Article 2 The term "Songtao Reservoir" as mentioned in these regulations refers to the main project, reservoir area, and channels (including tailrace canal, main canal, main canal, and branch main canal) of Songtao Reservoir. Article 3 The water administrative department of the Provincial People's Government shall be in charge of the water resources and soil and water conservation work of Songtao Reservoir. The Songtao Water Conservancy Project Management Agency established by the water administrative department of the Provincial People's Government is responsible for the specific work of Songtao Reservoir management.
The environmental protection department of the Provincial People's Government supervises and manages the water environment protection and water pollution prevention and control work of Songtao Reservoir.
The provincial people's government's land, forestry, fishery, agriculture, public security, transportation, tourism, planning, construction and other competent departments and Baisha, Danzhou, Qiongzhong, Chengmai, Lingao, Haikou and other cities and counties , autonomous county people's government (hereinafter referred to as the relevant city, county, autonomous county people's government), in accordance with their respective responsibilities, coordinate to protect the ecological environment of Songtao Reservoir.
The environmental protection departments of the Provincial People's Government and the people's governments of relevant cities, counties, and autonomous counties, as well as other relevant departments, may entrust the Songtao Water Conservancy Project Management Agency with the power to impose administrative penalties involving the management of the Songtao Reservoir. The Provincial People's Government shall establish a comprehensive law enforcement system in a timely manner based on the actual needs of Songtao Reservoir management. Article 4 The Provincial People's Government and the people's governments of relevant cities, counties, and autonomous counties shall incorporate the ecological environment protection work of Songtao Reservoir into the national economic and social development plan.
The water administrative department and environmental protection department of the Provincial People's Government shall work with relevant departments and the people's governments of relevant cities, counties, and autonomous counties to prepare an ecological environment protection plan for the Songtao Reservoir, and submit it to the Provincial People's Government for approval before implementation. Article 5 The provincial people's government and the people's governments of relevant cities, counties, and autonomous counties should increase their financial investment in the ecological environment protection of Songtao Reservoir year by year.
The Provincial People's Government has established special funds for ecological environment protection of Songtao Reservoir. Article 6 The Provincial People's Government shall establish an ecological compensation mechanism for Songtao Reservoir. Specific measures shall be formulated by the Provincial People's Government. Article 7 The Provincial People's Government and the people's governments of relevant cities, counties, and autonomous counties shall strengthen land management and post-resettlement support in the Songtao Reservoir area, properly resolve the land and resettlement issues left over in the reservoir area, and gradually establish and promote the improvement of the ecological environment and economic development of the reservoir area. , a long-term mechanism for immigration to increase income and social stability. Article 8 The land (including islands in the reservoir) and water surface below the design flood level (193.031 meter contour) of the Songtao Reservoir area; within the outer slope feet of both sides of the Songtao Reservoir water delivery channel and fill canal section; excavated square ditches The management scope is within the excavation points on both sides of the section or the outer shoulder line of the canal top (if there is a drainage ditch, the drainage ditch shall prevail).
The design flood level of the Songtao Reservoir area extends horizontally within 400 meters outward; the main dam of the reservoir extends 500 meters, both sides of the auxiliary dam abutment and the foot of the backwater slope extend 100 meters, and the area around the spillway extends 500 meters. Within; 3 meters or 5 meters (tailrace canal, main canal) from the outer slope foot of the filled canal section of the water conveyance channel or the excavation point of the excavation canal section or the outer shoulder line of the canal top (if there is a drainage ditch, the drainage ditch shall prevail) The protection range is within 5 meters of the main canal and 3 meters of the main canal.
The specific boundaries of the management and protection scope of Songtao Reservoir shall be delineated by the provincial people's government, organized by the land and water administration departments, and signs shall be erected and announced. Article 9 The following activities are prohibited within the protection scope of Songtao Reservoir:
(1) Dam building, land reclamation for reservoir, blasting, well digging, quarrying, mining, and grave repair;
(2) Dumping and burying radioactive materials and other toxic and hazardous wastes;
(3) Setting up toxic and hazardous chemical warehouses and stacks;
(4) Applying highly toxic and highly toxic chemicals Toxic and high-residue pesticides;
(5) Discharging pollutants exceeding national standards;
(6) Other destructive behaviors that violate laws and regulations.
It is prohibited to carry out activities that endanger the safety of the dam, such as blasting, digging wells, quarrying, mining, sand dredging, soil borrowing, and grave repairing within the scope of dam management and protection.
Article 10 In addition to the behaviors prohibited by Article 9 within the management scope of Songtao Reservoir, the following behaviors are also prohibited:
(1) Construction of livestock and poultry farms;
(2) Setting up Docks for loading and unloading garbage, feces, oil and toxic substances;
(3) Dumping, stacking and storing soil, stones, slag, garbage and other solid waste on the beach or shore;
(4) Planting crops below the normal water level (190-meter contour);
(5) Exploding fish, poisonous fish, and electric fish;
(6) Catching larvae of rare fish and fishery resources such as long-rumped catfish (white bone fish), big-finned loach, and eel without authorization;
(7) Cleaning vehicles, containers and other items that have stored toxic and pollutants;
(8) Unapproved vehicles driving on dam tops, embankment tops, and gates;
(9) Other behaviors that violate laws and regulations. Article 11 The Songtao Reservoir drinking water source protection zone shall be demarcated by the Provincial People's Government in accordance with the law, and its grade classification and management shall be implemented in accordance with relevant national regulations.
The provincial people's government and the people's governments of relevant cities, counties, and autonomous counties should erect boundary markers in the Songtao Reservoir drinking water source protection zone. Article 12 It is prohibited to set up sewage outlets in the Songtao Reservoir drinking water source protection zone.
It is prohibited to build, reconstruct, or expand construction projects that have nothing to do with water supply facilities and water source protection within the first-level protection zone of Songtao Reservoir drinking water source; construction projects that have been completed and have nothing to do with water supply facilities and water source protection will be People's governments at or above the county level order demolition or closure.
It is prohibited to build, renovate or expand construction projects that discharge pollutants within the secondary protection zone of the drinking water source of Songtao Reservoir; existing construction projects that discharge pollutants shall be ordered to be dismantled or dismantled by the people's government at or above the county level. closure.
