and supply and marketing cooperatives shall do relevant work within their respective responsibilities. Article 4 State organs, social organizations, enterprises and institutions, communities, villagers' committees and other organizations shall carry out publicity and education on the lawful, safe and civilized discharge of fireworks and firecrackers, and assist in the management of fireworks and firecrackers.

Primary and secondary schools should educate students about civilized and safe fireworks and firecrackers.

Radio, television, newspapers and other media should publicize the civilized and safe discharge of fireworks and firecrackers. Article 5 The principles of unified planning, rational layout, strict examination and approval and ensuring safety shall be implemented in the examination and approval of fireworks and firecrackers retail outlets.

Retail outlets shall be located and laid out by the safety production supervision and management department in conjunction with the public security organs, urban management departments and supply and marketing cooperatives. Sixth fireworks retail outlets shall meet the following conditions:

(1) Conforming to the layout conditions of the retail outlets of fireworks and firecrackers in this Municipality;

(2) Having a sound sales management system, mainly including: the post responsibility system for sales personnel, the purchase and sale management system and the warehousing system;

(3) There are no gas stations, other inflammable, explosive, toxic and harmful dangerous goods production and storage facilities, kindergartens, schools, nursing homes, medical institutions, shopping malls, bazaars, theaters, dance halls, state organs and other crowded places within a radius of 100 meters;

(four) the total amount of fireworks and firecrackers placed in each booth shall not exceed 100 boxes, and the maximum weight of each box shall not exceed 30 kilograms;

(5) Having reliable communication facilities;

(six) equipped with fire fighting equipment and equipment that meet the requirements;

(seven) retail fireworks that meet the requirements of safe discharge;

(eight) retail establishments should be equipped with more than one safety management personnel who have passed the training and examination;

(nine) other conditions stipulated by laws and regulations. Seventh the implementation of fireworks limited time discharge system.

Fireworks and firecrackers are prohibited from 20: 00 every day to 6: 00 the next day.

Fireworks and firecrackers are allowed to be set off from 6: 00 to 22: 00 every day from the 23rd to 15th of the twelfth lunar month. Among them, fireworks and firecrackers are allowed on New Year's Eve and the first day of the first month. Eighth business wedding places prohibit the discharge of fireworks. Ninth, it is forbidden to set off fireworks and firecrackers all day during the college entrance examination. Tenth it is forbidden to set off fireworks and firecrackers in the following places:

(a) cultural relics protection units;

(2) Transportation hubs such as stations and docks and railway line safety protection zones;

(3) Units that produce and store inflammable and explosive articles;

(4) Within the safety protection zone of power transmission and transformation facilities;

(five) medical institutions, kindergartens, primary and secondary schools, nursing homes;

(six) key fire prevention areas such as forests and grasslands;

(seven) shopping malls, markets and other crowded places;

(8) Balcony, window, corridor, roof, bridge and underpass;

(nine) indoor theaters, dance halls and other public places of entertainment;

(ten) other places where fireworks and firecrackers are prohibited as prescribed by the people's government of the city or county (District). Eleventh it is forbidden to set off fireworks and firecrackers in the following ways:

(a) throwing at others, vehicles, ships, aircraft, buildings, municipal facilities, public green spaces;

(2) obstructing the safe passage of pedestrians, vehicles, ships and aircraft;

(three) other ways to endanger public security and personal and property safety. Twelfth prohibit the sale and discharge of fireworks, rowing guns, throwing guns, paper guns and other friction fireworks. Thirteenth state organs, social organizations, enterprises, institutions and individual industrial and commercial households to hold a celebration to set off fireworks and firecrackers, should be approved by the local public security organs. The public security organ that accepts the application shall, within fifteen days from the date of accepting the application, review the submitted application, and approve it if it meets the conditions; Do not meet the requirements, it shall explain the reasons. Fourteenth fireworks should be set off in accordance with the discharge instructions. The discharge of Class A fireworks and firecrackers shall be approved by the public security organ, and shall be discharged by professional discharge personnel at the approved place; If more than 5,000 Class B fireworks and firecrackers are set off, they will be set off by professional fireworks personnel at the approved place after being approved by the public security organ. Fifteenth designated places for setting off fireworks and firecrackers shall be established by the county (District) people's government and announced to the public. Article 16 The owners' statute and the villagers' convention may stipulate the following matters:

(1) Fireworks and firecrackers are prohibited in this residential area;

(two) the time, place, type and quantity of fireworks and firecrackers are allowed in this residential area, but they shall not violate the provisions of laws, regulations and these regulations.
