Chapter I General Provisions
Article 1 In order to strengthen blood management, ensure the use of blood for medical emergency, protect the health of citizens and promote the construction of socialist spiritual civilization, these Interim Measures are formulated in accordance with the relevant provisions of the state and combined with the actual situation of this Municipality.
Article 2 This Municipality implements the system of citizens' voluntary blood donation.
Free blood donation is the social obligation of every healthy citizen of school age. All healthy citizens of school age who live in the urban areas and counties (cities) of this Municipality shall participate in voluntary blood donation in accordance with the provisions of these Measures.
Encourage rural villagers to participate in voluntary blood donation, and gradually implement voluntary blood donation by citizens in rural areas of this city.
Article 3 Citizens of this Municipality shall fulfill their obligation to donate blood, follow the principles of voluntariness, free of charge, safety and hygiene, and implement the system of giving priority to blood donors.
Article 4 Organs, organizations, enterprises, institutions and other organizations within the administrative area of this Municipality shall, in accordance with the provisions of these Measures, do a good job in publicity and education of citizens' voluntary blood donation, popularize knowledge of blood science, and mobilize and organize citizens in their own regions and units to donate blood voluntarily.
Article 5 This Municipality implements the blood management system of unified blood source management, unified blood collection and unified blood supply in cities and counties (cities) to ensure blood quality and adhere to rational and economical use of blood.
Chapter II Management Organization and Duties
Article 6 The people's governments of cities and counties (cities) shall set up citizens' voluntary blood donation committees to uniformly lead citizens' voluntary blood donation work within their respective jurisdictions.
City, county (city) Citizens' Voluntary Blood Donation Committee has an office, which is subordinate to the health administrative department at the same level and is specifically responsible for the organization and management of citizens' voluntary blood donation.
Seventh city and county (city) health administrative departments in charge of citizens' voluntary blood donation work within their respective jurisdictions, responsible for the implementation of these measures.
Eighth municipal health administrative departments are responsible for:
(a) to formulate relevant measures and technical specifications for the implementation of these measures;
(two) to formulate the citizens' voluntary blood donation plan and the annual guidance plan;
(three) supervision and inspection of the implementation of the management of blood source, blood collection, blood supply and blood use;
(four) examination and approval, issued a "blood collection permit";
(five) responsible for blood swap with other provinces and cities;
(six) blood and blood transfusion management;
(seven) to decide and implement the rewards and punishments stipulated in these measures;
(eight) responsible for other work related to blood management.
Ninth county (city) health administrative departments have the following duties:
(1) To supervise and inspect the implementation of these Measures within its jurisdiction;
(two) according to the city's annual citizen blood donation guidance plan, formulate the county (city) annual citizen blood donation plan;
(3) Organizing and implementing citizens' voluntary blood donation;
(four) to decide and implement the rewards and punishments stipulated in these measures.
Article 10 The units to which citizens belong and the organizations in residential areas shall perform the following obligations:
(a) to formulate the voluntary blood donation guidance plan for citizens of this unit (region);
(two) according to the arrangement of the city and county (city) blood donation office, organize the physical examination and blood donation of the citizens of this unit (region) to ensure the completion of the blood donation guidance plan of this unit (region);
(three) to assist the city and county (city) blood donation office to do a good job in blood management.
Eleventh blood collection and supply units have the following duties:
(a) to provide whole blood and various blood components to medical units, and do a good job in the supply of blood for medical use;
(two) strict implementation of blood donation physical examination standards and blood collection and storage technical specifications and related management systems, to ensure the quality of blood, in line with health standards;
(3) Cooperate with clinical medical treatment, actively promote component blood transfusion and implement comprehensive utilization of blood.
Twelfth medical units have the following duties:
(a) according to the patient's condition, decide to use blood, so as to use blood in a planned, scientific and economical way;
(two) strictly implement the technical specifications of blood transfusion to ensure the safety of blood transfusion;
(three) to cooperate with the blood management agencies to do a good job in the examination and approval and management of blood use. For patients who need blood, the Notice of Blood Use uniformly printed by the Municipal Blood Donation Office will be issued.
Thirteenth downtown blood stations are responsible for providing technical guidance to county (city) blood stations and uniformly dispatching blood.
Chapter III Citizens' Blood Donation
Fourteenth citizens aged eighteen to fifty-five within the administrative area of this Municipality, who meet the standards of blood donation after physical examination, are obliged to donate blood according to the following provisions:
(1) Having permanent residence in this Municipality and donating blood once every five years;
(two) institutions of higher learning (including military academies) and all kinds of vocational and technical schools after high school students donate blood once during their studies at school;
(three) the soldiers stationed in Xu (including the armed police and fire brigade) donated blood once during their service;
(four) foreign citizens who have lived in this city for more than two years and donated blood once, donate blood once every five years for more than five years.
Fifteenth citizens, students and soldiers who have a work unit donate blood, which is organized by the unit where they work, or they can directly register blood donation at the local blood donation office with their ID cards.
Citizens who have no work units donate blood, organized by neighborhood offices (townships and towns) neighborhood (village) committees, or they can register blood donation directly to the local blood donation office with their ID cards.
Sixteenth city blood donation office should be calculated according to the five percent of the population who meet the conditions of blood donation in this city, formulate the annual blood donation guidance plan, and organize all regions and units to implement it.
Seventeenth citizens must go to the medical unit designated by the blood donation office for physical examination before donating blood. Those who pass the examination donate blood with the physical examination form and my ID card. Those who fail the medical examination may not donate blood. Citizens donate 200 ml of blood each time, and if they voluntarily donate blood many times, the interval between two blood donations shall not be less than three months.
Eighteenth citizens to donate blood to implement the principle of free, to fulfill the obligation of blood donation, the blood collection unit issued a "citizen blood donation card".
Nineteenth citizens with work units enjoy public holidays on the day and the next day of blood donation.
Twentieth units that completed the voluntary blood donation guidance plan for citizens in that year, the city and county (city) blood donation office issued a certificate of completion of the unit blood donation guidance plan.
Chapter IV Blood Use by Citizens
Article 21 Any citizen has the right to use blood for medical treatment due to injury or illness. Citizens use blood in accordance with the principle that the obligation to donate blood is consistent with the right to use blood and the humanitarian spirit of saving lives, and implement the system of individual blood storage, mutual assistance of units or families, social assistance and preferential treatment for blood donors.
Article 22 Citizens who fulfill their blood donation obligations in accordance with the provisions of these Measures shall go through the blood donation procedures at the blood donation offices of cities and counties (cities) with their blood donation card and resident identity cards (or household registration books), and provide blood equivalent to twice the amount of blood donated to the blood donors themselves or their family members (spouses, parents and children, the same below) who do not enjoy free medical care and labor insurance medical care.
Citizens who donate blood without compensation and their families who do not enjoy free medical care and labor insurance medical care shall be reimbursed by the receipt of blood for medical use and the blood donation card equivalent to twice the amount of blood donated. Among them, 50% of the work units are reimbursed in their own units and local blood donation offices, and 50% of the work units are reimbursed in local blood donation offices.
Twenty-third units that completed the blood donation guidance plan last year, their employees shall implement the method of mutual assistance in blood use. With the proof of completing the blood donation guidance plan and work permit (or retirement certificate) in the previous year, apply to the blood donation office of the city or county (city) where it is located for blood use procedures.
If the unit fails to complete the guidance plan for blood donation in the previous year, when its employees need blood for medical treatment, they must apply to the blood donation office of the city or county (city) where they are located by the blood notification issued by the hospital, and pay a blood deposit equivalent to twice the cost of blood use. If the unit completes the blood donation guidance plan of the previous year within a limited time, the deposit will be refunded; If the blood donation guidance plan is not completed within the time limit, the deposit will not be refunded. The provisions of the preceding paragraph shall not apply to citizens who have fulfilled their blood donation obligations in their units, and citizens who have fulfilled their blood donation obligations in their units shall use blood in accordance with the provisions of Article 22 of these Measures.
Article 24 If a citizen who has no work unit meets the requirements for blood donation and fails to perform the obligation of blood donation, and other family members fail to perform the obligation of blood donation, they shall apply for blood donation to the blood donation office of the city or county (city) where they are located by the blood donation notice issued by the hospital, and the blood donation fee shall be charged at twice the blood donation standard.
Twenty-fifth foreign citizens to the city for medical treatment to fulfill the obligation of blood donation, with blood donation card and identity certificate, in accordance with the provisions of the first paragraph of article twenty-second of these measures; Those who fail to fulfill their blood donation obligations shall use blood in accordance with the provisions of Article 24 of these Measures.
Twenty-sixth citizens who have no work units and their family members who do not meet the conditions for blood donation shall apply to the blood donation office of the city or county (city) for blood use with the Resident Identity Card, household registration book and relevant certificates.
Twenty-seventh citizens under the age of eighteen and over fifty-five shall hold the "Resident Identity Card" and the "Notice of Blood Use" issued by the hospital to go through the formalities of blood use at the local city and county (city) blood donation office.
Twenty-eighth emergency rescue patients, first of all, the hospital directly supply the required blood, the patient's unit or relatives in accordance with the provisions of these measures to re apply for blood use procedures.
Chapter V Management of Blood Collection and Supply
Twenty-ninth blood stations at all levels are professional institutions for blood collection and supply. Without approval, no unit may engage in blood collection and supply business or buy blood from other places.
Thirtieth it is strictly forbidden to hire others to donate blood as an impostor. No unit or individual may donate blood instead of the employees of the unit or by others in order to complete the blood donation guidance plan of the unit or individual's blood donation obligation.
Article 31 It is strictly forbidden to illegally organize others to sell blood or to organize others to donate blood for profit. It is strictly forbidden to provide conditions for others to evade blood donation obligations or resort to deceit.
Thirty-second blood collection and supply units must strictly check the "Resident Identity Card" of blood donors, strictly implement the blood donation physical examination standards and technical specifications for blood collection and supply, and ensure the quality of blood. It is strictly forbidden to supply unqualified blood to medical units.
Chapter VI Fund Management
Thirty-third blood donation funds, unified management by the city and county (city) blood donation office, separate accounts, earmarking, and shall not be used for other purposes.
Thirty-fourth city and county (city) blood donation office management of blood donation funds for the following matters:
(1) Business expenses necessary for organizing blood donation;
(two) blood donors or their families to use blood for free;
(three) major disasters, accidents and social poverty of blood donation;
(4) Examination and treatment of blood;
(five) improve the conditions of collection, storage and blood supply, and purchase instruments and equipment;
(six) other matters related to the development of blood transfusion.
Article 35 50% of the funds converted from voluntary blood donation organized by a collective unit shall be returned to the unit, accounted for separately in the unit, and earmarked for the medical expenses of voluntary blood donation, the expenses of organizing voluntary blood donation and the rewards of voluntary blood donation.
Thirty-sixth the use of unpaid blood donation funds should be made public, regularly report to the city and county (city) blood donation committee, and accept the inspection and supervision of the health administrative department at the same level and the audit and other relevant departments. In the first quarter of each year, the audit department of the city and county (city) announced to the public the audit conclusion of the income and expenditure of the voluntary blood donation conversion fund in the previous year and accepted social supervision.
Chapter VII Reward and Punishment
Thirty-seventh any of the following circumstances, by the city and county (city) people's government to give recognition:
(a) citizens donate blood for free 1000 ml or more;
(two) the unit overfulfilled the annual blood donation guidance plan on time;
(3) Other citizens who have made remarkable achievements in blood donation.
Thirty-eighth units that have not completed the annual blood donation guidance plan shall be criticized as appropriate and completed within a time limit; If it is not completed within the time limit, it shall pay a medical blood fund equivalent to 5 times the amount of blood donated by the unit's annual blood donation guidance plan to the city and county (city) blood donation office, and its funds shall not be collected from individuals.
Thirty-ninth unauthorized collection, blood supply or not according to the provisions of the collection, blood supply, by the city, county (city), jiawang district health administrative departments shall be ordered to stop the collection, blood supply, and impose a fine equivalent to three to five times the amount of blood collected, blood supply, but the maximum shall not exceed 30 thousand yuan.
Article 40 Anyone who hires others or donates blood in other ways as an impostor, the amount of blood donated is not included in the number of blood donation guidance plans completed, and the administrative department of health of the city, county (city) and jiawang district shall impose a fine of 1000 yuan.
Forty-first to provide conditions for others to escape the obligation of blood donation, by the city, county (city), jiawang district city health administrative departments impose a fine of one thousand yuan.
Article 42 Whoever forges, alters or transfers relevant blood donation certificates shall be fined 1000 yuan by the administrative department of health of the city, county (city) and jiawang district.
Forty-third for the purpose of profit to organize others to donate blood or organize others to sell blood, by the city, county (city), jiawang district city sanitation administrative department fined three thousand yuan.
If the acts mentioned in the preceding paragraph are serious enough to constitute a crime, criminal responsibility shall be investigated by judicial organs according to law.
Article 44 If a blood station fails to implement the system of examination, approval and verification of blood use or fails to supply blood according to regulations, the administrative department of health of the city, county (city) and jiawang district shall impose a fine of 1000 yuan.
Article 45 If the staff members of blood donation management institutions and blood collection and supply units abuse their powers, engage in malpractices for selfish ends, neglect their duties, and fail to collect, supply and test blood according to the prescribed standards, thus causing blood quality accidents, they shall be given administrative sanctions by their units or the competent department at a higher level; If the circumstances are serious enough to constitute a crime, criminal responsibility shall be investigated by judicial organs according to law.
Chapter VIII Supplementary Provisions
