Provisions on the Discussion of Major Matters by the Standing Committee of the Yunnan Provincial People's Congress

Article 1 In order to regulate the Standing Committee of the Provincial People's Congress (hereinafter referred to as the Standing Committee of the Provincial People's Congress) in exercising its authority to discuss and decide on important matters in accordance with the Constitution of the People's Republic of China, the Organic Law of the People's Congresses of the People's Republic of China and the People's Governments of the People's Republic of China at Local Levels and the Organizations of the People's Governments of the People's Republic of China at Local Levels and other relevant laws, and taking into account the actual situation of the Province, the Provisions are formulated. Article 2 The major matters referred to in these provisions refer to those matters within the administrative area of the province which are related to the overall situation of reform, development and stability, or which involve the people's vital interests and are of general concern to the society, and which shall be discussed and decided by the Standing Committee of the Provincial People's Congress. Article 3 The Standing Committee of the Provincial People's Congress shall, in discussing and deciding on important matters, adhere to the leadership of the Communist Party of China, give full play to democracy and proceed in strict accordance with the law.

The Standing Committee of the Provincial People's Congress shall report annually to the Provincial People's Congress on the discussion and decision of important matters in the preceding year. Article 4 The following major matters shall be discussed and decided by the Standing Committee of the Provincial People's Congress:

(1) major measures taken to ensure compliance with and implementation of the Constitution, laws, administrative regulations and resolutions and decisions of the National People's Congress and its Standing Committee, and of the Provincial People's Congress;

(2) major matters which, according to the provisions of the law, shall be discussed and decided by the Standing Committee of the Provincial People's Congress;

(3) major matters relating to economic construction, economic development and the development of the economy, and the development of the economy. p>(3) major reform decisions on economic construction and social development;

(4) major measures to strengthen the construction of democracy and the rule of law;

(5) major decisions on population and family planning, environmental and resource protection, and progress in national unity;

(6) decisions that need to be made in the implementation of supervision over the Provincial People's Government, the Provincial Higher People's Court, the Provincial People's Procuratorate, and the people's congresses and their standing committees of the lower level;

(1) the establishment and adjustment of the constituent departments of the provincial people's government;

(2) changes in the administrative divisions of the counties and adjustments in the names of the regions;

(iii) Formulation and modification of provincial urban system planning;

(iv) Important situations in the implementation of provincial regional development planning across state (city) administrative regions;

(v) Important situations in the supervision of state-owned assets;

(vi) Major projects with provincial financial input or government financing;

(vii) Education, healthcare, social security, employment and other important situations concerning people's livelihood;

(viii) important situations concerning economic construction and social development;

(ix) important situations concerning trials and procuratorial work;

(x) other important matters which the Standing Committee of the Provincial People's Congress deems it necessary to report. Article 6 Matters of significance shall be raised in the form of a motion or a report, and the procedures for their raising and consideration shall be in accordance with the procedures set forth in the Rules of Procedure of the Standing Committee of the Yunnan Provincial People's Congress. Article 7 A motion or report on a major matter shall include the following main contents:

(1) the basic situation and the main problems to be solved;

(2) the relevant legal and policy grounds;

(3) the decision-making program;

(4) other relevant information to be submitted. Article 8 The Standing Committee of the Provincial People's Congress shall, within two months from the date of receipt of a motion or report on a major matter, deliberate on it. If, due to the complexity of the situation, it is not possible to deliberate on time, the relevant specialized committee or working committee shall report to the meeting of the chairperson of the Standing Committee of the Provincial People's Congress. With the consent of the Presidium of the Standing Committee of the Provincial People's Congress, an appropriate extension may be granted.

If the report on important matters stipulated in Article 5 of these Provisions requires the Standing Committee of the Provincial People's Congress to make a resolution or decision, it shall be put forward by the Presidium of the Standing Committee of the Provincial People's Congress after a decision has been made by the Presidium.

Resolutions and decisions made by the Standing Committee of the Provincial People's Congress on important matters shall be announced in a timely manner through public notices. Article 9 Before the Standing Committee of the Provincial People's Congress discusses or decides on a major matter, the relevant specialized committee or working committee shall listen to the views of the relevant organs, deputies to the National People's Congress, people's masses and all sectors of society. If necessary, it may convene hearings or openly solicit opinions from the public through the media. Article 10 If the Standing Committee of the Provincial People's Congress does not make a resolution or decision after considering the report on major matters stipulated in Article 5 of these Provisions, the relevant specialized committee or working committee shall summarize and collate the deliberations after the meeting of the Standing Committee, and after discussion at the most recent meeting of the chairpersons, the general office of the Standing Committee of the Provincial People's Congress shall send it to the relevant organ for study and processing. The relevant organ shall report in writing to the Standing Committee of the Provincial People's Congress within the prescribed period on the situation of the study and processing. Article 11 The General Office of the Standing Committee of the Provincial People's Congress is the supervisory organization of the Standing Committee of the Provincial People's Congress in discussing and deciding major matters.

If the organ concerned makes its own decision or fails to report on a major matter that should be discussed or decided by the Standing Committee of the provincial people's congress, the General Office of the Standing Committee of the provincial people's congress shall, together with the relevant specialized committee or working committee, study the matter and put forward an opinion, which shall be reported to the meeting of the chairperson of the Standing Committee of the provincial people's congress for approval, and shall recommend that the organ concerned make corrections on its own.

If the organ concerned still fails to report within the suggested period for self-correction or fails to revoke on its own, the Standing Committee of the Provincial People's Congress shall order it to report or revoke according to law. Article 12 The Standing Committee of the Provincial People's Congress shall strengthen the supervision and inspection of the implementation of resolutions and decisions on major matters. If necessary, it may include the implementation of resolutions and decisions on major matters or the handling of deliberations as a supervisory matter in its annual supervisory work plan.
