Chapter I General Provisions
Article 1 According to the relevant guidelines, policies, decrees formulated by the state, based on the "Chinese People's Republic of China *** and the State Economic Contract Law", "Chinese People's Republic of China *** and the State Railway Law" and the "Regulations for the Implementation of Contracts for the Transportation of Goods by Railway" as the basis for the "Rules for the transportation of goods by railroads".
Article 2 carriers and shippers, consignees in the process of cargo transportation, shall comply with the provisions of these regulations, to work closely with, good collaboration, care of transport materials and railroad transport equipment, strict fulfillment of the contract of carriage, safe, speedy, economical and convenient delivery of goods.
Article 3 The right to modify and interpret these regulations belongs to the Ministry of Railways, and their formulation, modification or abolition shall be announced beforehand.
The Railway Bureau, without violating the conditions of these regulations, may formulate supplementary regulations within the management, and report them to the Ministry of Railways for the record.

The national business railroad cargo transportation, in addition to international intermodal transportation, surface transportation, military transportation, except as otherwise provided, are applicable to these regulations.
The rules and regulations extended by these regulations are:
1. Railway cargo tariff rules;
2. Railway dangerous goods transportation rules;
3. Railway fresh goods transportation rules;
4. Railway overloading rules;
5. Railway cargo loading and consolidation rules;
6. Monthly cargo transportation plan preparation;
7. Freight daily work organization;
8. Express cargo transportation;
9. Railway container transport;
10. Railway freight transportation of insured goods;
11. Wagon extension fee collection methods;
13. Other methods developed in accordance with the spirit of the regulations.
Chapter II Cargo Transportation
Section I. Basic Conditions of Cargo Transportation
Article 4 The types of goods transported by railroads are divided into carloads, LTL and containers.
The weight, volume or shape of a batch of goods need to be transported in more than one truck, it should be consigned by the car; not enough conditions for transportation of trucks, according to the LTL consignment; in line with the conditions of container transportation, can be consigned by the container. According to the LTL consignment of goods, a minimum volume shall not be less than 0.02 cubic meters (a weight of more than 10 kilograms except), each batch shall not exceed 300 pieces.
The following goods shall not be transported on LTL basis:
1. Goods that need to be refrigerated, insulated or heated for transportation;
2. Dangerous goods that are limited to be handled on a full truckload basis;
3. Dirty goods that are easily contaminated with other goods (e.g., bones, wet furs, dung, and charcoal black, etc., that are not disinfected or packaged in a sealed, leak-free package);
4. bees; 5. goods that cannot be easily counted in pieces;
5. movable objects that are not packed in containers (except for those that can be transported as LTL in the pipeline as stipulated by the Railway Bureau);
6. goods with a weight of more than 2 tons, a volume of more than 3 cubic meters, or a length of more than 9 meters in one piece of cargo (except for those that do not interfere with loading and unloading operations in the transfer stations and arrival stations as confirmed by the originating station).
In the special line or special railroads within the organization of direct full LTL transport, agreed by the Railway Bureau by the station and the shipper to negotiate and sign an agreement to deal with; such as the organization of transit full LTL, should be agreed by the Railway Bureau.
Container transportation according to the provisions of the "Railway Container Transportation Measures".
Rapid transportation of goods, according to the provisions of the "Express Cargo Transportation Measures".
The transportation of goods under specific conditions is handled in accordance with the provisions of Annex I "Specific Conditions of Transportation".
Only through transportation of whole cargos is handled between permitted and metered tracks. However, the following goods are not subject to through transport:
1. Live and fresh goods and goods requiring refrigeration, thermal insulation or heating for transport;
2. Goods transported in tank cars;
3. Goods weighing more than 5 tons each (except for those agreed upon in particular), with a length of more than 16 meters, or with a volume that exceeds the limit of loading on the metre gauge.
Article 5 consignment of goods according to a batch, must be the shipper, consignee, station, station and loading and unloading locations are the same (except for full truckloads of goods). Whole carloads of goods per car for a batch. Cross-loading, climbing loads and the use of rover goods, each group of cars for a batch.
Quasi, inter-metre track through the transport of whole cargos, a batch of weight or volume should meet the following requirements:
1. Heavy cargo weight of 30, 50, 60 tons (does not apply to the provisions of the wagon load increase);
2. Floating volume of 60, 95, 115 cubic meters of cargo.
LTL cargo or goods transported using containers, to each cargo waybill as a batch. Goods transported using containers, each batch must be the same box type, at least one box, up to a maximum of one wagon of the railroad can be loaded with the number of boxes.
The following goods shall not be transported in one consignment:
1. Perishable goods and non-perishable goods;
2. Dangerous goods and non-dangerous goods (except as otherwise provided);
3. According to the nature of the goods can not be mixed with the goods transported;
4. Insured goods and uninsured goods;
6. Different conditions of transportation of goods.
The goods specified in the preceding paragraph, in special circumstances, recognized by the Railway Board may also be transported in one consignment.
Article 6 Article 4 of these Regulations shall not be consigned by LTL of goods, in addition to bees, the use of refrigerated cars to ship the need for refrigeration or heat preservation of goods and goods that are not easy to calculate the number of pieces of goods, the number of insufficient to a car, such as the shipper's request will be the same path to the two or three to the station to unloading of the goods at the station, loaded on the same wagon as a batch of transportation, may be consigned by the car unloading consignment.
Article 7 of the goods transported by car, the shipper requires handling within the boundaries of the station or loading and unloading on the way (including in the station does not handle freight business loading and unloading), upon approval, can be handled by the Railway Bureau from the Bureau of Management. However, dangerous goods shall not be handled within the station boundary handling or en route loading and unloading.
En route loading and unloading of goods, according to the shipper's request, in order to en route loading and unloading of the rear or front of the station for freight business as the station of departure or arrival.
Article 8 When the representative of the shipper or consignee or the agent entrusted with the consignment, collection, alteration or fulfillment of other rights and obligations of the goods, a power of attorney (Form 4) or a letter of introduction certifying the entrustment shall be presented to the station.
Section 2: Conclusion of Contract of Carriage of Goods
Article 9 The shipper to transport goods by rail may sign an agreement for the carriage of goods on an annual, semiannual, quarterly or monthly basis, or may sign a transport agreement for a longer period of time; during the period of the agreement, the shipper may determine the demand with the carrier by stages, and when delivering the goods, propose to the carrier a waybill for the goods by batch as an integral part of the contract of carriage. The shipper and the carrier may, during the term of the agreement, determine their needs by stages and, when delivering the goods, present to the carrier a cargo waybill on a batch basis as part of the contract of carriage. Other goods use the goods waybill as the contract of carriage.
The preparation of the cargo transportation plan in accordance with the "Interim Measures for the Management of Railway Cargo Transportation Planning".
Article 10 for the rescue and relief materials, directly used in agricultural production, fresh and live goods and other materials need to be transported in a hurry, should be prioritized for transportation.
Section 3: Consignment, acceptance and transportation of goods
Article 11 The consignor to the carrier to deliver the goods, should be presented to the station according to the batch of goods waybill (Form I) a. The consignor shall not be responsible for the transportation of the goods, and shall not be liable for any loss or damage. The use of mechanical refrigerated truck transportation of goods, the same station, the same consignee can be several batches of a waybill. Whole car unloading of goods, in addition to the basic cargo waybill, each unloading station should be added to the unloading of goods waybill two (unloading station, the consignee of a copy of each).

The shipper consigns too many goods according to a batch of goods, can not fill in the waybill one by one, or consignment of moving goods, as well as the same package with more than two kinds of goods, must be presented to the list of items (Form 3) in triplicate. After stamping the date of carriage at the station, one copy shall be kept by the sending station for inspection; one copy shall be submitted to the station together with the transportation bill; and one copy shall be returned to the shipper. In addition to personal consignment of goods, you can use other documents with the contents of the list of goods instead of the list of goods.
The shipper shall be fully responsible for the truthfulness of the entries in the goods waybill and the bill of lading, and shall pay liquidated damages for anonymity and misstatement of the name and weight of the goods in accordance with the regulations.
Article 12 Consignment of perishable goods, short-lived? Short life? Radioactive goods, the permissible period of transportation of goods should be noted. The permissible period of transportation shall be at least three days longer than the period of arrival of the goods.
Article 13 The shipper consignment of goods, divided into insured and uninsured transportation of two kinds, according to which mode of transportation, the shipper in the waybill to choose to determine.
Individual consignments are handled in accordance with the provisions of the Measures for the Transportation of Personal Effects (Annex IV)
.
Transportation of goods at a guaranteed price, the railroads charge a guaranteed price for goods.
Article 14 According to the central or provincial (municipal), autonomous region decree, the need for documents to transport the goods, the shipper should be the documents and goods waybill at the same time, and in the goods waybill shipper records the matters indicated in the column of the name and number of the document. Station in the back of the supporting documents indicate the number of consignments, and stamped with the station date stamp, returned to the shipper or according to the regulations to stay in the station for inspection.
For customs, quarantine procedures and other special circumstances of the supporting documents and the number of the goods, quality, specifications of the documents, can be entrusted to the carrier to the station delivery to the consignee.
The shipper shall firmly attach the relevant documents or papers entrusted to the carrier to be delivered to the cargo waybill and indicate the name and number of pages in the shipper's entry on the cargo waybill.
The carrier shall refuse to accept any goods that are required to be transported on the basis of supporting documents if the shipper fails to provide such documents as required.
The shipper shall be responsible for the authenticity of the documents it produces.
The carrier shall pay attention to the custody of documents or papers entrusted to it by the shipper in the course of delivery, and in case of loss, it shall prepare a general record at the arrival station to prove it.
Article 15 consignor consignment of goods, according to the nature of the goods, weight, type of transport, transport distance, climate and truck loading and other conditions, the use of transport requirements, to facilitate loading and unloading and to ensure the safety of the goods transport packaging. There are national packaging standards or Ministry packaging standards (industry packaging standards), according to national standards or Ministry standards (industry standards) for packaging.
The transportation of goods packaging does not meet the requirements of the preceding paragraph, should be improved by the shipper after the carrier.
There is no uniform provision for packaging standards, the station should work with the shipper to study the development of temporary standards for the transport of goods packaging, *** with the implementation. For the need for trial shipments of goods transport
transport packaging, unless otherwise specified, the station and the shipper can agree on the conditions for the organization of trial shipments.
The carrier and the shipper shall actively carry out containerized transport to ensure the safety of the goods.
Defects in the state of the goods, which do not affect their safety, may be carried by the shipper with specific indications in the goods waybill.
Article 16 consignor consignment of LTL goods, should be marked on each piece of cargo clear and obvious mark (cargo label) (Form V). The marking shall be made of tough material. In each piece of cargo at each end of the paste or nailed a, packaging is not suitable for paste or nailed, you can use the tethered approach. Unsuitable for paper marking of goods, should use paint in the shipment of written markings or markings made of metal, wood, cloth, plastic plates and other materials.
Checked baggage, moving goods, in addition to the use of cloth, wood, metal and other tough materials or writing markers, and should be placed inside the package of goods marking (cargo label).
The shipper shall, according to the nature of the goods, in accordance with national standards, in the packaging of goods to do a good job on the packaging, storage and transportation of graphic signs (see Appendix).
Goods on the shipment of goods unrelated to the batch of transportation markings and packaging, storage and transportation of graphic symbols, the shipper must remove or erase.
Article 17 of the railroad transportation of goods according to the number of pieces and weight. However, the following goods, according to the whole car transportation, only according to the weight of the carrier, do not count the number of pieces:
1. bulk goods;
2. pieces of goods with the same specifications (specifications within three kinds of the same specifications), a batch of more than 2,000; specifications are different, a batch of more than 1,600 pieces.

1. needles, textiles, clothing, socks, shoes, hats;
2. clocks and watches, Chinese and Western medicines, cigarettes, stationery, musical instruments, arts and crafts;
3. flour, fertilizers, shoes, caps and other products. p> 3. Flour, soap, candy, rubber, paint, dyes, tires, canned food, bottled alcohol, medical equipment, laundry detergent, sewing machine head, empty cylinders, chemical reagents, glass instruments, 241 liters of empty iron drums.
4. Television sets, radios, tape recorders, record players, electric fans, computers, cameras.

Article 18 The shipper must escort movable objects, live plants that need to be watered for transportation, goods that are heated by fire for transportation, locomotives and railroad cranes that are attached to the shipment, as well as goods that should be escorted by special provisions. The number of escorts shall not exceed two per shipment, except in specified cases. The shipper's request for additional escorts or for goods other than those mentioned above shall be recognized by the carrier when the shipper requests an escort.
The escort shall be billed for the escort's ride.
For shipments with an escort, the shipper shall indicate the name of the escort and the name and number of the document in the freight waybill, which shall be examined and approved by the station and issued to the escort (Form 6), and shall be indicated in the consignment note (A), which shall be signed by the shipper.
The escort shall ride in the truck under escort, or if the truck is not suitable for riding, he may ride in the guard vehicle or the vehicle designated by the captain or station master.
The escort shall be responsible for taking measures to ensure the safety of the goods under escort.
If the goods are found to be rotten, deteriorated, diseased, injured or damaged, the escort shall immediately make a declaration to the captain of the vehicle or the station master, who will assist in dealing with the matter appropriately.
The escort shall comply with the matters specified in the instructions to the escort and the regulations concerning the transportation of goods by railroad.
The carrier shall inform the escort of safety precautions and provide working and living conditions.
The escort shall be treated as a passenger in case of personal injury from the time the carrier carries the goods to the time the delivery is completed.
Article 19 The cost of transportation of goods shall be calculated in accordance with the provisions of the Rules for the Carriage of Goods by Railway. The shipper shall pay the charges on the day the goods are carried at the point of departure. For goods carried after 18:00
The station shall indicate in the cargo ticket (Form 2) under the date of carriage stamp ? The next day? The transportation cost can be paid on the next day. Due to the temporary occurrence of rescue, disaster relief, epidemic prevention and other situations, payment at the sending station is difficult, agreed by the sending Railway Bureau, can be paid later or by the consignee at the station to pay.
Frequent consignment or collection of goods shipper or consignee, can be summarized on a daily basis to pay the transport costs, the time does not affect the transport costs sent to the bank under the premise of the station manager in accordance with the specific circumstances of the shipper or consignee agreed.
In case of late payment of transportation charges by the shipper or consignee, the carrier shall be paid the prescribed late payment of freight and miscellaneous charges.
Article 20 The goods transported in LTL and containerized transport, by the departure station to receive the completion of loading of full truckloads of goods, the departure station in the goods waybill stamped with the station date stamp (format VII), that is, from the time of the carrier.
The implementation of pre-shipment custody of the station, the shipper has been moved to the station in full batch of the whole carload of goods, from the receipt of the completion of the time, the responsibility of pre-shipment custody.
When the station carries the goods, it should give the shipper the voucher and the ticket to the shipper. The shipper should give the consignee the voucher in time to contact the station to collect the goods.
Section IV of the goods moved in, loading and unloading
Article 21 Where the goods loaded in the station public **** loading and unloading places, the station should be organized in a timely manner loading. When the station receives the goods, it shall check the name, number of pieces, transportation packaging, marking and reinforcing materials.
Full truckloads of goods due to vehicle volume or weight limitations, after loading the remaining goods, the station shall negotiate with the shipper to deal with.
Article 22 The organization of loading and unloading of goods is the responsibility of the carrier within the public **** loading and unloading place of the station. However, the shipper or consignee shall be responsible for organizing the loading or unloading of goods transported in tank trucks, frozen perishable goods, uncontained movable objects, bees, fish fry, radioactive isotopes weighing more than one ton in one piece, as well as loading and unloading of machinery and vehicles with motive power by manpower.
Other goods due to the nature of the special, by the shipper or consignee request, and the consent of the carrier, may also be shipper or consignee organization loading or unloading.
Article 23 Cargo loading or unloading, should be under the conditions of ensuring the safety of goods, and actively organize fast loading and unloading, day and night uninterrupted operation, in order to shorten the stay time of trucks, accelerate the transport of goods.
The station shall sign a transportation agreement with each special railroad, special line owners, reported to the competent railroad bureau for the record. The content of the agreement is stipulated by the Railway Bureau. Shippers, consignees use others to load and unload wagons on the special line, should be signed with the station, the special line owner of the transportation agreement. Special line **** use of units sent to the goods, the implementation of the station public **** loading and unloading place of charge policy.
By the shipper or consignee to organize the loading or unloading of trucks, the station should be in the truck before the transfer to the transfer time to inform the shipper or consignee. The shipper or consignee in the loading and unloading operation is completed, should be loaded or unloaded finished time to inform the station.
The shipper or consignee is responsible for organizing the loading and unloading of trucks, more than the required loading and unloading time standards or the required stay time standards, the carrier shall be to the shipper or consignee to collect the required wagon charges.
When local railroads use railroad cars, they shall pay the required vehicle usage fees.
All goods stored in the loading and unloading places shall be more than 1.5 meters away from the outside of the rails of the goods line, and shall be stacked neatly and firmly.
Article 24 The carrier shall allocate appropriate vehicles in accordance with the type of vehicle agreed in the contract of carriage. If the carrier does not have the appropriate allocation of trucks, with the consent of the shipper, to ensure the safety of goods, truck integrity and ease of loading and unloading operations under the conditions can be used instead. To grow cargo car, refrigerated car instead of other vehicles and change the scope of use of tank cars, should be recognized by the Ministry of Railways; other vehicles instead of shed car, should be recognized by the Railway Bureau.
Vehicle substitution must comply with the "Railway Cargo Loading Reinforcement Rules" in the ? Wagon Use Restriction Table? s regulations.
For confidential materials, foreign-related materials, precision instruments, exhibits, can be transported in a shed car must be used to transport shed cars, shall not be replaced by other wagons.
Article 25 The carrier shall allocate good condition and clean wagons to load the goods. Before loading, the loading unit shall check the integrity and cleanliness of the wagon.
The shipper organizes the loading of wagons, before loading, found in the car left residual goods, shall notify the station to clean or deal with. If the station commissions the shipper to clean on its behalf, it shall pay the shipper the prescribed wagon cleaning fee.
The shipper of the carrier allocated wagons require scrubbing and disinfection, handled by the railroad, to the shipper to charge the shipper scrubbing and disinfection of wagons.
Article 26 The carrier and the shipper loading goods, should continue to improve the loading method, make full use of the wagon's load capacity or volume, but shall not exceed the wagon's allowable
load capacity. Due to the weight of the goods packaging, protective materials affect the net weight of the goods, or mechanical loading
loading is not easy to calculate the number of pieces of goods loaded tonnage reduction is difficult, can be loaded, but shall not exceed the wagon marking the load capacity of 2%; cargo loading height and width, in addition to overloading of the goods and there are specific exceptions, shall not exceed the limits of rolling stock or a specific section of the loading limits.
Freight shall be charged if the load exceeds the permissible load capacity of the truck.
Cargo loading reinforcement should be handled in accordance with the provisions of the "Railway Cargo Loading Reinforcement Rules".
Tank car loaded goods should be loaded to the bottom of the air bag or the specified height, and the loading unit is responsible for the oil discharge valve closed tight.
Article 27 The shipper to organize the loading of goods, the use of railroad wagon tarpaulin, the nuclear charge for the use of wagon tarpaulin, and the integrity of the tarpaulin state should be checked to ensure that the tarpaulin is good.
When the shipper uses its own tarpaulin, it should be recorded in the shipper's record of the goods waybill column? Self-provided tarpaulin?
Special line for loading the use of railroad wagon tarpaulin or arriving at the special line of the railroad wagon tarpaulin, respectively, by the shipper and consignee is responsible for picking up and delivering to the station.
The use of railroad wagon tarpaulin to cover the wagons, according to the use of the number of sheets to the shipper to charge for the use of wagon tarpaulin.
Railway truck tarpaulin arriving at the special line or special railroad, the consignee should be sent back to the station within 2 days from the day after the truck is delivered to the unloading place or handover place. More than the specified period, the period in excess of the tarpaulin extended use fee.
Article 28 The goods loaded with the goods required to equip the goods wagon (livestock racks, tarpaulin supports, grain baffles, feeding equipment, cold quilts, thatching items) and cargo reinforcement materials prepared by the shipper, and should be in the goods waybill shipper's records of the matters noted in the column of the name and the number of pieces, in the station together with the goods and delivered to the consignee. Truck equipment items and cargo reinforcement materials prepared by the carrier on behalf of the service charge for the use of loading and reinforcement materials.
If the consignee needs to send back the above wagon equipment items or reinforcing materials to the designated station, the consignee shall fill out the Special Transportation Certificate (Form VIII) within the next day of the carrier's delivery of the goods by the arriving station visa, and consign the goods within 30 days, and the freight fee will not be charged.
Quasi, inter-metre railroad cargos through transportation, goods at the loading station needs to be reinforced by the loading station preparation, the cost of which should be filled in the notice of advance, notify the station to the consignee to collect.
International intermodal export cargo equipment items and reinforcing materials by the foreign trade agency at the border station instead of the consignee to send back.
The shipper's own assembled appliances, explosives safes in line with the "Railway Cargo Tariff Rules" specific tariff range, the consignee needs to be sent back to the designated station, in accordance with the provisions of the second paragraph of this article for transport formalities, and pay the freight charges.
Article 29 The use of shed cars, refrigerated cars, tank cars, container transport of goods, by the organization of the loading or crating unit responsible for the sealing of the wagon or container. However, the goods sent with an escort, the need to ventilate the transport of goods and the organization of loading units that do not need to apply the seal of the goods (except for container transport of goods), can not apply the seal.
The wagons or containers to be sealed shall be noted on the cargo waybill, ticket envelope and wagon loading list. If sealing is done with sealing locks, sealing rings or numbered sealing pliers, the sealing number shall be noted.
The technical requirements for sealing and unsealing should be handled in accordance with the Regulations on Sealing and Unsealing of Wagons and Containers (Annex II).
