Enterprises producing food packaging, containers and tools that have the basic production conditions and can guarantee the product quality shall be issued with production licenses after application and examination, and allowed to produce products within the scope of certification. An enterprise without a production license may not produce food packaging, containers and tools. Food packaging, containers, tools and other products that are subject to production license management and have passed the inspection must be printed (affixed) with the "QS" logo when they leave the factory for sale, and those without the "QS" logo may not enter the market for sale.

I. Scope of application

The production license objects of plastic packaging, containers, tools and other products for food include plastic products and plastic composite products used for packaging and containing food or food additives; Plastic containers, utensils, tableware and other products that come into direct contact with food or food additives during production, circulation and use. The first batch of food plastic packaging, containers, tools and other products with market access system include 39 products in 3 categories with national standards and industry standards. According to the principle that products with the same or similar production technology are divided into one product unit, products such as plastic packaging, containers and tools for food are divided into six product units: packaging includes four product units: non-composite film bags, composite film bags, sheets and woven bags; The container class includes 1 product unit: container; Tools include 1 product unit: tools for food.

Second, the application conditions

When applying for the QS production license, the relevant food packaging production and processing enterprises must meet the following conditions:

1. If there is a business license, the business scope shall include the products applied for production or processing.

2. It has production equipment, process equipment and related auxiliary equipment to ensure product quality and safety, and workshops or places for processing, handling, packaging, storage and inspection of raw materials suitable for product quality and safety.

3. Raw materials and additives (including processing AIDS) used by food packaging production and processing enterprises shall not be illegally used for the production and processing of unclean, recycled and polluted raw materials or raw and auxiliary materials for non-food packaging. The raw and auxiliary materials used belong to the production license management, and the products of certified enterprises must be purchased.

4. Food packaging production and processing enterprises must adopt scientific and reasonable processing technology, and the production and processing process should be strictly regulated to prevent biology, chemistry and physical contamination, and to prevent cross-contamination and waste of resources between raw materials and semi-finished products and finished products. Food packaging production and processing enterprises must organize production in accordance with effective product standards. If the market access management of food quality and safety is implemented according to enterprise standards, the enterprise standards must comply with laws and regulations, relevant national standards, industry standards and the requirements for safeguarding human health and personal and property safety, and the product quality and safety indicators shall not be lowered.

5. Food packaging production and processing enterprises must have corresponding professional and technical personnel, skilled workers, quality management personnel and inspection personnel. Personnel engaged in the production and processing of commodity packaging must be healthy, free from infectious diseases and other diseases that affect the quality and safety of food packaging, and hold health certificates. Inspectors must have the ability to inspect related products and obtain the qualification of quality inspection. Food packaging production and processing enterprises should have a sound and effective enterprise quality management system and product quality responsibility system, and implement standardized management in the whole production process, from raw material procurement, production process control and inspection, product ex-factory inspection to after-sales service.

6. The food packaging materials sold in the factory shall be marked, and the food marking shall conform to the relevant national laws, standards and requirements.

Third, the application materials

An enterprise applying for a production license shall submit the application materials to the local provincial bureau of quality and technical supervision, including (unless otherwise specified, all in triplicate, one for the provincial bureau of quality and technical supervision, one for the review institution and one for the review center):

1. Application for production license of food packaging, containers, tools and other products;

2. Copy of business license (the enterprise must bring the original when applying);

3. A copy of the certification documents that meet the requirements issued by the local environmental protection department (the original should be brought when the enterprise applies);

4. The "Enterprise Self-Declaration" that the raw and auxiliary materials used by the enterprise meet the national laws, regulations, mandatory standards and safety and health requirements;

5. When the types of raw and auxiliary materials used by enterprises exceed the scope stipulated by national standards, a safety evaluation report issued by a safety evaluation agency shall be submitted;

6. List of enterprise production management systems;

7 product type inspection report (can also be submitted during the on-site inspection of the enterprise);

8. Product instruction manual or product label; The contents of the product instruction manual or product label shall include words, charts and warning contents such as product use method, use precautions, use, product use environment, use temperature, types of raw and auxiliary materials used;

9. Other materials that need to be supplemented as stipulated in the detailed rules for product review.

Review and certification

In order to implement the market access system for food packaging, containers, tools and other products, the person in charge of the relevant departments of the General Administration of Quality Supervision, Inspection and Quarantine said that the quality, rate and efficiency of issuing certificates will be improved, and work discipline and post-certification supervision will be strictly enforced. Only in this way can licensed enterprises be well managed, unlicensed production can be prohibited, and various undesirable phenomena and problems that may occur in market access can be eliminated to the maximum extent.

According to the General Rules for the Production License of Food Packaging, Containers and Tools, the Provincial Bureau of Quality and Technical Supervision will review the completeness and authenticity of the application materials after receiving the application from the enterprise. Upon examination, if the application materials meet the requirements, it shall accept the application, and issue the "Decision on Accepting the Application for Administrative License" to the enterprise within 5 days from the date of receiving the application materials; If the application materials do not meet the requirements and can meet the requirements after correction, it shall inform the enterprise of the contents that need to be corrected at one time, and issue the Notice of Correction of Administrative License Application Materials to the enterprise on the spot or within 5 days. Failing to inform the enterprise within the time limit shall be deemed as accepting the application. If the application materials do not meet the requirements of the Administrative Licensing Law and the Regulations on the Administration of Production Licenses for Industrial Products, it will not be accepted, and the enterprise shall issue a decision on the inadmissibility of the application for administrative license within 5 days from the date of receiving the application or making corrections to the application materials.

After accepting the application, the Provincial Bureau of Quality and Technical Supervision will send (send) all the application materials to the review body within 5 days from the date of receiving the application materials sent (sent) by the Provincial Bureau of Quality and Technical Supervision, and the review body will formulate the enterprise field verification plan within 15 days from the date of receiving the enterprise application materials, and organize the review group to conduct on-the-spot verification of the enterprise in accordance with the provisions of the product review rules.

The on-site inspection time of enterprises is generally 1~3 days, and the inspection team is responsible for the on-site inspection results, and the team leader is responsible for it. The evaluation team shall submit the on-site inspection report of the enterprise to the evaluation institution within 3 days after completing the on-site inspection, and the evaluation institution shall complete the on-site inspection of the enterprise and seal the samples within 30 days from the date of accepting the application of the enterprise, issue the Notice of the on-site inspection result of the enterprise to the enterprise, and inform the Provincial Bureau of Quality and Technical Supervision at the same time; If the enterprise fails to pass the on-site inspection, it will be judged as unqualified in the enterprise review, and the review institution will terminate the enterprise review.

According to the regulations, the applicant enterprise can organize small-batch trial production of products applying for evidence collection from the date of receiving the decision on accepting the application for administrative license; The trial-produced products of enterprises must be approved by the inspection institutions designated by AQSIQ according to the provisions of the corresponding product review rules. Those who pass the inspection shall be marked with "Trial Products" on the package or instructions before they can be sold; If AQSIQ decides not to grant administrative license, the enterprise shall stop trial production from the date of receiving the decision not to grant administrative license.

In accordance with the relevant provisions, the review body shall summarize and review the application forms and application materials, on-the-spot verification records, on-the-spot verification reports and inspection reports of enterprises, fill in the review opinions according to the review results of all materials submitted by enterprises, and fill in the review report with the summary review results of the same batch of enterprise materials. The examination institution shall, within 0/0 day from the date of receiving the inspection report, submit a copy of the inspection report, a copy of the inspection opinions, a copy of the application for the production license of food packaging, containers and tools, a copy of the on-site inspection report of the enterprise and a copy of the inspection report to the examination center; The examination center shall complete the examination of the submitted materials within 10 days from the date of receiving the materials submitted by the examination institution, and report them to the AQSIQ for approval.

The General Administration of Quality Supervision, Inspection and Quarantine shall make a decision on whether to approve the production within 10 days from the date of receiving the materials. If the production is approved, the original and copy of the production license shall be issued to the enterprise within 10 days from the date of making the decision. If production is not allowed, it shall issue a decision not to grant administrative license to the enterprise within 10 days from the date of making the decision not to grant production; AQSIQ uniformly announces the list of certified enterprises to the public.

The production license is valid for 3 years. If an enterprise continues to produce after the expiration of the validity period, it shall reapply for the production license to the local provincial bureau of quality and technical supervision six months before the expiration of the validity period of the production license.

According to the regulations, an enterprise that has obtained a production license shall complete the printing (affixing) of QS mark and production license number within 12 months from the date of license. The QS mark of production license has three main functions: first, it shows that the product has obtained the production license; Second, it shows that the product has passed the factory inspection; Third, the enterprise clearly shows that the products meet the basic requirements of product quality and safety. The production license number consists of English letters QS and 12 Arabic numerals. QS stands for the production license of food-related products. The first two digits of 12 Arabic numerals are the number of the accepting provincial bureau, the middle five digits are the product number, and the last five digits are the enterprise serial number. The production license number is printed (pasted) on the product packaging, instructions or products by the enterprise itself.

Supervision and inspection

In order to prevent the phenomenon of heavy licensing, light supervision or only licensing without supervision, and promote enterprises to continuously meet the necessary conditions for ensuring product quality and safety, the quality inspection department supervises and inspects the production licenses of food packaging, containers, tools and other products and the licensed enterprises engaged in product production activities within the scope of license. Supervise and manage the certified enterprises, including daily supervision, regular supervision and inspection, annual report audit, etc. And investigate and deal with unlicensed enterprises, and supervise the license-issuing supervision departments, review institutions and license-issuing inspection institutions. According to the relevant regulations, after obtaining the production license, an enterprise shall ensure that the product quality is stable and qualified, carry out ex-factory inspection on the products in strict accordance with the provisions of national standards and industry standards, and submit the enterprise self-inspection report to the Provincial Bureau of Quality and Technical Supervision every year from the date of obtaining the certificate. The quality and technical supervision department will deal with the illegal production behavior of enterprises in law enforcement according to relevant laws and regulations.
