Regulations on the Development of Ginseng Industry in Benxi City

Article 1 In order to protect and reasonably utilize ginseng resources and promote the sustainable development of ginseng industry, these regulations are formulated in accordance with the relevant laws and regulations of the State and in the light of the actual situation of the city. Article 2 These regulations shall be applicable to the ginseng industry related activities such as ginseng planting, processing, operation, inspection, identification, brand building and ginseng culture and its development and utilization in the administrative area of the city.

The ginseng referred to in these Regulations refers to wild ginseng and garden ginseng.

(1) Wild ginseng, commonly known as forest ginseng, refers to ginseng grown naturally in deep forests for more than 15 years after sowing;

(2) garden ginseng refers to ginseng cultivated in artificial whole land. Article 3 The municipal people's government shall incorporate the development of ginseng industry into the overall planning of national economic and social development, and establish and improve the coordination mechanism for promoting the development of ginseng industry.

The municipal administrative department of agriculture is responsible for the development of ginseng industry in the city. The ginseng industry administrative department determined by the people's governments of counties (districts) is specifically responsible for the development of the ginseng industry in the administrative area.

Forestry, industry and commerce, health, quality supervision, food and drug supervision and other departments, in accordance with their respective responsibilities, *** with the ginseng industry development work. Article 4 The municipal people's government shall adhere to the principles of ecological environmental protection, rational allocation of resources and optimization of industrial structure, formulate measures to scientifically adjust and optimize the industrial structure of ginseng planting, and encourage, support and promote the standardization of ginseng planting, deep processing and intensive development. Article 5 The municipal people's government shall organize and formulate the development plan of ginseng industry in the city, and connect with the planning of land use, forest land protection and utilization, soil and water conservation, ecological environmental protection, tourism and so on.

The key counties (districts) of ginseng industry development shall formulate the ginseng industry development plan and annual plan of the region according to the ginseng industry development plan of the city, and organize the implementation. Article 6 The municipal people's government shall, according to the city's ginseng resources, designate the key development areas for ginseng planting and, relying on the key development areas for ginseng planting, cultivate large-scale ginseng enterprises and ginseng industry clusters, and plan for the construction of ginseng research and development, deep-processing industrial parks, ginseng professional markets and ginseng trade and distribution centers.

The people's government of the region where the ginseng planting key development areas are located shall build ginseng logistics centers according to the ginseng industry development planning and location characteristics, establish ginseng information service platforms and develop ginseng e-commerce. Article 7 The municipal administrative department of agriculture shall, together with the administrative department of forestry, organize the administrative department of ginseng industry in counties (districts) to protect, develop and utilize the excellent ginseng germplasm resources according to law, and encourage and support the selection and breeding of excellent ginseng varieties and the cultivation of local varieties. Article 8 The municipal people's government shall organize agriculture, forestry, quality supervision and other departments and relevant enterprises and associations to formulate and promote standardized planting procedures.

Encourage and support the construction of ginseng standardized planting demonstration areas. Article 9 ginseng growers shall establish ginseng planting files, ginseng planting files since the ginseng sales retained for a period of not less than two years.

The ginseng planting records shall include the following contents:

(1) the name of the grower or the name of the enterprise and the basic information such as the address;

(2) the location of the planting plots and the soil test report;

(3) the name, source, usage, dosage and date of use of agricultural inputs such as seed, ginseng seedling, fertilizers, pesticides, etc.

(4) the date of disease, pests and diseases, and the date of use of agricultural inputs. p>(iv) the occurrence and prevention of diseases, pests, rodents and other disasters;

(v) the date of planting and the date of harvest;

(vi) the quality and safety inspection.

Encourage ginseng growers to rely on large growers, professional cooperatives and other new agricultural management bodies to establish ginseng planting electronic files.

Cities, counties (districts) agricultural administrative departments shall, together with forestry, food and drug supervision departments on ginseng cultivation and planting file management and guidance, free of charge to ginseng growers to provide planting file text. Article 10 prohibits the following acts in ginseng cultivation:

(1) using prohibited and restricted pesticides, fertilizers, agricultural films and other agricultural inputs in violation of the regulations;

(2) utilizing and using soil and seedlings with pesticide residues or heavy metals exceeding the standard;

(3) using irrigation water that does not comply with the prescribed standards;

(4) using domestic garbage, industrial waste and medical waste as fertilizers;

(e) other acts prohibited by laws and regulations that jeopardize the quality and safety of ginseng. Article 11 The processing and management of ginseng and its products shall comply with the relevant quality and safety standards.

Processors and operators of ginseng and its products shall establish and improve the quality and safety management of ginseng and its products as well as inspection and identification system, and shall be responsible for the quality and safety of ginseng and its products. Article 12 The operators or organizers of ginseng and its products centralized trading market shall perform the following management obligations:

(1) check the qualification of the operators;

(2) establish the operator file, record the basic situation of the operators, the main purchase channels, business varieties, brands and supplier status and other information;

(3) check the ginseng and its products inspection report or product qualification certificate;

(4) establish a system of quality and safety management of ginseng and its products, and shall be responsible for the quality and safety of ginseng and its products.

(4) sign a quality and safety management responsibility agreement with the operator to clarify the operator's management responsibility for the ginseng and its product quality and safety;

(5) regularly inspect the operator's business behavior and business records;

(6) other ginseng and its product quality and safety management obligations should be fulfilled.

The operator or organizer of the centralized trading market of ginseng and its products shall stop the operator from violating the law in time and report the relevant situation to the supervisory and management department of the market under the jurisdiction to deal with it.
