Article 36 of the industrial solid waste unit shall establish and improve the industrial solid waste generation, collection, storage, transportation, utilization, disposal of the whole process of pollution prevention and control of the environment, the establishment of the management of industrial solid waste ledger, truthful record of the type of industrial solid waste generated, Quantity, flow, storage, utilization, disposal and other information to achieve industrial solid waste can be traced, can be queried, and take measures to prevent and control industrial solid waste pollution of the environment.

It is prohibited to put industrial solid waste into domestic garbage collection facilities.

Article 37 The unit that generates industrial solid waste entrusts others to transport, utilize or dispose of industrial solid waste, it shall verify the subjective qualifications and technical capabilities of the entrusted party, sign a written contract according to law, and agree on pollution prevention and control requirements in the contract.

The entrusted party to transport, use, disposal of industrial solid waste, should be in accordance with relevant laws and regulations and contractual agreements to fulfill the requirements of pollution prevention and control, and will be transported, use, disposal of industrial solid waste units to inform the generation.

Industrial solid waste generating units in violation of the provisions of the first paragraph of this article, in addition to be punished in accordance with relevant laws and regulations, shall also be jointly and severally liable with the entrusted party causing environmental pollution and ecological damage.

Article 38 Units generating industrial solid waste shall, in accordance with the law, implement cleaner production audits, rationally select and utilize raw materials, energy and other resources, and adopt advanced production processes and equipment, so as to reduce the amount of industrial solid waste generated, and to reduce the hazardous nature of industrial solid waste.

Article 39 The units that generate industrial solid waste shall obtain a sewage discharge permit. The specific methods and implementation steps of the sewage discharge license shall be prescribed by the State Council.

Units generating industrial solid waste shall provide the competent ecological and environmental authorities at their location with relevant information on the types, quantities, flows, storage, utilization and disposal of industrial solid waste, as well as specific measures to reduce the generation of industrial solid waste and promote comprehensive utilization, and to implement the relevant provisions of the sewage discharge permit management system.

Article 40 of industrial solid waste generated by the unit shall be based on economic and technological conditions of industrial solid waste to be utilized; for the time being does not use or can not be utilized, shall be in accordance with the provisions of the State Council department in charge of ecological and environmental protection and other construction of storage facilities, places, safe and classified storage, or to take harmless disposal measures. Storage of industrial solid waste should be taken in line with national environmental protection standards of protective measures.

Construction of industrial solid waste storage, disposal facilities, places, should be consistent with national environmental protection standards.
