Chapter 1 General Provisions

Article 1 In order to strengthen the management of domestic waste, improve the urban and rural living environment, promote the construction of ecological civilization and sustainable economic and social development, according to the "People's Republic of China Laws and administrative regulations such as the Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Waste, the Circular Economy Promotion Law of the People's Republic of China, and the Regulations on the Management of Urban City Appearance and Environmental Sanitation have been formulated based on the actual conditions of this province.

Article 2 These regulations shall apply to activities such as source reduction, classification, placement, collection, transportation, processing, planning and construction of related facilities and their supervision and management of domestic waste within the administrative region of this province.

Domestic garbage as mentioned in these regulations refers to solid waste generated in daily life or activities that provide services for daily life, as well as waste that is regarded as domestic garbage according to laws and administrative regulations.

Article 3 Domestic waste management follows the principles of government promotion, national participation, urban and rural coordination, adaptability to local conditions, and simplicity and ease of implementation, and establishes and improves a full classification system for classified placement, collection, transportation, and treatment of domestic waste , promote the reduction, recycling and harmlessness of domestic waste.

Article 4 People’s governments at or above the county level shall strengthen leadership over domestic waste management within their respective administrative regions, incorporate domestic waste management into national economic and social development plans, and establish and improve a comprehensive coordination mechanism for domestic waste management. , the required funds are included in the fiscal budget of the corresponding level. Domestic waste management work has been incorporated into the local government’s performance assessment and evaluation system.

Township people's governments and sub-district offices are responsible for the classification and placement of rural domestic waste and the construction of collection facilities within their jurisdiction, and carry out relevant supervision work such as classification and placement, collection and transportation of domestic waste in accordance with the requirements of the people's government at higher levels. And guide village (resident) committees to do a good job in reducing and classifying domestic waste at the source.

Article 5 The provincial housing and urban-rural development department is responsible for the overall coordination and guidance of domestic waste management in the province, as well as the management of urban domestic waste; the provincial agriculture and rural development department is responsible for the management of rural domestic waste in the province.

The competent departments of city appearance and environmental sanitation of cities and counties (cities and districts) with districts are responsible for the management of urban domestic waste within their own administrative regions, and the departments of agriculture and rural affairs of cities and counties (cities and districts) with districts or Other departments determined by the people's government at the same level are responsible for the management of rural domestic waste within their respective administrative areas; in areas where coordinated urban and rural management of domestic waste is implemented, the municipal appearance and environmental sanitation department is responsible for the management of domestic waste. The departments responsible for the management of urban and rural domestic waste specified in this paragraph are hereinafter collectively referred to as the domestic waste management department.

The development and reform authorities are responsible for coordinating the implementation of the extended producer responsibility system, improving the domestic waste treatment charging mechanism, and working with relevant departments to formulate policies to promote source reduction, resource utilization and harmless treatment of domestic waste.

The competent departments of economy and information technology are responsible for promoting green packaging of products in the industrial and information fields, cultivating leading enterprises in the comprehensive utilization of renewable resources, and guiding relevant industrial enterprises to carry out comprehensive utilization of domestic waste.

The cultural and tourism authorities are responsible for the supervision and management of source reduction and classified distribution of domestic waste in tourist attractions and hotels (hotels).

The market supervision and management department is responsible for the supervision and management of source reduction and classified placement of domestic waste in farmers' markets and agricultural product wholesale markets, and works with relevant departments to strengthen the supervision and management of excessive packaging of commodities.

The competent commerce department is responsible for the supervision and management of source reduction and classification of domestic waste in shopping malls, supermarkets, and catering service establishments, establishing a recycling system that is coordinated with the recycling and utilization of domestic waste, and rationally arranging the recycling of renewable resources. outlets, and promote source reduction work in the e-commerce field.

The postal management department is responsible for promoting the standardization, reduction and recycling of postal and express packaging.

The ecological environment department is responsible for the supervision and management of pollution prevention and control of domestic waste disposal.

Other relevant departments of the people's governments at or above the county level shall, in accordance with their respective responsibilities, do a good job in the supervision and management of domestic waste in the industry.

The people's governments of cities and counties (cities, districts) divided into districts may stipulate the specific responsibilities of relevant departments for the supervision and management of domestic waste based on local conditions.

Article 6 The village (resident) committee shall do a good job in publicity and guidance on the source reduction and classification of domestic waste, organize, mobilize and supervise the village (resident) residents to carry out the source reduction and classification of domestic waste. Classified delivery work.

Encourage the inclusion of domestic waste source reduction and classification requirements into village regulations and residents' covenants.

Article 7 Renewable resources, property services, environmental sanitation, ecological environment, accommodation, catering, e-commerce, express delivery, tourism, housekeeping services and other related industry associations should formulate industry self-discipline norms to supervise and guide member units Carry out work such as reducing the source of domestic waste and classifying it.

Article 8 Science and technology and other departments should take measures to support technological innovation in domestic waste classification and processing, promote the application of advanced technologies, processes, and equipment, promote the intelligentization of domestic waste classification, and improve domestic waste reduction and resources Chemical and harmless treatment level.

Article 9 People's governments at all levels and relevant departments shall take measures to strengthen the publicity of source reduction, full-process classified management, and resource utilization of domestic waste, and popularize the knowledge of domestic waste classification.

In coordinating the promotion of civilized behavior, the guidance agency for spiritual civilization construction should strengthen the publicity and education on civilized dining and refusal of waste, advocate a simple, moderate, green and low-carbon lifestyle, and incorporate the work of classifying domestic waste into the masses Activities to create sexual spiritual civilization.

Relevant people's organizations and mass organizations such as trade unions, the Communist Youth League, and women's federations should give full play to their respective advantages to promote the reduction of domestic waste at the source and the classification of waste.

News media such as radio, television, newspapers and magazines, and the Internet should carry out public welfare propaganda on domestic waste classification and pollution prevention and control knowledge, enhance the awareness of the whole society about domestic waste source reduction and classification, and punish violations of domestic waste management. Carry out public opinion supervision.

Operators of farmers’ markets, agricultural product wholesale markets, shopping malls, supermarkets, airports, stations, docks, tourist attractions, parks, accommodation service venues, catering service venues, public cultural facilities, entertainment venues, etc. or Managers should take various forms to publicize domestic waste classification.

Article 10: Education authorities should incorporate knowledge on source reduction, classified placement, recycling, and harmless treatment of domestic waste into the education content of schools of all levels and types.

Encourage domestic waste management departments to establish domestic waste classification popular science education bases and include them in social practice education bases in accordance with regulations.

Article 11 The provincial housing and urban-rural development department shall work with the provincial agriculture and rural departments to establish an urban and rural domestic waste management information system. The districted municipal domestic waste management department has established a full-process information management system for domestic waste source reduction, cleaning and cleaning, classified placement, classified collection, classified transportation, and classified processing, and is connected to the provincial urban and rural domestic waste management information system in real time.

Article 12 Units and individuals should practice green and low-carbon lifestyles, reduce the generation of domestic waste, develop the habit of classifying domestic waste, perform the obligation to classify and put domestic waste in accordance with the law, and have the right to punish violations of domestic waste Report to the units and individuals specified by the management.

Guide and mobilize social organizations and volunteers to participate in work related to domestic waste classification.

Chapter 2 Planning and Construction

Article 13 The domestic waste management department, together with relevant departments, shall, in accordance with relevant national and provincial regulations and requirements, take into account the population, geography, and domestic waste of the region. According to the production volume, treatment targets, etc., organize the preparation of a special plan for domestic waste management in the region and submit it to the people's government at the same level for approval.

The special plan for domestic waste management should comply with the land and space planning, and clarify the layout and scale of classified placement, classified collection, classified transportation, classified processing facilities of domestic waste, as well as renewable resource recycling outlets, centralized sorting centers, and trading markets. and standards.

When formulating a special plan for domestic waste management, symposiums, demonstration meetings, hearings, etc. should be used to listen to the opinions of experts and the public. The draft plan shall be disclosed to the public for no less than 20 days.

Article 14 The domestic waste management department, together with relevant departments, shall formulate an annual plan for the classified placement, collection, transportation and construction of classified processing facilities of domestic waste based on the special plan for domestic waste management.

Article 15 Construction projects such as new construction, reconstruction, and expansion of residential quarters, public buildings, public places, etc. shall, in accordance with relevant national and provincial standards, support the construction of classified placement and classification of domestic waste. Collection facilities are designed, constructed and put into use simultaneously with the main project.

If the existing domestic waste sorting and collection facilities do not meet the relevant national and provincial standards, they shall be gradually transformed according to the prescribed standards; if it is indeed impossible to transform according to the prescribed standards, they may be modified with the consent of the domestic waste management department. Necessary facilities for classified placement and collection of domestic waste shall be reasonably equipped as needed.

No unit or individual may close, idle, dismantle, relocate or change domestic waste sorting, collection and storage facilities without authorization.

Chapter 3 Source Reduction

Article 16 People’s governments at all levels shall establish a working mechanism for source reduction of domestic waste covering production, circulation, consumption and other fields, and adopt measures to guide Organizations and individuals use recyclable, easily recyclable, and degradable products to reduce the generation of domestic waste and promote resource conservation and recycling.

Article 17 This province implements a total volume control system for domestic waste disposal.

The people's government of a city divided into districts shall formulate a total domestic waste disposal control plan based on the population size and economic and social development level of the region, and submit it to the provincial housing and urban-rural development department for approval before implementation. The total volume control plan should include the total volume of domestic waste treatment, source reduction, reduction measures, time limit requirements, etc.

Article 18 The provincial standardization authority shall organize the formulation of local standards related to green packaging based on industry development needs, and relevant departments shall promote the effective implementation of local standards in accordance with their respective responsibilities.

Product manufacturers, sellers and relevant service providers should implement national and provincial regulations on restricting excessive packaging of products and reduce the excessive use of packaging materials and the generation of packaging waste.

Producers and sellers are encouraged to adopt measures such as trade-in for new ones and direct recycling to recycle the products and packaging they produce and sell. Enterprises that produce, sell, and import products and packaging that are legally included in the compulsory recycling catalog should recycle the products and packaging in accordance with relevant national regulations.

Article 19 Operators in e-commerce, express delivery, takeout and other industries should give priority to the use of green certified electronic waybills, tapes, packaging boxes (bags) and other packaging products, and provide recyclable packaging bags. Actively recycle packaging materials, establish and use points, pricing discounts and other systems to guide consumers to use green packaging and reduced packaging.

Operators in the e-commerce and takeout industries should use packaging materials with specifications and strengths that meet express packaging requirements to avoid and reduce secondary packaging by express delivery companies.

Article 20 Prohibits or restricts the production, sale and use of some plastic products. The catalog of plastic products that are prohibited or restricted from production, sale and use and time limit requirements shall be determined by the provincial development and reform department in conjunction with relevant departments in accordance with national regulations and the actual situation of the province, and announced to the public.

No unit or individual may produce, sell or use plastic products in violation of the provisions of the preceding paragraph.

People's governments at all levels and relevant departments should take measures to promote the application of recyclable, easily recyclable, and degradable alternative products.

Departments of commerce, market supervision and management, culture and tourism, agriculture and rural areas, and postal management shall, in accordance with their national and provincial responsibilities, supervise and manage the prohibition and restriction of the production, sale, and use of plastic products.

Article 21 Catering service providers should set up frugal dining signs in conspicuous places in catering service establishments to guide consumers to consume rationally, order moderately, pack up after meals, and leave the CD-ROM; The venue provides disposable tableware proactively or free of charge, except for those that are packaged after the meal.

State agencies, institutions, and state-owned enterprises should take the lead in practicing frugal and civilized catering, provide meals in accordance with the principles of health and simplicity, establish a dynamic management system for meals, prepare and serve meals on demand, and eliminate meal waste.

Accommodation service providers such as hotels (hotels) and B&Bs are not allowed to proactively provide disposable items. Encourage hotels (hotels), B&Bs and other accommodation service providers to provide consumer supplies that are recyclable and meet hygiene requirements.

Article 22 Government procurement should give priority to recyclable products and gradually reduce the proportion of disposable supplies.

State agencies, institutions, and state-owned enterprises should take the lead in using products, equipment and facilities that are conducive to environmental protection, increase the use of recycled paper, promote paperless office, reduce the use of disposable office supplies, and shall not Use disposable cups in its internal offices.

Encourage enterprises and social groups to save and reuse office supplies and reduce the use of disposable supplies.

Article 23 Agriculture and rural areas, market supervision and management, commerce and other departments shall, in accordance with their respective responsibilities, strengthen the management of fruit and vegetable production bases, farmers' markets, agricultural product wholesale markets, shopping malls and supermarkets, and promote the listing of clean vegetables, Clean agricultural and sideline products enter the city.

Qualified farmers’ markets, agricultural product wholesale markets, shopping malls, supermarkets, etc. can build perishable waste treatment facilities that meet the prescribed requirements, establish corresponding management systems and ledgers, and conduct transactions in accordance with technical specifications and operating procedures. Rotten domestic waste is processed on-site.

In remote mountainous areas, islands and areas with dispersed populations, agricultural and rural departments can organize the construction of perishable domestic waste treatment facilities and implement on-site resource utilization or harmless treatment according to local conditions. Township people's governments and sub-district offices are responsible for the operation and maintenance of rural perishable domestic waste treatment facilities.

Article 24 The commercial departments of cities and counties (cities, districts) divided into districts shall, in conjunction with the domestic waste management departments at the same level, according to the special plan for domestic waste management in the region, and in accordance with the overall planning and rational layout of urban and rural areas. In accordance with the principles, we will promote the construction of renewable resource recycling outlets, centralized sorting centers and trading markets. The construction and operation of recycling outlets, centralized sorting centers and trading markets shall comply with relevant environmental protection, safety and fire protection regulations.

People's governments at or above the county level should formulate special support policies for the recycling of renewable resources and promote the recycling of low-value recyclables in domestic waste. The catalog of low-value recyclables is formulated by the provincial commerce department in conjunction with domestic waste management, finance and other departments at the same level.

Article 25: Guide and encourage leading renewable resource recycling enterprises to establish a recycling network with reasonable layout, convenient delivery and sales, and orderly acquisition through chain operations, authorized operations, etc., to improve intensification and scale level.

Encourage the establishment of convenient recycling points in residential areas, villages, shopping malls, supermarkets and other places, and use methods such as trading in old ones for new ones, setting up automatic recycling machines, and online shopping and delivery to recycle packaging materials to recycle renewable resources.

Encourage renewable resource recycling operators to use modern information technology to recycle renewable resources through intelligent recycling and other methods.

Chapter 4 Classified Disposal

Article 26 Domestic waste in this province is divided into the following four categories:

(1) Recyclable materials refer to materials suitable for recycling Domestic waste that can be recycled mainly includes discarded paper, plastics, metals, packaging, textiles, electrical and electronic products, glass, etc.;

(2) Perishable waste refers to waste in production and operations and perishable household waste generated by residents in their daily lives, including discarded vegetables and fruits, meat, aquatic products, rice and flour foods, edible oils and fats, nuts and roasted seeds and nuts, etc.;

(3) Hazardous waste, Refers to domestic waste that has direct or potential harm to human health or the natural environment, mainly including discarded batteries (cadmium nickel batteries, mercury oxide batteries, lead-acid batteries, etc.), fluorescent lamps, mercury-containing thermometers, mercury-containing sphygmomanometers, medicines and their Packaging materials, paints, solvents and their packaging materials, pesticides, disinfectants and their packaging materials, film and photographic paper, etc.;

(4) Other garbage, including recyclables and perishable garbage , other domestic waste other than hazardous waste.

The provincial housing and urban-rural development department shall, in conjunction with relevant provincial departments, formulate and publish a guidance catalog for domestic waste classification in accordance with the provisions of the preceding paragraph. The people's governments of municipalities divided into districts may refine the classification categories based on the guidance catalog and the actual conditions of the region.

Promote the establishment of a garbage classification labeling system, and producers and sellers will gradually set eye-catching garbage classification labels on product packaging.

Article 27 Units and individuals that generate domestic waste are responsible for the classification and placement of domestic waste. They must classify and place domestic waste into corresponding collection containers in accordance with regulations, and shall not throw, dump, pile or pile it at will. Burn.

Article 28 The signs and labels of domestic garbage collection containers shall comply with relevant national or provincial regulations.

Producers and operators engaged in environmental protection, recycling of renewable resources, etc. are encouraged to set up special collection containers for specific types of recyclables and hazardous waste.

Article 29 Urban residential areas and other residential areas should be equipped with separate collection containers for recyclables, perishable garbage, hazardous garbage, and other garbage. In residential areas where conditions permit, special collection containers can be set up according to specific types of recyclables and hazardous waste.

Villages should set up separate collection containers for perishable garbage and other garbage, and centrally set up collection containers for recyclables and hazardous garbage as needed.

Catering service establishments, farmers’ markets, agricultural product wholesale markets, and cold chain warehousing and logistics enterprises should set up perishable garbage and other garbage collection containers; among them, the perishable garbage collection containers set up in catering service establishments should be airtight .

Public buildings, public places, urban roads, and commercial facilities should be equipped with recyclables and other garbage collection containers.

Article 30 establishes a responsible area system for the classification and management of domestic waste. The management responsible persons of various responsible areas shall be determined in accordance with the following provisions:

(1) Residences employing property service companies The residential complex is the responsibility of the property service company; the residential community that implements self-management is the responsibility of the homeowners committee; the residential community that has not hired a property service company and has not established a homeowners committee is the responsibility of the village (resident) committee;

(2) Office buildings, shopping malls, various markets, accommodation, restaurants and other business places are the responsibility of the management unit;

(3) Subway stations, airports, stations, docks, parking lots, and bus procedures The management unit is responsible for the site and its management scope;

(4) Railways, highways, urban roads, subways, tunnels, underground passages, rivers, lakes and other waters are the responsibility of the management unit;

(5) Public places such as parks, squares, tourist attractions, public cultural facilities, and entertainment venues shall be the responsibility of the management unit;

(6) Construction projects The construction site is the responsibility of the construction unit, and the land for construction projects that have not yet started is the responsibility of the construction unit; (7) The management areas of agencies, groups, troops, schools, hospitals and other enterprises and institutions are the responsibility of the unit;

(8) Villages are responsible for the village committees.

If the person responsible for management cannot be determined in accordance with the provisions of the preceding paragraph, or the relevant unit has objections to the determination of the person responsible for management, the person responsible for management shall be determined by the local township people's government or sub-district office; if it crosses administrative regions, the person responsible for management shall be determined by the relevant people's government Determined through consultation; if the negotiation fails, it shall be determined by the corresponding superior domestic waste management department.

Article 31 The person responsible for the classification and management of domestic waste shall perform the following obligations:

(1) Establish a responsibility system and daily management system for the classification and distribution of domestic waste;

(2) Carry out publicity on the knowledge of domestic waste classification, and guide and supervise units and individuals to classify domestic waste;

(3) Set up, clean and maintain domestic waste classification collection containers in accordance with relevant regulations;

(4) Handle the classified domestic waste to the domestic waste collection and transportation units that meet the prescribed conditions;

(5) Punish the units and individuals who do not classify the domestic waste in accordance with the regulations , provide persuasion, and urge corrections; if they refuse to make corrections, they shall promptly report to the local township people's government, sub-district office, or domestic waste management department.

Township people's governments and sub-district offices should supervise the performance of management responsibilities by management personnel within their jurisdictions, and promptly report to the domestic waste management department any violation of domestic waste classification regulations that should be punished in accordance with the law. If a property service enterprise is the person responsible for management, the property management department shall include its performance of management responsibilities in the industry supervision content.

Chapter 5 Classified Collection, Transportation, and Treatment

Article 32: The city’s city appearance and environmental sanitation authorities are responsible for organizing the collection and transportation of urban domestic garbage. Units engaged in commercial collection and transportation of urban domestic waste must meet the conditions stipulated by the state.

The village committee is responsible for organizing the collection of rural domestic waste, and the township people's government and sub-district offices are responsible for organizing the transportation.

Article 33: Domestic waste collection and transportation units shall comply with the following regulations:

(1) Use sealed vehicles, Ships;

(2) Transport the domestic garbage collected in categories to the prescribed locations at the specified frequency and time, and do not discard or scatter domestic garbage along the way;

(3) Do not transport Mixed collection and transportation of classified domestic waste;

(4) Establish a management ledger to record the source, category, quantity and destination of domestic waste, and regularly report information to the domestic waste management department.

If the domestic waste collection and transportation unit discovers that the domestic waste delivered by the person responsible for the classification and management of domestic waste is not classified as required, it shall promptly report to the local township people's government, sub-district office or domestic waste management department .

Article 34 People’s governments at all levels or domestic waste management departments may carry out domestic waste cleaning, collection, transportation and processing by purchasing services.

Encourage and support social capital to participate in the cleaning, collection, transportation and processing of domestic waste. People's governments at or above the county level can guide social capital to participate in the construction, renovation, operation and management of domestic waste classification facilities through franchising, government-social capital cooperation, etc.

Article 35 Domestic waste shall be classified and processed in accordance with the following provisions:

(1) Recyclable materials shall be processed through resource recovery and utilization;

( 2) Perishable waste is recycled or treated harmlessly through methods such as composting, anaerobic methane production, and biochemical treatment;

(3) Hazardous waste is treated harmlessly in accordance with relevant national and provincial regulations ; Among them, hazardous wastes shall be treated as hazardous wastes;

(4) Other wastes shall be utilized and treated harmlessly through incineration and power generation.

Waste electrical and electronic products in domestic waste shall be disposed of in accordance with relevant laws and regulations.

Domestic waste shall not be disposed of in landfill except for emergency disposal.

Article 36 Fly ash generated by domestic waste incineration treatment facilities shall be treated harmlessly in accordance with national and provincial regulations on hazardous wastes.

Article 37: Used furniture and other bulky and highly integrated bulky garbage can be recycled by making an appointment with a renewable resource recycling operator, or placed in a place designated by the responsible person for domestic waste management in the area. After classified collection, classified transportation and disassembly, resource utilization or harmless treatment is carried out.

Township people’s governments and sub-district offices should set up large garbage storage, transfer or sorting places based on local conditions.

Article 38 Domestic waste disposal units shall abide by the following regulations:

(1) Maintain the normal operation of domestic waste treatment facilities and equipment, and classify and receive waste in accordance with relevant national and provincial standards. Dispose of domestic waste;

(2) Dispose of domestic waste in accordance with technical specifications, operating procedures and pollution control standards, and promptly handle the waste water, waste gas and waste residue generated;

(3) Establish management Accounts should be kept to truthfully record the source, type, quantity and destination of recycled products of domestic waste received, and regularly submit information to the domestic waste management department;

(4) Establish and improve an environmental information disclosure system, and comply with laws and regulations Disclose to the public the main pollutant emission data, environmental testing and other information of domestic waste treatment facilities.

Article 39 The people's government of a city divided into districts shall establish a charging system for domestic waste treatment in accordance with the principle of paying for whoever generates more waste and paying more for more waste.

The formulation of charging standards and charging methods for domestic waste treatment should be based on local realities and combined with the classification of domestic waste, reflecting differentiated management such as classified pricing and metering charges, and fully solicit public opinions.

Units and individuals shall pay domestic waste disposal fees in accordance with the charging standards and charging methods prescribed by the people's government of the districted municipality.

Article 40 The domestic waste management department shall prepare an emergency plan for domestic waste disposal and establish an emergency mechanism for the collection, transportation and treatment of domestic waste.

If an unexpected incident occurs and domestic waste cannot be collected, transported or processed normally, the relevant units shall immediately report to the domestic waste management department, which shall promptly organize and dispose of it in accordance with the emergency plan.

Article 41 The people's governments of cities and counties (cities, districts) divided into districts shall, in accordance with the principles of regional coordination and comprehensive construction and sharing, establish a compensation mechanism for the cross-regional treatment of domestic waste and Emergency linkage mechanism.

If domestic waste is transferred and processed across administrative areas above the county level, the people's governments of the moving party and the receiving party shall reach an agreement through consultation. The people's government of the place where the moving party is located shall compensate the people's government of the place where the receiving party is located based on the transferred processing volume through a method agreed upon by both parties.

Chapter 6 Legal Liability

Article 42 If relevant laws and administrative regulations have legal liability provisions for violations of these Regulations, those provisions shall prevail.

Article 43 Anyone who violates the provisions of Paragraph 2 of Article 20 of these Regulations by selling relevant plastic products shall be ordered to make corrections by the market supervision and management department and shall be fined not less than 5,000 yuan but not more than 50,000 yuan; depending on the circumstances In serious cases, a fine of not less than 50,000 yuan but not more than 100,000 yuan may be imposed.

Article 44 If a catering service provider violates the provisions of Paragraph 1 of Article 21 of these Regulations and provides disposable tableware on its own initiative or free of charge, the commerce and market supervision and management departments shall order it to make corrections; if the circumstances are serious, , the market supervision and administration department shall impose a fine of not less than 1,000 yuan but not more than 10,000 yuan.

If a hotel (hotel), in violation of the provisions of paragraph 3 of Article 21 of these Regulations, proactively provides disposable items, it shall be ordered to make corrections by the competent cultural and tourism department; if the circumstances are serious, a fine of not less than RMB 1,000 and RMB 10,000 shall be imposed. A fine of less than RMB 10,000.

Article 45 If any unit or individual violates the provisions of Article 27 of these Regulations and disposes domestic waste without classification, the domestic waste management department shall order it to make corrections; if the circumstances are serious, the individual shall be fined 200 yuan A fine of not less than RMB 2,000 but not more than RMB 2,000 shall be imposed on the unit, and a fine of not less than RMB 50,000 but not more than RMB 500,000 shall be imposed on the unit.

Article 46 If the person responsible for the classification and management of domestic waste fails to perform the responsibility for the classification and management of domestic waste in violation of the provisions of Paragraph 1 of Article 31 of these Regulations, the domestic waste management department shall order him to make corrections. A fine of not less than 500 yuan but not more than 5,000 yuan may be imposed; if the circumstances are serious, a fine of not less than 5,000 yuan but not more than 30,000 yuan may be imposed.

Article 47 If the provisions of Article 33, Paragraph 1, Item 1 of these Regulations are violated, and the vehicles or ships used by domestic waste collection and transportation units do not meet the prescribed requirements, the domestic waste management department shall Order to make corrections and impose a fine of not less than 3,000 yuan but not more than 30,000 yuan.

In violation of the provisions of Item 2 and Item 3 of Article 33, Paragraph 1 of these Regulations, the domestic garbage collection and transportation unit fails to transport domestic garbage to the prescribed location in accordance with the prescribed frequency and time, or If domestic waste is collected and transported in a mixed manner, the domestic waste management department shall order it to make corrections and impose a fine of not less than 5,000 yuan but not more than 50,000 yuan; if the circumstances are serious, a fine of not less than 50,000 yuan but not more than 500,000 yuan may be imposed.

Article 48 If a domestic waste disposal unit violates the second paragraph of Article 38 of these Regulations and fails to process domestic waste in accordance with technical specifications and operating procedures, the domestic waste management department shall order it to make corrections; circumstances In serious cases, a fine of not less than 10,000 yuan but not more than 100,000 yuan will be imposed.

Article 49 Any violation of the provisions of these Regulations that results in administrative penalties and is considered adverse information as stipulated in the "Zhejiang Provincial Public Security Bureau Credit Information Management Regulations" shall be recorded in the credit file in accordance with relevant regulations.

Article 50 If the domestic waste management department and other relevant departments, township people's governments, sub-district offices and their staff commit any of the following acts, they shall be ordered to make corrections by the competent authority; if serious consequences are caused, The persons in charge and other directly responsible persons who are directly responsible shall be punished by the competent authorities in accordance with the law:

(1) Failure to carry out domestic waste classification publicity, education, and training in accordance with regulations;

(2) Failure to perform domestic waste supervision and management duties in accordance with the law;

(3) Failure to investigate and handle relevant complaints or reports in accordance with the law;

(4) Other negligence Duties, abuse of power, and acts of malpractice for personal gain.

Chapter 7 Supplementary Provisions

Article 51 The urban domestic waste referred to in these regulations refers to the towns (central urban areas) and other places where the people's governments of cities and counties are located within the administrative region of this province. Domestic waste in built-up areas of towns, economic development zones, industrial parks and other areas subject to urban management, as well as other areas delineated and announced by the people's governments at or above the county level.

The term “rural domestic waste” as mentioned in these Regulations refers to domestic waste in other areas outside the scope specified in the preceding paragraph.

Article 52 These regulations will come into effect on May 1, 2021. The "Zhejiang Province Urban Domestic Waste Classification Management Measures" issued by the Zhejiang Provincial People's Government will be abolished at the same time.
