Government procurement not only refers to the specific procurement process, but also is the general term for procurement policies, procurement procedures, procurement processes and procurement management. It is a system for public procurement management.
According to Article 2 of the "Government Procurement Law of the People's Republic of China" (hereinafter referred to as the "Government Procurement Law"), the scope of government procurement should include two aspects:
First, purchase goods, projects and services within the centralized procurement catalog formulated in accordance with the law. Government procurement in our country combines centralized procurement and decentralized procurement, and government procurement must be executed strictly in accordance with the approved budget. The scope of centralized procurement, that is, the centralized procurement catalog, shall be announced and determined by the people's governments at or above the provincial level. For government procurement projects belonging to the central budget, the centralized procurement catalog shall be determined and announced by the State Council. On June 1, 1999, the General Office of the State Council forwarded the "Notice on the Opinions on Trial Implementation of Government Procurement in Various Departments and Agencies of the State Council" issued by the State Council Agency Affairs Administration. In the "Notice", it was stipulated that, based on the current situation, all departments and agencies of the State Council should be included in the trial implementation of government procurement. Items within the scope of procurement include:
⑴Cars, boilers, elevators, computers and their auxiliary equipment, photocopiers, fax machines, air conditioners, office furniture and other materials;
⑵The investment amount is Non-productive repair projects of more than 500,000 yuan;
⑶ Large-scale conference reception, vehicle insurance and vehicle maintenance and other services.
Second, purchase goods, projects and services above the quota. The so-called quota standard refers to the minimum amount standard determined by the central government and provincial, municipal and autonomous region governments for centralized procurement of goods, projects and services through government procurement. As for the government procurement quota standards, the "Government Procurement Law" still adopts the principle of hierarchical management. Government procurement projects belonging to the central budget shall be determined and announced by the State Council; government procurement projects belonging to local budgets shall be determined by the people's governments of provinces, autonomous regions, municipalities directly under the Central Government or other governments. Determined and published by the authorized agency. In addition, the "Government Procurement Law" also determines the principle of preferential procurement of domestic goods, that is, the law clearly stipulates that except for goods, projects or services that need to be purchased, they cannot be obtained in China; they cannot be obtained on reasonable commercial terms; they are not available in China. For procurement for overseas use; and unless otherwise provided by other laws and administrative regulations, government procurement shall purchase domestic goods, projects and services (the definition of domestic goods, projects and services shall be implemented in accordance with the relevant provisions of the State Council); at the same time, government procurement shall Contribute to the country's economic and social development, including protecting the environment, supporting underdeveloped areas and minority areas, and promoting the development of small and medium-sized enterprises.
