Article 1 (purpose and basis)
In order to strengthen the management of building energy efficiency, improve energy efficiency and building function, and promote the sustainable development of the economy and society, according to the "Chinese People's Republic of China *** and the State Energy Conservation Law", "Chinese People's Republic of China *** and the State Building Law", the State Council, "Construction Engineering Quality Management Regulations" and other relevant laws, Regulations, combined with the actual city of Chengdu, the formulation of these provisions.
Article 2 (concept of building energy efficiency)
Building energy efficiency, as referred to in these provisions, refers to the design and construction of building projects, in accordance with the provisions of the relevant state laws and regulations and building energy efficiency standards, the use of energy-saving building materials, products and equipment, to improve the thermal insulation properties of the building envelope, to reduce the use of buildings in the course of the heating, cooling, lighting energy consumption, and rational and effective use of energy. The use of energy is rational and effective.
Article 3 (Scope of Application)
The administrative area of the city, in addition to rural self-constructed residential buildings, public **** construction projects (hereinafter referred to as construction projects), engaged in the supervision and management of building energy efficiency must comply with the provisions of this regulation.
The existing buildings that have not reached the building energy-saving standards before the implementation of these provisions shall gradually implement building energy-saving renovation.
Article 4 (management)
The municipal construction administrative department is responsible for the supervision and management of the city's building energy efficiency, direct management of Jinjiang, Qingyang, Jinniu, Wuhou, Chengdu five urban areas (including high-tech zones) within the scope of building energy efficiency, can be entrusted to Chengdu City, the wall material innovation and building energy efficiency office (hereinafter referred to as the Office of Wall Energy Efficiency) to undertake the specific work.
Other districts (cities) and counties in charge of construction administration department is responsible for the supervision and management of building energy efficiency in the region, can be entrusted to the district (city) and county wall materials energy-saving office to undertake specific work.
Development plans, economy, planning, science and technology, quality supervision, finance and other relevant departments should be in accordance with their respective responsibilities, in accordance with the law to do a good job in the supervision and management of building energy efficiency.
Article 5 (publicity and planning)
The people's governments of the city and districts (cities) and counties shall strengthen publicity on building energy conservation, enhance public awareness of energy conservation, and gradually establish a social supervision mechanism.
The municipal construction administrative department shall, in conjunction with the relevant departments, prepare a development plan for building energy efficiency in accordance with the city's level of economic and social development and energy development planning, and report it to the municipal government for approval before organizing and implementing it.
Article 6 (development-oriented)
The city encourages scientific research and technological development of building energy conservation, and vigorously promotes the application of energy-saving technologies, products and equipment. It focuses on the development of the following building energy-saving technologies and products:
(1) walls and roofs with energy-saving heat preservation and insulation properties;
(2) energy-saving doors and windows with heat preservation, insulation and airtightness technologies;
(3) energy-saving air-conditioning technologies and products;
(4) energy-saving technologies and products for architectural lighting;
(5) natural energy, clean energy (v) natural energy, clean energy and other renewable energy application technologies and equipment;
(vi) centralized cooling, heating and heat, electricity, cooling cogeneration and cogeneration technologies;
(vii) heating, air-conditioning systems, temperature control and heat metering technologies and devices;
(viii) building energy-saving energy testing and evaluation technologies;
(ix) other mature technology, the effect of the energy saving technology and energy-saving management technology.
Article 7 (financial security)
The municipal science and technology research and development funds, special funds for new wall materials shall support the scientific research, promotion and application of building energy efficiency. Specific measures shall be formulated by the Municipal Construction Commission in conjunction with the Municipal Finance Bureau.
Article VIII (design and construction standards)
The design and construction of building projects shall strictly implement the "Energy Conservation Design Standards for Residential Buildings in Hot Summer and Cold Winter Areas", "Energy Conservation Design Standards for Public **** Buildings", and other national, provincial or industry standards for energy conservation of buildings, construction norms and standards for inspection and evaluation.
The competent department of municipal construction administration shall, in accordance with the law, organize the preparation of building energy-saving design, construction, inspection and evaluation procedures and assessment system applicable to the city.
Article 9 (Engineering Requirements)
The building materials, products, equipment and technologies used in building energy-saving projects must comply with the national building energy-saving standards as well as the requirements of the relevant building energy-saving codes. It is prohibited to use building materials, products, equipments and technologies that are explicitly eliminated by the state.
Building lighting project should be a reasonable choice of lighting standards, lighting, control and make full use of natural light, the use of energy-saving products, reduce lighting power consumption, improve lighting quality.
Article 10 (the responsibility of the relevant units)
Construction units should be commissioned in accordance with the standards of building energy efficiency in the design, construction and supervision of construction projects, shall not lower the standards, unauthorized modification of energy-saving design documents.
Construction units in the organization of the completion of the project acceptance, should be building energy-saving whether to meet the design requirements into the completion of the acceptance of the content, and will contain building energy-saving content of the completion of the project acceptance report to the competent administrative department of construction for the record.
Real estate development enterprises selling new commercial residential shall be the basic information of building energy-saving contained in the "residential instruction manual", the sale of new public **** building shall provide building energy-saving instructions, indicating that the building has taken energy-saving measures and the corresponding protection requirements.
Design units in the design of construction projects should be designed in accordance with the provisions of the building energy-saving design standards and relevant mandatory standards to ensure the quality of building energy-saving design.
Construction plan design document review organization in the construction plan design document review, shall review the content of the building energy-saving, issued by the review opinion shall contain building energy-saving review.
Construction units shall carry out construction in accordance with the construction plan design documents and construction procedures, and is responsible for the quality of construction.
Engineering supervision unit shall be in accordance with the provisions of the building energy-saving and technical standards, design documents to implement supervision of building materials, building components and equipment that have not been qualified by the product quality inspection organization and do not meet the requirements of the building energy-saving design, as well as the state ordered to eliminate the backward energy-using technologies and energy-consuming products, equipment and materials shall not be agreed to be installed in the construction project and use.
Article 11 (Duties of Project Quality Supervisory Bodies)
The construction project quality supervisory bodies shall order corrections for projects that are not constructed in accordance with the energy-saving design documents or that fail to meet the relevant acceptance standards; the project quality supervision reports issued shall contain the contents of building energy conservation.
Article 12 (duties of the administrative department of construction)
The competent administrative department of construction shall review the content of the building energy-saving design when carrying out the preliminary design review of the project, and shall not pass the review of the building energy-saving standards are not complied with; and shall order the completion acceptance of the process of violating the provisions of the building energy-saving projects to make corrections within a certain period of time, and shall re-organize the completion acceptance of the project after the corrections are made.
Article XIII (duties of the relevant administrative departments)
Based on the relevant provisions of the state, construction projects should be carried out feasibility study report, the report should include building energy-saving chapter (chapter) of the thematic argumentation. Where there is no energy-saving chapter or energy-saving chapter has not been assessed feasibility study report, the development of planning and administrative departments will not be accepted.
Planning administration to review the planning of construction projects should contain building energy content.
Quality and technical supervision and administrative departments shall strengthen the supervision and management of the quality of building energy-saving products.
Article 14 (Supervision and Inspection)
Cities and districts (municipalities) and counties in charge of construction administration, the Office of Wall Material and Energy Conservation shall carry out inspections of the implementation of building energy efficiency, and organize technical training on building energy efficiency.
Article 15 (Responsibility for Violation of the Provisions Concerning Supervision)
If an engineering supervision unit violates these provisions by signing backward energy-using technologies and energy-using products, equipment and materials that consume too much energy and that are explicitly eliminated by the state in accordance with the qualified signatures, the competent department of construction administration may impose a fine of 5,000 yuan or more than 30,000 yuan or less.
Article 16 (Violation of other relevant provisions of the responsibility)
Violation of these provisions, the construction unit expressly or impliedly design unit or construction unit in violation of the mandatory standards of energy efficiency of construction works, reduce the quality of the project; design unit is not in accordance with the mandatory standards of energy efficiency of construction works for the design of the design of the unit; construction unit is not in accordance with the construction drawings and design documents for the construction of the construction of the construction of the unit by the competent administrative department of construction The competent department shall be punished in accordance with the "Construction Engineering Quality Management Regulations" Article 56, Article 63, Article 64 respectively.
Article 17 (Violation of the provisions of the construction plan design review responsibility)
Construction plan design document review organization is not in accordance with the provisions of the review content of the review, by the competent administrative department of the Ministry of Construction, "housing construction and municipal infrastructure projects construction plan design document review management measures" Article 22 shall be punished.
Article 18 (Accountability)
The staff of the competent administrative department of construction and relevant administrative departments, negligence, abuse of power, favoritism and malpractice, shall be given administrative sanctions in accordance with the relevant provisions, and if a crime is constituted, shall be held criminally liable according to law.
Article 19 (remedies)
Parties who are not satisfied with the specific administrative act may apply for administrative reconsideration or bring an administrative lawsuit according to law.
Article 20 (interpretive authority)
The provisions of the Chengdu Municipal People's Government is responsible for the interpretation of the Legislative Affairs Office.
Article 21 (Enforcement Date)
These provisions shall come into force on December 1, 2005, and shall be implemented as of the same date.
