The management of domestic garbage shall follow the principles of government-led, universal participation, market operation, urban and rural integration, local responsibility, and gradual progress. Article 5 domestic waste is classified in accordance with the following standards:
(1) recyclables, mainly including waste paper, waste plastics, waste metals, waste glass products, waste fabrics and other suitable for recovery, recyclable household waste;
(2) hazardous waste, including waste batteries, waste lamps, waste medicines, waste pesticides, waste thermometers, waste paint and its containers and other direct or potential harm to human health or the natural environment. (ii) Hazardous waste, including waste batteries, waste lamps, waste medicines, waste pesticides, waste thermometers, waste paints and their containers, and other household wastes that are directly or potentially hazardous to human health or the natural environment;
(iii) Kitchen wastes, including household kitchen wastes, kitchen wastes and other kitchen wastes and other easily perishable household wastes that contain organic matter;
(iv) Other wastes, which refer to other household wastes other than recyclables, hazardous wastes, and kitchen wastes.
If the national classification standard for domestic waste is adjusted, it shall be subject to its provisions. Article 6 The people's governments at or above the county level shall strengthen the leadership of the management of domestic garbage, establish a comprehensive coordination mechanism for the management of domestic garbage, and improve the system of domestic garbage classification and treatment. The funds required for the management of domestic garbage are included in the financial budget at this level.
Township people's governments, street offices are responsible for the classification of domestic garbage within their jurisdiction, collection and transportation, as well as inspection and supervision. Article 7 the provincial people's government department in charge of environmental sanitation is responsible for the organization, coordination, guidance and supervision of the province's domestic waste management work.
The environmental sanitation departments of the people's governments of cities, counties and autonomous counties are specifically responsible for the supervision and management of domestic garbage in the administrative areas under their jurisdiction.
The competent departments for development and reform of the people's governments at or above the county level are responsible for formulating plans for the comprehensive utilization of domestic garbage and harmless garbage disposal facilities, formulating plans for the implementation of the extended producer responsibility system, and establishing a mechanism for charging for the disposal of domestic garbage.
The competent department of commerce of the people's governments at or above the county level is responsible for establishing a recycling system coordinated with the utilization of domestic garbage recyclables, and rationally distributing the recycling outlets of renewable resources.
The competent ecological environment department of the people's governments at or above the county level is responsible for the monitoring of pollutant emissions from centralized domestic waste transfer facilities, terminal treatment facilities and other places, as well as the supervision and management of the prevention and control of pollution in the process of storing, transporting and disposing of hazardous waste.
The people's governments at or above the county level of natural resources and planning, finance, market supervision and management, postal management, tourism and culture, organ affairs management and other relevant departments in accordance with the division of responsibilities, and work together to do a good job in the management of domestic waste. Article 8 units and individuals should actively participate in the green life action to reduce the production of domestic waste, to fulfill the obligations of domestic waste classification and disposal, and bear the responsibility of domestic waste producers.
Units and individuals in accordance with the principle of who produces who pays, based on the municipal, county and autonomous county people's governments to determine the fees to pay for domestic waste disposal. Conditional places can gradually establish the measurement of charges, classification pricing of domestic garbage charging system. Specific measures shall be separately formulated by the people's governments of cities, counties and autonomous counties. Article IX respect for sanitation and garbage disposal workers and the fruits of their labor, improve their working conditions, to ensure operational safety, and gradually improve labor compensation and welfare benefits, health care and technical training, and safeguard the legitimate rights and interests. Chapter II Planning and Construction Article 10 The people's governments at or above the county level to prepare national economic and social development planning, territorial spatial master plan, shall reduce the source of domestic waste, the whole process of classification, resource utilization, harmless disposal as an important content.
The competent department of environmental sanitation of the provincial people's government shall, on the basis of population, territory, the total amount of domestic garbage control objectives, combined with the production and treatment of domestic garbage, organize the preparation of special planning for domestic garbage disposal, reported to the provincial people's government for approval and implementation. Article 11 The people's governments at or above the county level and their relevant departments shall incorporate the funds and land required for the annual construction plan of domestic waste disposal facilities into the annual investment plan and the annual land supply plan, respectively.
The environmental health management department of the people's governments of cities, counties and autonomous counties shall, in accordance with the special plan for the disposal of domestic waste in this administrative region, formulate an annual construction plan for domestic waste disposal facilities and organize its implementation.
The land for the construction of domestic waste disposal facilities determined by the plan shall not be changed for any purpose without legal procedures. Article XII of the people's governments at or above the county level shall, according to the economic and social development of the administrative region and domestic waste generation, treatment, in accordance with the requirements of urban and rural synchronization, regional integration, cross-regional **** construction **** enjoy all kinds of domestic waste disposal facilities.
