Measures for the Implementation of Funeral Management in Xi'an (Amended 2021)

Article 1 In order to strengthen the management of funeral and burial, and promote the construction of socialist material civilization and spiritual civilization, according to the provisions of the State Council and the People's Government of Shaanxi Province on the management of funeral and burial, combined with the actual situation of the city, the formulation of these measures. Article 2 The municipal civil administration department is the administrative authority of the city's funeral management, and the municipal funeral management office is responsible for the specific organization and implementation of these measures. Public security, health, urban management, transportation, resource planning, market supervision, ecological environment and other departments shall cooperate with the civil administration department to do a good job related to funeral management. Article 3 The construction of funeral halls and crematoriums within the administrative area of the county, by the county civil administration department to put forward the program, reported to the county people's government for approval; district administrative area of the construction of funeral halls and crematoriums, by the municipal civil administration department to put forward the program, reported to the municipal people's government for approval.

Construction of funeral service stations and columbaria within the county administrative area shall be approved by the county civil administration; construction of funeral service stations and columbaria within the district administrative area shall be approved by the municipal civil administration. Article 11 within the cremation area, it is prohibited in the funeral home outside the courtyard, roads, hospitals, residential neighborhoods and other public **** place to set up sacrifices, burning offerings and sundries, and hold mourning activities. Prohibited in the funeral activities in the firecrackers and along the way to throw paper money, prohibited in the funeral activities in the feudal superstitions and activities that hinder the appearance of the city and traffic order. Article 12 No unit or individual shall provide vehicles and other means of transportation for illegal burials in cremation areas. Hospitals shall not be unauthorized to the remains of dead people to non-funeral special vehicles. Article 13 It is prohibited to bury corpses on both sides of railroads, highways and river embankments, as well as within 100 meters of places of interest, cultural relics protection zones, scenic areas and reservoirs. Existing graves in the above areas, except for the graves of revolutionary martyrs, the graves of eminent persons, the ancestral graves of overseas Chinese and ancient graves of historical, artistic and scientific research value protected by the state, shall be relocated or buried y within a certain period of time. Article 14 The production and sale of feudal and superstitious funerary objects are prohibited, and the sale of coffins and other earthly funerary objects in cremation areas is strictly prohibited. Article XV operating cremation cemeteries shall be in accordance with the relevant provisions of the state for approval procedures, without approval, shall not be established. Article XVI in the cemetery, public cemetery burial ashes of a single grave or double burial tomb covers an area of not more than 1 square meters; buried remains of a single grave covers an area of not more than 4 square meters, double burial tomb not more than 6 square meters.

The applicable period for cemetery graves and ash storage compartments is 20 years. The expiration of the period to continue to retain, shall apply for an extension of the use of formalities.
