Chapter I General Provisions
Article 1 These Measures are formulated in accordance with the provisions of the Road Traffic Safety Law of the People's Republic of China and the Regulations for the Implementation of the Road Traffic Safety Law of the People's Republic of China and in light of the actual situation in Sichuan.
Article 2 These Measures shall apply to drivers, pedestrians, passengers and units and individuals related to road traffic activities within the administrative area of Sichuan Province.
Third road traffic safety work should follow the principles of prevention first, strict management, safety and smoothness.
Fourth people's governments at or above the county level shall establish and improve the responsibility system for road traffic safety; To organize the formulation of five-year plans for road traffic safety management and emergency plans to deal with natural disasters, bad weather conditions and other emergencies that affect road traffic safety; Individuals and organizations that have made outstanding contributions to road traffic safety shall be commended and rewarded.
Article 5 The traffic administrative department of the public security organ of the people's government at or above the county level shall be responsible for the management of road traffic safety within their respective administrative areas. According to the needs of traffic safety management, you can hire relevant personnel to help maintain road traffic order.
Chapter II Accident Prevention
Article 6 The people's governments at or above the county level shall incorporate road traffic safety into the assessment of production safety, establish and improve the system of road traffic safety contact meetings attended by safety supervision, public security, transportation, construction, agricultural machinery, health, education, industry and commerce, quality inspection, planning and supervision, regularly analyze the road traffic safety situation, formulate governance measures, and implement road traffic safety responsibilities.
Township people's governments and urban street offices shall urge the units under their jurisdiction to implement the responsibility system for road traffic safety, eliminate potential safety hazards in time, and educate citizens to abide by road traffic safety laws and regulations.
Seventh traffic management departments and agricultural machinery management departments of public security organs shall, in accordance with the relevant provisions of the state, strictly register vehicles and issue certificates for drivers.
Transportation, construction and other departments shall, according to their respective responsibilities, strengthen the road transport safety supervision and inspection of transport enterprises, stations, operating vehicles and drivers.
Eighth motor vehicle driving training institutions shall carry out training in accordance with the relevant provisions of the state, and shall not shorten the training time or reduce the training content.
The competent department of motor vehicle driving training shall strengthen the supervision of motor vehicle driving training institutions.
Ninth organs, enterprises and institutions, social organizations and other organizations shall strictly manage the internal road traffic safety and abide by the following provisions:
(a) to establish and improve the internal traffic safety system, and to determine the person to organize the implementation;
(two) to educate the personnel of this unit to abide by the laws and regulations on road traffic safety; (three) regular motor vehicle maintenance, maintenance and safety inspection, to eliminate potential safety hazards.
Tenth motor vehicle maintenance units and individuals shall ensure that the vehicle maintenance projects meet the safety technical requirements, and shall not use expired, invalid or scrapped spare parts and assemblies to maintain vehicles.
Eleventh road management and maintenance departments shall, according to national and industry standards, set up and maintain road traffic safety facilities that meet safety requirements; Traffic safety monitoring and early warning system should be set up on the expressway. The traffic administrative department of the public security organ shall report to the local people's government in time if there are serious traffic safety hazards on the roads that have been put into use, and put forward suggestions for preventing traffic accidents and eliminating hidden dangers; Before the hidden dangers of road traffic safety are eliminated, obvious warning signs shall be set up.
Twelfth units and personnel occupying road construction operations shall set up obvious construction signs and safety warning signs at a distance of not less than 50 meters from the direction of incoming vehicles; Reflective signs should be set at night, and the spacing should not be less than 100m. Construction workers should wear reflective clothes.
Chapter III Vehicles and Drivers
Thirteenth motor vehicle driver safety information card system.
The driver's safety information card is used to record the driver's traffic accidents, illegal acts, accumulated scores and related information. Free driver safety information cards.
Motor vehicle drivers and drivers who drive motor vehicles registered in Sichuan Province with motor vehicle driving licenses from other provinces and cities shall receive driver safety information cards and carry them with them.
Fourteenth motor vehicles on the road shall meet the following requirements:
(1) Hanging the number plate at the specified position, and not inverting or installing more than two number plates;
(two) shall not install or use lighting, audio and other devices that hinder the safe passage of pedestrians and other vehicles without authorization;
(three) shall not increase or decrease the number of people carrying seats without authorization; (four) shall not install and use devices that interfere with traffic technology monitoring equipment; (five) other motor vehicles except motorcycles shall be equipped with effective fire-fighting equipment and warning signs for faulty vehicles that meet the national standards;
Highway passenger cars and passenger seats should be equipped with safety belts, and the number of people on both sides of the cab should be sprayed.
The number of school buses and coaches carrying kindergarten and primary and secondary school students should be painted on both sides of the cab, and the words "school bus" and "coach car" should be painted on the front and rear of the car body and carriage.
Fifteenth human tricycles, electric bicycles, motorized wheelchairs for the disabled on the road, should be registered by the traffic management department of the public security organ in the place of residence, and obtain a license.
To apply for non-motor vehicle registration, the vehicle shall be submitted for inspection, and the owner's identity certificate, property right certificate and vehicle certificate shall be submitted. To apply for the registration of disabled motorized wheelchairs, you should also hold a valid disability certificate.
Chapter IV Road Traffic
Article 16 Signs and plaques placed on buildings and structures on both sides of urban roads and highways shall not be similar to road traffic signs.
Article 17 On urban roads with insufficient parking spaces, the traffic administrative department of the public security organ at or above the county level may designate temporary parking spaces without affecting the passage of pedestrians and vehicles.
Eighteenth bus lanes designated on urban roads have priority, and other motor vehicles should give way when they meet buses.
Nineteenth people's governments at or above the county level may, according to the road traffic conditions in the urban center, limit the total amount and time for large trucks, motorcycles and human tricycles to enter the urban center. The restricted contents shall be made public.
Twentieth in the city center road, not driving a cart or riding, walking cattle, horses, donkeys and other livestock.
Article 21 When a motor vehicle borrows a non-motor vehicle lane according to regulations, it shall avoid the non-motor vehicle, and the maximum speed shall not exceed15km.
Article 22 When a motor vehicle breaks down or has a traffic accident on the road and occupies the carriageway, it shall take safety measures in accordance with regulations and quickly transfer passengers to a safe place.
Twenty-third motor vehicles on the road, shall not continue to cross more than 2 lanes to overtake.
Article 24 A motor vehicle running on a road without a center line and without dividing motor vehicle lanes and non-motor vehicle lanes should slow down and drive to the right when encountering a curve.
Motor vehicles traveling on roads covered with snow and ice in mountainous areas shall be equipped with snow chains on the driving wheels.
Before the motor vehicle leaves the roundabout, it should turn on the right turn signal. Twenty-fifth motor vehicles driving on the expressway are not allowed to drive or park in the emergency lane while the vehicles in front are waiting in line.
In non-emergency situations, motor vehicles are not allowed to stop on the expressway to get on and off passengers and load and unload goods.
Twenty-sixth motor vehicles are not allowed to run when passengers fail to fasten their seat belts as required.
Twenty-seventh school buses carrying kindergarten, primary and secondary school students on the road, shall not exceed the number of nuclear load, should be equipped with guardians.
Twenty-eighth human tricycles, electric bicycles, disabled motorized wheelchairs on the road, should be in accordance with the provisions of the suspension number plate. The driver shall carry the driving license with the vehicle and shall not lend it.
Electric bicycles and bicycles are only allowed to carry one child under the age of 12. Disabled motorized wheelchairs can take nurses.
Twenty-ninth motorcycle driving on the road, the driver shall not carry people, drivers and passengers should wear safety helmets.
Thirtieth non-motor vehicles driving on the road shall not be towed by motor vehicles or other vehicles.
Thirty-first pedestrians are not allowed to wait and ask for, sell or distribute articles in the motor vehicle lane.
Thirty-second passengers are not allowed to take the following motor vehicles: (1) knowing that the driver does not have a driver's license or the driver drives after drinking alcohol; (two) knowing that the motor vehicle has reached the standard of scrapping or assembling; (3) Full load or overload.
Chapter V Handling of Accidents
Article 33 People's governments at or above the county level shall organize public security, transportation, safety supervision, health and construction departments to formulate emergency rescue plans for road traffic accidents. When a road traffic accident occurs, causing heavy casualties, the person in charge of the people's government of the city (state) and county (city, district) shall go to the scene to direct the rescue and organize the aftermath.
After receiving the request for rescuing the injured in road traffic accidents or the notice from the emergency command center and the administrative department of health, the medical institution shall promptly organize the implementation of medical treatment, and shall not shirk or refuse. Due to the limitation of medical personnel, technology or equipment, it is impossible to carry out normal ambulance, and medical personnel shall be sent to escort the wounded to qualified medical institutions.
Article 34 After the traffic administrative department of the public security organ completes the on-site investigation of the road traffic accident, the parties concerned shall promptly move the vehicle to a place that does not hinder traffic safety. If a party refuses to obey or cannot execute, and the public interest may be affected by an emergency, the traffic administrative department of the public security organ may notify the relevant unit to remove the obstacle, and the expenses shall be borne by the party concerned.
Article 35 When investigating a road traffic accident, the traffic administrative department of the public security organ may inspect, examine or identify the vehicle, driving license, motor vehicle driving license and driver's safety information card that caused the traffic accident; Where it is necessary to consult, retrieve or copy the materials related to road traffic accidents, the relevant units and personnel shall provide assistance.
Thirty-sixth road traffic accidents between motor vehicles, in addition to the parties themselves to negotiate according to law, the traffic management department of the public security organ shall determine the responsibility for the accident in accordance with the following provisions:
(1) If one party fails to stop immediately or protect the scene, or fails to report the case in time when conditions permit, so that the basic facts of the accident cannot be ascertained, it shall take full responsibility;
(2) If both parties have the above-mentioned fault behaviors, * * * shall be jointly and severally liable.
Thirty-seventh motor vehicles and non-motor vehicles, pedestrians, traffic accidents, resulting in the loss of non-motor vehicle drivers, pedestrians more than the third party liability compulsory insurance liability limit, the motor vehicle side responsible for the accident, the excess in accordance with the following provisions:
(1) If the motor vehicle bears full responsibility, the motor vehicle party shall bear 100% of the compensation liability;
(two) the motor vehicle bears the main responsibility, and the motor vehicle party shall bear 80% of the liability for compensation;
(three) motor vehicles and non-motor vehicles and pedestrians bear the same responsibility, and the motor vehicle party shall bear 60% of the liability for compensation;
(four) if the motor vehicle bears secondary responsibility, the motor vehicle party shall bear 40% of the liability for compensation.
Article 38 If a traffic accident occurs between a motor vehicle and a non-motor vehicle or pedestrian, causing the loss of the non-motor vehicle driver or pedestrian to exceed the liability limit of compulsory third-party liability insurance, and there is evidence that the non-motor vehicle driver or pedestrian violates the laws and regulations on road traffic safety, and the motor vehicle driver has taken necessary measures, the liability of compensation of the motor vehicle party shall be reduced in accordance with the following provisions:
(1) In case of road traffic accidents on closed roads such as expressways and urban motor vehicle expressways, 95% of the compensation liability of the motor vehicle party shall be reduced, and 5% shall be borne by the motor vehicle party, but the maximum amount shall not exceed 6,543,800 yuan;
(2) In case of road traffic accidents on other roads, the liability of the motor vehicle side will be reduced by 90%, and the motor vehicle side will bear 10%, but the maximum amount will not exceed 50,000 yuan.
Thirty-ninth non motor vehicle drivers, pedestrians and motor vehicles in a stopped state have road traffic accidents, and the motor vehicle side does not bear the responsibility for traffic accidents, and the motor vehicle side does not bear the liability for compensation.
Chapter VI Legal Liability
Article 40 Whoever gives a warning, temporarily suspends or revokes a motor vehicle driving license, detains or otherwise punishes an act that violates the laws and regulations on road traffic safety shall be dealt with by the traffic administrative department of the public security organ in accordance with the provisions of the Road Traffic Safety Law of the People's Republic of China; Where a fine is imposed, the amount of the fine shall be implemented in accordance with the standards stipulated in these Measures.
Forty-first pedestrians, passengers and non-motor vehicle drivers who violate the provisions of laws and regulations on road traffic safety shall be fined from 5 yuan to 30 yuan.
Forty-second in any of the following circumstances, the motor vehicle driver shall be fined from 20 yuan to 50 yuan:
(1) Failing to affix the inspection mark and insurance mark on the upper right corner of the front window; (two) driving a motor vehicle during the internship period, without sticking or hanging a unified practice sign at the back of the car body;
(three) not equipped with effective fire fighting equipment or not carrying warning signs of faulty vehicles with the vehicle;
(four) hanging or placing objects that hinder the driver's sight in the front and rear windows of the cab;
(five) the passenger car carries goods outside the external luggage rack and the built-in luggage compartment; (6) The goods exceed the length, width and height; (seven) in violation of the provisions of the motor vehicle; (eight) motor vehicle transfer, cancellation or mortgage, without registration; (nine) deliberately blocking, defacing the motor vehicle number plate, or hanging the motor vehicle number plate in violation of regulations;
(ten) the motor vehicle fails to spray the relevant words according to the regulations; (eleven) the city bus stops outside the road station to get on and off passengers; (twelve) the contents of motor vehicle registration have changed, and the corresponding procedures have not been handled according to the regulations;
(thirteen) posting pictures on the front and rear glass of the car body, spraying words and patterns that hinder the line of sight;
(fourteen) do not carry a motor vehicle driving license, driver's license.
Forty-third in any of the following circumstances, the motor vehicle driver shall be fined more than 50 yuan 100 yuan:
(a) the car did not stop to let people get on and off, and when the door was opened and closed, it hindered the passage of other vehicles and pedestrians, and the door and carriage were not closed properly;
(two) do not use the horn in accordance with the provisions; (three) in violation of the provisions on the installation and use of seat belts; (four) driving a motorcycle without a helmet or carrying people or goods in violation of regulations;
(five) changing lanes in the same direction or changing lanes on roads with more than two motor vehicles, which affects the driving safety of other motor vehicles;
(6) Failing to hang obvious signs or violating the specified route, time and driving speed when carrying non-detachable articles that are out of gauge;
(seven) the use of alarms and sign lamps in violation of regulations; (eight) due to the occupation of non motor vehicle lanes, non motor vehicles driving by adjacent motor vehicle lanes do not slow down;
(nine) not according to the provisions of the lane; (ten) in violation of the provisions of alternate traffic; (eleven) the use of lighting devices is not required; (12) The motorcyclist leaves the handlebar or hangs articles on the handlebar; (thirteen) the motor vehicles passing through the ferry do not wait for the ferry in turn;
(14) Failing to slow down when passing a railway crossing without traffic signals or management personnel;
(fifteen) when the motor vehicle in front is waiting in line or driving slowly, forcibly overtaking or stopping at the crosswalk or mesh line area;
(sixteen) when crossing the intersection, not in accordance with the provisions of the yield, stop waiting or not in accordance with the provisions of the route; (seventeen) not according to the designated crossing and time for out-of-gauge goods through the railway crossing;
(eighteen) driving a motor vehicle that is not registered or has not obtained a temporary pass on the road.
Forty-fourth in any of the following circumstances, the motor vehicle driver shall be fined 100 yuan or more 150 yuan or less:
(1) Failing to slow down or stop to let pedestrians pass the crosswalk; (2) Failing to avoid police cars, fire engines, ambulances and engineering rescue vehicles performing emergency tasks;
(three) in violation of the provisions of overtaking, yield, overtaking, turning around, reversing and temporary parking; (four) do not obey the traffic signals or obey the traffic police command; (five) the driving recorder is not installed or the driving recorder cannot be used normally; (six) tractors driving on highways, large and medium-sized cities and other roads that are forbidden to pass;
(seven) failing to learn to drive a motor vehicle on the road according to the specified time and route; (eight) driving in areas and roads where driving is prohibited; (nine) making phone calls, answering mobile phones or watching TV while driving, which hinders safe driving;
(ten) the number of non-operating motor vehicles exceeds the approved number; (eleven) failing to tow a trailer or a faulty vehicle according to the regulations; (twelve) did not keep a safe distance from the car in the same lane; (13) Splash or scatter the carrier while driving.
Forty-fifth in any of the following circumstances, the motor vehicle driver shall be fined more than 200 yuan 150 yuan:
(a) driving a motor vehicle that is not allowed to be driven during the internship period; (2) Turn off the fire or slide in neutral when going down a steep slope; (3) Driving a motor vehicle with an unverified motor vehicle driver's license; (four) driving a motor vehicle that does not conform to the type of driving permit;
(5) Carrying explosives, inflammable and explosive chemicals, toxic and radioactive dangerous goods without the approval of the public security organ, or driving in violation of the specified time, route and speed, or failing to hang warning signs and take necessary safety measures; (six) failing to carry out safety technical inspection of motor vehicles in accordance with the provisions; (7) changing the structure, structure, characteristics or model, engine number, frame number and vehicle identification code of a registered motor vehicle without authorization;
(eight) suffering from diseases that hinder safe driving or excessive fatigue, and continuing to drive;
(nine) driving a motor vehicle after taking psychotropic drugs or narcotic drugs under state control;
(10) When a motor vehicle breaks down or has a traffic accident, it fails to turn on the danger warning flash and set warning signs at night, and does not turn on the position light and the rear position light at the same time, which hinders traffic and makes it difficult to move;
(eleven) motor vehicle driver's license is lost, damaged, overdue or detained according to law and the score reaches 12;
(12) Driving a motor vehicle with an overseas motor vehicle driving license or driving an overseas registered motor vehicle without a temporary pass number plate and driving license;
Tractors are used to carry people.
Forty-sixth driving on highways and urban expressways, under any of the following circumstances, the driver of a motor vehicle shall be fined in 200 yuan:
(a) driving a motor vehicle that is not allowed to enter the expressway; (two) failure or traffic accident, not timely alarm and notify the special rescue vehicles, wrecker traction, traction;
(three) reversing, retrograde, crossing the central median, turning around or parking in the driveway;
(four) test drive or learn to drive a motor vehicle; (five) overtaking on the ramp, acceleration lane or deceleration lane; (six) riding, rolling the boundary of the lane or driving on the shoulder; (seven) driving or parking in the emergency lane under non-emergency circumstances; (eight) the use of turn signals or other lighting devices in violation of regulations; (nine) through the construction section does not slow down.
Forty-seventh in any of the following circumstances, the person in charge and responsible person of the road maintenance construction unit shall be fined in 200 yuan:
(1) Failing to set up construction signs, safety warning signs and safety protection facilities at the maintenance construction site;
(two) there is no obvious detour sign on the detour section, or when the construction site can not be bypassed, there is no temporary passage of vehicles and pedestrians;
(3) Warning lights are not installed on the working vehicles and machinery, or obvious identification patterns are not sprayed, or the warning lights and hazard warning flashlights are not turned on during operation.
Article 48 Whoever drives a motor vehicle after drinking alcohol shall be fined by 300 yuan; Driving an operating motor vehicle will be fined in 500 yuan.
Whoever drives a motor vehicle after being drunk shall be fined 1500 yuan; Whoever drives a motor vehicle shall be fined 2000 yuan.
Forty-ninth highway passenger cars exceed the rated passengers, and the overload is less than 20%, and the motor vehicle driver 500 yuan is fined; If the overload reaches or exceeds 20%, a fine of 2000 yuan will be imposed.
500 yuan, a motor vehicle driver, was fined for loading a passenger car on the road.
If the cargo of a freight motor vehicle exceeds the approved load quality and the overload is less than 30%, the driver of the motor vehicle shall be fined in 300 yuan; If the overload reaches or exceeds 30%, a fine of 1000 yuan or more and 2000 yuan or less shall be imposed.
If a freight motor vehicle carries passengers, the driver of the motor vehicle shall be fined 1000 yuan.
If the vehicle of the transport unit has the above situation and still fails to make corrections after being punished, the directly responsible person in charge shall be fined between 2,000 yuan and 3,000 yuan.
Fiftieth motor vehicles driving on the road, in violation of the provisions of the speed limit, shall be punished according to the following provisions:
(a) driving on expressways and urban expressways, where the speed is less than 60 kilometers per hour or less than 50% of the speed limit, the motor vehicle driver shall be fined in 200 yuan; If the speed limit exceeds 50% to 70%, the motor vehicle driver will be fined 1000 yuan; If the speed exceeds 70%, the driver of the motor vehicle will be fined 2000 yuan;
(two) driving on the road without the center line, dividing the motor vehicle lane and the non-motor vehicle lane, and exceeding the speed limit by less than 50%, the motor vehicle driver shall be fined in 50 yuan; If the speed exceeds 50% to 70%, the motor vehicle driver 300 yuan will be fined; If the speed limit exceeds 70%, the motor vehicle driver will be fined in 500 yuan;
(three) driving on other roads, exceeding the speed limit by less than 50%, the motor vehicle driver shall be fined 100 yuan; If the speed exceeds 50% to 70%, the motor vehicle driver 500 yuan will be fined; If the speed limit exceeds 70%, the driver of the motor vehicle will be fined 1000 yuan.
Article 51 If the motor vehicle safety technical inspection institution fails to inspect the motor vehicle according to the national safety technical standards or issues a false inspection report, the traffic management department of the public security organ shall impose a fine of 10 times the inspection fee.
Article 52 Whoever forges, alters or uses forged or altered motor vehicle registration certificates, license plates, driving licenses, inspection marks, insurance marks and driving licenses, or uses other motor vehicle registration certificates, license plates, driving licenses, inspection marks and insurance marks to drive a motor vehicle, shall be fined between 65,438 yuan and 0,000 yuan.
Fifty-third illegal installation of alarm and sign lamps, a fine of 1000 yuan.
Fifty-fourth motor vehicle owners and managers who fail to take out compulsory motor vehicle third-party liability insurance in accordance with the provisions of the state shall be fined twice the minimum liability insurance premium.
Article 55 In any of the following circumstances, the relevant responsible person shall be fined 1000 yuan:
(a) driving a motor vehicle without obtaining a motor vehicle driver's license or driving a motor vehicle during the period when the driver's license is revoked or temporarily detained;
(two) driving a motor vehicle that has been assembled or has reached the standard of scrapping on the road;
(three) the motor vehicle is driven by a person who has not obtained a motor vehicle driver's license or whose driver's license has been revoked or temporarily detained;
(four) causing a traffic accident and escaping, which does not constitute a crime; (5) Forcing motor vehicle drivers to drive motor vehicles in violation of road traffic safety laws, regulations and safety requirements, thus causing traffic accidents, which does not constitute a crime; (six) in violation of traffic regulations, forced passage, do not listen to discourage; (7) intentionally damaging, moving or altering traffic safety facilities, causing harmful consequences, which does not constitute a crime;
(eight) illegal interception of motor vehicles, causing serious traffic jams.
Article 56 Where plants are planted on both sides of the road, isolation belts, billboards or pipelines are set up, and street lamps, traffic lights and traffic signs are blocked, which hinders the safe sight distance, the traffic management department of the public security organ shall order it to remove the obstruction; Refuse to carry out, compulsory removal of obstruction, fine 1000 yuan.
Article 57 Whoever produces or sells motor vehicles without the permission of the national department in charge of motor vehicle products, or produces or sells assembled or modified motor vehicles without authorization, shall be fined five times the value of the illegal products.
Article 58 If the traffic administrative department of the public security organ and its traffic police violate the provisions of these measures, abuse their powers, neglect their duties or engage in malpractices for selfish ends, the responsible personnel shall be given administrative sanctions according to law; If the circumstances are serious enough to constitute a crime, criminal responsibility shall be investigated according to law; If losses are caused to the parties concerned, they shall be liable for compensation according to law.
Chapter VII Supplementary Provisions
Article 59 These Measures shall come into force as of March 6, 2005.
Sichuan Province
First, cancel the system of safety information card for motor vehicle drivers.
