Regulations of Jiujiang Municipality on the Administration of Water Conservancy Projects

Article 1 In order to strengthen the management of water conservancy projects, ensure the safe and normal operation of water conservancy projects, and give full play to the functions and benefits of water conservancy projects, these Regulations are formulated in accordance with the provisions of People's Republic of China (PRC) Water Law, People's Republic of China (PRC) Yangtze River Protection Law, Jiangxi Water Conservancy Project Regulations and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the management of various projects and supporting facilities for the development, utilization, control, allocation and protection of water resources in rivers, lakes and underground water sources such as dikes, reservoirs, dams, sluices, pumping stations, channels and hydropower stations within the administrative area of this Municipality.

The management of shipping, urban and rural water supply, urban drainage, sewage treatment and tailings dam projects shall be implemented in accordance with the provisions of relevant laws and regulations. Article 3 The people's governments of cities and counties (cities, districts) (administrative committees) shall strengthen their leadership in the management of water conservancy projects, increase financial input, and coordinate and solve major problems in the management of water conservancy projects.

Township people's governments and sub-district offices are responsible for the management of small rural water conservancy projects directly managed by the water administrative department of the people's governments at or above the county level (CMC) within their respective administrative areas.

The village (neighborhood) committee shall mobilize and organize the village (neighborhood) people to carry out the management of water conservancy projects, and assist the township people's governments and sub-district offices in the management of other water conservancy projects. Fourth city and county (city, district) people's government (CMC) water administrative departments in accordance with the hierarchical management authority, responsible for the management and supervision of water conservancy projects within their respective administrative areas.

Cross-administrative water conservancy projects are managed by the water administrative department of the people's government at the next higher level, or by the water administrative department of the people's government of the county (city, district) or the township people's government or the sub-district office that mainly benefits.

City, county (city, district) people's government (CMC) and other relevant departments shall do a good job in the management of water conservancy projects in accordance with their respective responsibilities. Fifth water conservancy project management units or managers, specifically responsible for the daily management of water conservancy projects.

Water conservancy project management units and managers should strengthen the inspection and safety inspection of water conservancy projects, timely discover and deal with hidden dangers in safe operation, and report to the water administrative department or the township people's government and sub-district offices.

Small rural water conservancy projects such as mountain ponds that undertake farmland water conservancy functions and final canal system projects in irrigation areas shall determine the daily management subject in accordance with the relevant provisions of the state and this province. City, county (city, district) people's government (CMC) should increase investment, strengthen the rectification of small rural water conservancy projects such as mountain ponds and the last canal system projects in irrigation areas, and ensure their safe and normal operation. Sixth city and county (city, district) people's government (CMC) should take measures to strengthen the construction of grass-roots water conservancy service institutions and water conservancy project management professionals. Township people's governments and sub-district offices shall clarify the management institutions of water conservancy projects, determine specialized management personnel, and implement management responsibilities.

City, county (city, district) people's government (CMC) water administrative departments should strengthen the business guidance and training of water conservancy project management personnel. Article 7 The people's governments of cities and counties (cities, districts) shall include the public welfare function management funds of state-owned pure public welfare water conservancy projects and state-owned quasi-public welfare water conservancy projects into the fiscal budget at the corresponding level. Management funds include on-the-job personnel funds, retirees funds, public funds, daily operation and maintenance funds of the project and other basic expenditures.

The management funds of state-owned operating water conservancy projects shall be borne by the water conservancy project management unit.

Non-state-owned water conservancy projects undertake public welfare tasks, and the government subsidizes management funds.

City, county (city, district) people's government (CMC) shall support and encourage social forces to participate in the operation and management of water conservancy projects by investing in water conservancy projects or providing water services according to law, and collecting water supply and water charges, and guarantee their legitimate business income. Eighth water conservancy project construction units in the formulation of new water conservancy project construction plan, should formulate water conservancy project management plan. The relevant administrative departments shall not approve or approve a water conservancy construction project without a governance plan.

The water administrative department of the Municipal People's Government shall formulate a model text of the management plan, and standardize the management unit, management responsibility and management funds. Ninth water conservancy projects within the administrative area of this Municipality, in addition to national and provincial water conservancy projects, are divided into municipal water conservancy projects, county (city, district) water conservancy projects and township (town, street) water conservancy projects.

The list of municipal water conservancy projects shall be formulated or proposed by the water administrative department of the Municipal People's Government and submitted to the Municipal People's Government for determination.

The list of county (city, district) water conservancy projects and township (town, street) water conservancy projects shall be formulated or proposed by the water administrative department of the county (city, district) people's government (CMC) in conjunction with the township people's government and street offices, and submitted to the county (city, district) people's government (CMC) for determination.

City, county (city, district) people's government (CMC) shall regularly organize water conservancy project survey. Tenth city, county (city, district) people's government (CMC) water administrative departments shall, in accordance with the relevant provisions of the state and the province, timely put forward a plan for the delineation of the scope of management and protection of state-owned water conservancy projects, and report it to the city, county (city, district) people's government (CMC) for delineation.

The management scope and protection scope of non-state-owned water conservancy projects shall be delineated by the water conservancy project managers in accordance with the relevant provisions of the state and this province, and submitted to the county (city, district) people's government (Administrative Committee).

The scope of management and protection of water conservancy projects in urban planning areas and industrial parks outside urban planning areas shall be delineated by the water administrative department in conjunction with the departments of housing and urban and rural construction, natural resources, ecological environment and forestry. According to the historical situation, report to the people's government at the same level for demarcation.

City, county (city, district) people's government (CMC) shall announce to the public the management scope and protection scope of water conservancy projects, water conservancy project management units and water conservancy project managers.
