The construction waste referred to in these measures refers to the new construction, alteration, expansion, repair, demolition of various types of buildings, structures, and municipal roads, pipe networks, landscaping engineering construction, housing decoration and other waste generated in the process of soil, waste materials and other waste. Article 3 the city, county (city, district) people's government shall strengthen the leadership of urban construction waste management, the establishment of coordination mechanism, timely study and solve the major problems in the disposal of construction waste.
Township (township) people's governments and street offices, under the guidance of the administrative department of municipal environmental sanitation, shall do a good job in accordance with their duties related to the management of construction waste under their jurisdiction. Article 4 The administrative department of municipal environmental sanitation is the competent department for urban construction waste disposal, and is responsible for the approval and supervision and management of construction waste disposal.
The administrative department of housing and urban-rural construction is responsible for the management of urban construction waste at source, strengthening the management of civilized construction at construction sites, and supervising the incorporation of the costs of construction waste disposal into the project preliminaries (estimates).
The traffic management department of the public security organs is responsible for the supervision and management of the road traffic and traffic safety of the construction waste transportation vehicles, and investigates and deals with the violations of the traffic safety of the construction waste transportation according to law.
Development and reform, natural resources, ecological environment, transportation, agriculture (agricultural machinery), forestry, water conservancy, market supervision and management, emergency management, urban management and other competent departments in accordance with their respective responsibilities, to do a good job related to construction waste management. Article 5 The disposal of construction waste should follow the principle of minimization, resource utilization, harmlessness and who produces, who bears the responsibility for disposal, the implementation of local management, classification and collection, centralized treatment, comprehensive utilization.
Construction waste disposal in accordance with state regulations for the implementation of the approval system, without approval, shall not be disposed of without authorization. Article VI of construction waste disposal costs by the construction unit or construction unit, respectively, and construction waste transportation enterprises, the place of elimination, resource utilization of business units to determine the negotiation, and in the transportation, elimination and disposal contract to be clear.
Construction units or construction units shall be included in the construction waste disposal costs of construction project budget (estimate). Chapter II Discharge Article 7 of the construction unit or construction unit to generate construction waste shall be in the project ten working days before the commencement of the administrative department of municipal environmental sanitation to apply for the "urban construction waste disposal (discharge) certificate", and provide the following materials:
(a) disposal of the approved application form;
(b) construction project construction permits, planning and design of the general layout plan or demolition of buildings and other relevant documents;
(c) the construction of the construction project, the general layout plan or the demolition of houses, and so on. (iii) Construction waste disposal plan, including the name of the project, construction address, type and quantity of construction waste, transportation companies, places of elimination and recycling and other matters;
(iv) construction waste can not be transferred on-site need to be transported out of the construction waste should provide the construction waste transportation contract with the approved enterprises engaged in the transportation of construction waste, and the construction waste transportation contract issued by the eligible places of elimination. Proof of consent to abatement issued by the eligible abatement site;
(v) Other materials as stipulated by laws, regulations and rules.
The administrative department of municipal environmental sanitation shall make an approval decision within five working days from the date of accepting the application. If the conditions are met, it shall issue the "municipal construction waste disposal (discharge) certificate"; if the conditions are not met, it shall not be approved and the reasons shall be explained in writing to the applicant. Article 8 For emergency rescue, disaster relief and other special circumstances require emergency discharge of construction waste, does not apply to the provisions of Article 7 of these Measures, but the construction unit or construction unit shall, within three days after the elimination of danger, disaster, the discharge of construction waste will be reported to the county (city, district) administrative department of municipal environmental sanitation and cleaned up in accordance with the requirements of the construction waste. Article IX construction unit in the project bidding or direct contracting, shall be clear in the bidding documents or contracting for the construction unit of construction waste management specific requirements and related measures, and supervise the construction unit in accordance with the requirements of civilized construction.
Construction unit or construction unit to obtain approval for the disposal of construction waste, shall be strictly in accordance with the approved requirements for the disposal of construction waste discharge of construction waste. Article 10 of the project investment of less than three hundred thousand yuan or construction area of less than three hundred square meters, as well as construction waste generated in less than five tons of the following sporadic construction activities, the owner or the construction unit may not apply for the approval of the disposal of construction waste, but shall be in accordance with the relevant provisions of the isolation of operations and the discharge of garbage, to prevent the proliferation of construction waste contamination of the surrounding environment:
(a) water supply and drainage, Electricity, gas, communications and other pipelines, pipeline construction;
(ii) road and transportation facilities maintenance;
(iii) landscaping construction;
(iv) store front decorative decoration;
(v) other sporadic construction activities that generate construction waste.
Construction waste discharged from the activities specified in the preceding paragraph shall be cleaned up by the owner or the construction unit within twelve hours after the end of construction.
