Chapter I General Provisions

Article 1 In order to strengthen the management of housing demolition and relocation in the county, to ensure the smooth advancement of urban construction, standardize the behavior of the demolition and resettlement compensation and safeguard the lawful rights and interests of the demolition of the demolition of the person and the person to be demolished, in accordance with the State Council "Regulations on the Administration of Demolition and Relocation of Urban Buildings," "Beijing City Urban housing demolition and relocation management measures", "Beijing collective land housing demolition and relocation management measures" and other relevant provisions, combined with the actual situation in the county, the development of this approach.

Chapter 2: Compensation and Resettlement for House Demolition on State-owned Land

Article 4: The demolition and relocation of residential houses on state-owned land shall be carried out in accordance with the principle of "pricing compensation and repurchase of oriented resettlement houses".

Article 5 For the demolition and relocation of residential bungalows, the legal land area of the residential base and the legal floor area shall be based on the area indicated in the certificate of ownership of the house or the official approval.

Article 6 The demolition and relocation of houses of residential bungalows shall be compensated in accordance with the following standards:

(1) Land compensation shall be given in accordance with the standard of RMB 4,200 per square meter for the legal land of the residential base up to and including 0.4mu; in accordance with the standard of RMB 2,100 per square meter for the portion from 0.4mu to 0.6mu (including 0.6mu); and in accordance with the standard of RMB 1,000 per square meter for the portion exceeding 0.6mu. compensated according to the standard of 1,000 yuan per square meter.

(2) Based on the appraisal results made by the commissioned real estate appraisal organization, the legally constructed houses will be compensated at the replacement cost.

Demolition of temporary buildings that have not exceeded the approved period of time shall be compensated according to the replacement cost; demolition of illegal buildings and temporary buildings that have exceeded the approved period of time shall not be compensated.

(3) The amount of compensation for appurtenances shall be determined by the appraisal of the real estate appraisal organization entrusted with the task.

Article 7 The buyback area of the targeted resettlement house shall be determined in accordance with the following standards:

(1) For the demolition of a residential bungalow, the area of the targeted resettlement house to be bought back at the buyback price shall be approved in accordance with the number of family members of the property owner multiplied by 45 square meters.

(b) According to the resettlement standard, the area of the directed resettlement house repurchased at the repurchase price is less than 70 square meters is resettled according to 70 square meters.

(3) The area of the targeted resettlement houses bought back at the buyback price shall not exceed at most the area of the land as stated in the house ownership certificate or official approval.

The area of the targeted resettlement houses bought back at the buyback price shall not exceed at most 0.4 mu if the residential land demarcated before 1982 exceeds 0.4 mu.

(4) The remaining portion of the area of the directed resettlement house bought back at the repurchase price voluntarily chosen by the evicted person, which does not reach the maximum standard of the area to be resettled, may be transferred among the immediate family members of the same evicted person within the scope of the project.

Article X. Chapter IV Compensation and Resettlement for Demolition and Relocation of Non-residential Houses

Article 20 For the demolition and relocation of non-residential houses, if the houses can be returned in situ, the demolition agent shall return the houses to the people to be demolished according to the original floor area, and shall not settle the difference in the price between each other; if the houses can not be returned in situ, the houses shall be compensated in a lump sum according to the appraised price made by real estate appraisal agencies.

Article 21 The demolition and relocation agent shall, on the basis of the valid proofs provided by the demolished person or the lessee (including the rental agreement, the proof of acquisition and installation of the appurtenant equipment, etc.), grant the demolished person or the lessee the comprehensive subsidy for stopping production and business, and the relocation and installation of the equipment in accordance with the provisions of the Annex to these Measures. Unable to restore the use of equipment, in accordance with the replacement price of equipment combined with the newness of the demolished person or housing tenant compensation.

Article 23 The demolished and relocated person who engages in production and business activities with residential housing shall be demolished and relocated in accordance with residential housing. If the following conditions are met, the demolisher shall be compensated in accordance with the provisions of Article 21 of these Measures:

(1) the demolished house has a certificate of ownership of the house or official approval;

(2) there is a business license, and the place of business indicated on the business license is the house to be demolished;

(3) the house to be demolished is actually used for production and operation before the demolition;

(4) Has applied for tax registration and issued tax payment certificates.

Chapter V. Related Subsidies and Incentive Standards

Article 24 Incentive compensation shall be given in accordance with the following standards to those who have built houses within the area of the legal residence base:

(1) The part of the legal residence base within 75% of the area of the house that has not been built shall be given an incentive compensation of 600 yuan per square meter.

(ii) The portion of the legal homestead area within 75% to 90% of the area of which no house has been built shall be given an incentive compensation of 400 yuan per square meter.

Article 25 Compensation for renovation shall be given in accordance with the standard of 300 yuan to 500 yuan per square meter according to the legal building area.

Article 26 If the demolished person voluntarily abandons the repurchase of the targeted resettlement house, the demolition compensation shall be approved by the demolisher in accordance with the provisions of these Measures and paid to the demolished person in a lump sum, and an incentive shall be given for the abandonment of the repurchase.

(1) The compensation for the demolition and relocation of bungalows includes the compensation for land under Article 6 or Article 14 of these Measures, the replacement price of the house, and all the relevant subsidies and incentives provided for in Chapter 5;

(2) The compensation for the demolition and relocation of buildings includes the compensation provided for in Paragraph 1 of Article 9 of these Measures, and all the relevant subsidies and incentives provided for in Chapter 5;

(3) Abandonment of repurchase incentives Fee = area of repurchase price due x standard of abandonment award.

The standard of abandonment award: abandonment of state-owned land housing, the abandonment award standard is 2,000 yuan per square meter; abandonment of collective land housing, the abandonment award standard is 1,000 yuan per square meter.

Article 27 The actual repurchase of targeted resettlement housing area less than the required repurchase price area, and did not transfer the remaining repurchase price of the part of the area, in accordance with the third paragraph of Article 26 of these measures to give the abandonment of the third paragraph of the standard purchase award.

Article 28 The demolition and relocation agent shall pay the relocation subsidy and related incentive fees to the demolished person or the tenant of the house, the specific standards are as follows:

(1) Moving subsidy fees. Subject to the building area stated on the certificate of ownership of the house or official approval. Residential bungalows are subsidized at 20 yuan per square meter, residential buildings are subsidized at 25 yuan per square meter, non-residential bungalows are subsidized at 30 yuan per square meter, and non-residential buildings are subsidized at 35 yuan per square meter. No subsidy will be given to those who are relocated by the demolisher.

(ii) Turnover subsidy. Calculated from the date of signing the resettlement compensation agreement, and issued quarterly until three months after receiving the notice of relocation. The turnover subsidy is based on the actual living population and is granted at the rate of 300 yuan per person per month; if a person gives up the repurchase of the targeted resettlement house, a one-time turnover subsidy of six months is granted.

Relocated bungalows and multi-storey residential buildings back to the period of 24 months, more than 24 months, the turnover subsidy standard in the original basis of 50%, more than 36 months, the turnover subsidy at the rate of 600 yuan per person per month to give subsidies; high-rise residential buildings back to the period of 36 months, more than 36 months, an increase of 50% on the basis of the original, more than 48 months, the turnover subsidies The subsidy will be given at the rate of 600 yuan per person per month.

(3) Early moving incentive fee. For the evicted person to sign the resettlement and compensation agreement to vacate and deliver the house within the relocation period stipulated in the announcement, a reward of 50,000 yuan will be given. If the deadline is exceeded, no reward will be given.

(4) The compensation for each removal and installation fee is based on the following standards. If the market price changes, the compensation standard will be adjusted accordingly.

1. Telephone removal fee of 470 yuan;

2. Air conditioning removal fee of 600 yuan;

3. Cable TV removal fee of 200 yuan;

4. Solar removal fee of 600 yuan.

Chapter VI Supplementary Provisions

Article 29 For the demolition and relocation of houses outside the planning area of the new town of Miyun County, the repurchase price and preferential price standard shall be based on the actuality of the project, and shall be examined and submitted by the County Housing and Construction Committee to the County Demolition and Relocation Leadership Group for approval before implementation.

Article 30 The compensation for the relocation of cemeteries involved in the scope of demolition and relocation shall be formulated by the local township government in accordance with the relevant provisions of the civil affairs department to set specific standards.

Article 31 Issues in the implementation of these measures shall be interpreted by the county housing and construction commission.

Article 32 These Measures shall come into force on the date of publication. These Measures shall not apply to the demolition and relocation notices issued before the implementation.
