The civil air defense works mentioned in the preceding paragraph (hereinafter referred to as civil air defense works) include underground protective buildings built separately for wartime support personnel and materials, civil air defense command and medical rescue, and basements built in combination with ground buildings that can be used for air defense in wartime (hereinafter referred to as air defense basements). Article 3 The people's governments of cities and counties (districts) shall strengthen the organization and leadership of the planning and construction of civil air defense projects, and incorporate the planning and construction of civil air defense projects into the national economic and social development plan.
The housing and urban-rural construction department of the people's government of the city or county (district) is the competent department of civil air defense engineering construction (hereinafter referred to as the competent department of civil air defense), and under the leadership of the people's government at the same level and the military organs at the same level, it is specifically responsible for the supervision and management of the planning and construction of civil air defense engineering within its jurisdiction.
City, county (District) people's government development and reform, natural resources and planning, finance, auditing, administrative examination and approval, urban management and other departments in accordance with their respective responsibilities, do a good job in the supervision and management of civil air defense engineering planning and construction. Article 4 The municipal and county competent departments for civil air defense shall, jointly with the natural resources and planning departments, formulate and revise the civil air defense project construction plan according to the urban protection category, population concentration, regional development intensity, distribution of key protection targets and other factors, and incorporate it into the national land spatial planning system. The planning scope of civil air defense engineering construction is the planning area of cities and key civil air defense towns determined according to law.
The civil air defense project construction plan shall be reviewed by the competent civil air defense department at a higher level and implemented after being approved by the people's government at the same level.
After the approval of the civil air defense project construction plan, the municipal and county civil air defense departments shall, in accordance with the relevant provisions of the Regulations on the Openness of Government Information of the State Council, promptly disclose the contents that should be disclosed according to law. Article 5 When organizing the preparation of detailed plans, the competent departments of natural resources and planning shall, jointly with the competent departments of civil air defense, implement the planning contents of civil air defense projects, and specify the construction position and scale requirements of special projects such as civil air defense professional teams, medical rescue, evacuation trunk roads and material reserves. Sixth civil air defense departments should conscientiously implement the civil air defense project construction planning, scientific and rational layout of civil air defense material library project, and strictly control the scale of civil air defense material library project. Seventh new civil buildings within the planning scope of urban civil air defense engineering construction shall be equipped with air defense basements above level 6 according to 7% of the total construction area.
New civil buildings within the planning scope of civil air defense projects in Shuyang County, Siyang County and Sihong County shall be equipped with air defense basements above Grade 6 according to 5% of the total construction area of the construction project.
The total construction area of construction projects mentioned in the preceding two paragraphs does not include the area of civil air defense projects apportioned by civil construction projects. Eighth industrial production plants and their supporting facilities, temporary buildings, etc. , do not need to be equipped with civil air defense projects in accordance with the provisions of article seventh, except for non-productive buildings.
For buildings that do not need to be equipped with civil air defense projects, a catalogue list management system shall be implemented. The municipal competent department of civil air defense shall, in accordance with the relevant provisions, formulate and timely adjust and improve the list of buildings in this Municipality that do not need to be equipped with civil air defense projects. Ninth construction projects meet one of the following conditions, the application by the construction unit, approved by the competent department of civil air defense, can easily build civil air defense projects:
(a) the land where it is located prohibits or restricts the development and utilization of underground space;
(two) due to underground rivers, quicksand, shallow bedrock and other geological, topographic or structural conditions, it is not suitable to build an air defense basement;
(three) due to the dense buildings around the construction site or the dense underground pipeline facilities, the civil air defense project can not be constructed or it is difficult to take measures to ensure the construction safety;
(four) according to the prescribed standards, the area of civil air defense projects should be less than one thousand square meters;
(five) to meet the requirements of detailed planning or other national and provincial civil air defense planning control indicators.
For civil air defense projects approved by the competent departments for civil air defense, the construction unit shall pay the ex situ construction fee for the air defense basement before handling the construction project planning permit, and the competent departments for civil air defense shall construct and manage the air defense basement. Tenth air defense basement construction fees charged according to law, shall be paid into the financial accounts at the same level management, earmarking. Governments and departments at all levels in this Municipality shall not decide to postpone, reduce or waive the ex situ construction fee of air defense basement by means of illegal occupation, misappropriation, compensation by award or financial return.
The financial and auditing departments shall strengthen the supervision and inspection of the ex situ construction fees for air defense basements. Eleventh in accordance with the provisions of article seventh of the proportion of civil air defense projects, should be synchronized with the ground building planning, design, construction, completion and acceptance, the construction funds into the construction project investment plan.
The wartime function, protection level, construction scale and layout of civil air defense projects shall be clearly defined by the competent departments of civil air defense according to the tactical and technical requirements of the national civil air defense projects and the construction planning of civil air defense projects.
Civil air defense project planning and construction within the scope of new civil buildings, not according to the provisions of Article 7 with the construction of civil air defense projects or not according to the provisions of Article 9 to pay the basement construction fee, shall not be issued a construction project planning permit and construction permit.
