(1) If a construction project may have a significant impact on the environment, an environmental impact report shall be prepared to conduct a comprehensive and detailed evaluation of the pollution generated by the construction project and its impact on the environment;
(2) If a construction project may have a slight impact on the environment, an environmental impact report form shall be prepared to conduct analysis or special evaluation of the pollution caused by the construction project and its impact on the environment;
(3) If the construction project has a very small impact on the environment and does not require environmental impact assessment, an environmental impact registration form must be filled in.
According to this regulation, when opening a chemical factory, an environmental impact report must be prepared, and when opening a restaurant, a report form or registration form must be prepared based on regional sensitivity and business area. Article 25 of the Environmental Assessment Law stipulates: If the environmental impact assessment document of a construction project has not been reviewed by the approval department in accordance with the law or has not been reviewed and approved after review, the construction unit shall not start construction.
2. Article 19 of the "Regulations on Environmental Protection Management of Construction Projects" stipulates: A construction project that prepares an environmental impact report form or an environmental impact report form can only be put into production or use if the environmental protection design of its supporting construction has passed the acceptance test. Those that fail the acceptance inspection shall not be put into production or use. Projects included in the exempted environmental assessment management do not need to undergo environmental assessment and acceptance, but they must still implement relevant environmental protection measures to prevent environmental pollution and ecological damage, and be included in the management of pollution discharge licenses in accordance with relevant regulations.
Extended information:
The revised "Directory" includes 7 main articles and tables including 55 first-level industries and 173 second-level industries. New "Directory":
1, clarifying the principle of no environmental impact assessment outside the list
It is proposed that "construction projects that have not been stipulated will not be included in the environmental impact assessment management of construction projects". At the same time, the way to include environmental impact assessments for emerging industry projects that are really necessary is clarified.
2. Further define the environmental impact assessment of reconstruction and expansion projects that do not involve the main project.
It is clear that the classification should be determined according to the content of the reconstruction and expansion projects to solve the problem of "higher rather than lower" during implementation.
3. Strengthen the connection with the pollution discharge permit system
Agricultural and sideline food processing, equipment manufacturing and other industries that can be managed through emission permit registration, as well as egg processing, catering, entertainment and bathing places, agricultural reclamation, general warehouses, etc. that have little environmental impact no longer need to fill in the environmental impact registration form, ***involving 40 Secondary industries; in addition, the concept of "industrial buildings" is introduced, and 26 secondary industries such as wine and beverage manufacturing are clarified. Only those located in industrial buildings are included in environmental impact assessment management.
4. Reduce the environmental impact assessment categories of some projects
For example, grain grinding, etc., have been reduced from reports to report forms; small-scale domestic waste centralized disposal, etc. have been reduced from reports to registration forms; desulfurization, denitrification and environmental protection projects, etc., have been reduced from report forms to registration forms, with a total of 51 Secondary industries have been simplified to varying degrees.
