Is the hospital outsourcing department illegal?

Legal analysis: illegal, the so-called outsourcing or leasing of departments refers to the behavior that a medical institution with legal business qualifications hands over one or part of its internal departments to a leasing or contracting entity to operate in the name of a medical institution by signing a contract or agreement. As for whether the contracting subject is a legal person, natural person or other organization, and whether the contracting subject has the necessary relevant documents stipulated by medical and health laws, regulations or rules, the medical institution will not ask.

Legal basis: Article 100 of the Basic Medical Care and Health Promotion Law of People's Republic of China (PRC) violates the provisions of this law and commits any of the following acts, the competent health department of the people's government at or above the county level shall order it to make corrections, confiscate its illegal income and impose a fine of more than two times but less than ten times its illegal income. If the illegal income is less than 1 10,000 yuan, it shall be calculated as 1 10,000 yuan; (1) Medical and health institutions organized by the government and invested by other organizations that do not have independent legal personality; (two) medical institutions lease and contract medical departments; (3) Non-profit medical and health institutions distribute or distribute income in disguised form to investors and sponsors.
