(1) knowledge of medicine and medical theory;
(2) medical skills, techniques, equipment, and utensils;
(3) single prescriptions, tested prescriptions, secret prescriptions, and canonical books;
(4) concoctions of medicinal herbs and techniques of making medicinal preparations;
(5) medicinal herbs, their cultivation, and breeding techniques, etc.
This book is the first of its kind in China.
The medical institutions of ethnic medicine referred to in these Regulations refer to hospitals, health centers, sanatoriums, outpatient clinics, clinics, health centers (rooms), etc., which have obtained the licenses for the practice of medical institutions in accordance with the law and are engaged in the medical services of ethnic medicine. Article 4 The development of ethnomedicine shall follow the principles of combining inheritance and innovation, protection and development, giving full play to the advantages of ethnomedicine resources, utilizing modern science and technology, and promoting the development of ethnomedicine theory and practice. Article 5 The people's governments at or above the county level shall incorporate the development of ethnomedicine into the national economic and social development planning at this level, and the necessary funds shall be included in the financial budget at this level, so as to reasonably increase the investment in the development of the cause of ethnomedicine. Article 6 The administrative department of traditional Chinese medicine of the people's governments at or above the county level shall be responsible for the management of ethnic medicine in the region, and other relevant departments shall be responsible for the work related to the management of ethnic medicine within their respective scope of responsibilities. Article 7 The people's governments at or above the county level may set up research and protection institutions for ethnic medicine to engage in the collection, excavation, organization and research of ethnic medicine.
Encouraging units and individuals possessing scriptures, documents, manuscripts, handwritten copies, single prescriptions, partial prescriptions, secret prescriptions, and tested prescriptions of ethnic medicine to donate the information and physical objects to the competent departments of traditional Chinese medicine, research and protection organizations, or medical institutions.
The people's governments at or above the county level shall reward the units or individuals who have made remarkable contributions to the protection, inheritance and dissemination of national medicines, and who have donated precious documents and effective treatment methods of national medicines in accordance with the relevant provisions. Chapter II Protection and Development Article 8 The people's governments at or above the county level shall support the construction of ethnomedicine hospitals and the development of ethnomedicine enterprises, encourage the participation of social forces in the construction, encourage medical institutions to set up ethnomedicine medical specialties, and encourage communities, townships, as well as village-level medical services to provide ethnomedicine medical services, and encourage financial institutions to give support to ethnomedicine enterprises. Article 9 The people's governments at or above the county level shall strengthen the hierarchical and categorized management of the traditional resources of ethnic medicine under their jurisdiction, conduct census, registration and management of the personnel engaged in ethnic medicine, and formulate plans for the protection of varieties of ethnic medicines. Article 10 The administrative department of medical security of the autonomous prefectures shall promptly incorporate qualified medical institutions of ethnic medicine into the scope of designated medical institutions for basic medical insurance, and the scope of designated medical institutions for direct settlement of inter-provincial and cross-provincial medical treatment. Article 11 The administrative department of traditional Chinese medicine of the people's government of the autonomous prefectures shall, according to the needs of the formation of national medicine expert committee, responsible for the formulation of technical specifications for the planting and breeding of national medicinal materials, national medicine medical specifications; to carry out the identification of national medicines; the validation of national medicines marking, symbols, directories; to carry out the work of the national medicines inheritors, the evaluation of scientific research achievements of national medicines, and so on. Article 12 The people's governments at or above the county level shall strengthen the protection of the resources of ethnic herbs, scientifically delineate the scope of protection and management and announce it to the society. Strengthen the investigation and handling of illegal acts such as indiscriminate mining, indiscriminate digging and indiscriminate hunting, and protect and rationally develop and utilize the wild medicinal resources of ethnic medicine. Article 13 The people's governments at or above the county level shall strengthen the promotion and training of planting and breeding techniques of ethnic medicinal herbs. Support the construction of production bases for ethnic medicinal herbs, and strengthen the rational development and utilization of ethnic medicinal herbs resources.
Ethnic medicine medical institutions, as well as those who have obtained a certificate of practice for rural doctors, in accordance with the relevant provisions of the state can grow, collect, purchase and concoct their own ethnic medicines and use them in their corresponding medical activities. Article 14 The collection and storage of ethnic herbs, as well as the processing of ethnic herbs, shall be in accordance with the relevant state technical specifications, standards and management regulations.
To protect the traditional concocting techniques and technology of ethnomedicinal tablets, and encourage the use of modern science and technology to carry out research on the concocting technology of ethnomedicinal tablets. Article 15 The people's governments at or above the county level shall strengthen the quality supervision and management of the whole process of circulation of ethnic herbs to ensure the quality and safety of ethnic herbs. Support the development of modern circulation system of national herbs, establish and improve the circulation of national herbs traceability system. Article 16 The people's governments at or above the county level shall take measures to cultivate research and development, production and sales enterprises of ethnic medicines, and promote the development of pharmaceutical enterprises of ethnic medicines. Article 17 encourages and supports medical institutions and research and development organizations to develop new preparations of ethnic medicines based on the theory of ethnic medicine.
Medical institutions shall only apply traditional techniques to formulate varieties of ethnic medicinal preparations, which can be formulated after filing with the competent department for drug supervision of the people's government of the province in accordance with the relevant provisions of the State. Drug supervision department of the people's government at or above the county level shall strengthen the supervision and management of the preparation and use of recorded varieties of ethnic medicinal preparations.
