Regulation on Human Organ Transplantation

China's first Regulation on Human Organ Transplantation is expected to be issued in the near future, which

will regulate organ transplantation, said Huang Jiefu, vice minister of health.

-China will introduce the first human organ transplantation regulations to establish eight principles

The new regulations strictly prohibit the sale and purchase of organs

It is understood that the first introduction of human organ transplantation regulations will be followed by eight principles, including voluntariness, informed consent, fairness and impartiality, technical access, non-commercialization, and self-determination. In response to the current tendency to buy and sell domestic organ transplants, Huang Jiefu particularly emphasized the principle of non-commercialization: "In 1991, the World Health Organization adopted the guiding principles of human organ transplants, which stipulates that the human body and all its parts should not be the object of commercial transactions, including advertisements for organs, as well as the payment and collection of money, should be prohibited. should be prohibited, as well as prohibiting any individual or organization involved in the organ transplant procedure from receiving remuneration other than appropriate service fees." Huang Jiefu said the above principles are also cited in China's newly formulated organ transplant regulations, and it is clearly stipulated that fees can be charged for items such as organ removal, preservation and transportation, but the organs themselves can never be used for trading.

Transplant organizations will implement an access system

In the process of soliciting opinions on the new regulations, the implementation of the access system for organ transplantation technology has attracted the attention of the transplantation community. According to an expert from the organ transplant center of a Beijing tertiary hospital, many medical institutions have blindly carried out organ transplant projects in recent years, driven by economic benefits, and sometimes as many as five or six hospitals in a region have done organ transplants, creating a chaotic situation of competition for donor organs and patients. Under the new regulations, only medical institutions with certain technical conditions, medical equipment and technicians can engage in organ transplants.

Huang Jiefu also affirmed that in the future, medical institutions at the level of township health centers will not be able to carry out organ transplants, "The measure of identifying only one hospital in a region to carry out organ transplants will not be forced at this time, but an access system must be introduced so that only hospitals with the necessary conditions are allowed to do so."

Brain death standard determined for the first time

Huang Jiefu also revealed that the new regulations will be the first time to take the cardiac arrest death and brain death two kinds of death standards coexist, the two choices of the autonomy of the regulatory approach. According to reports, the human brain death, there will still be a heartbeat and breathing, many people therefore believe that there is still life, but according to international standards, brain-dead patients no longer exist any possibility of survival. Therefore, the new regulations to determine that the determination of the patient brain death can be carried out after organ transplantation
