Beijing dog management regulations

September 5, 2003, the Beijing Municipal People's Congress Standing Committee of the twelfth session of the sixth meeting adopted

Article 1 In order to strengthen the management of dog breeding, to protect the health and personal safety of citizens, and to maintain the city environment and social **** order, according to the relevant state laws and regulations, combined with the actual situation in the city, to formulate the provisions of this regulation.

Article 2 The city's administrative area of the institutions, groups, troops, enterprises and institutions, other organizations and individuals, shall comply with these provisions.

Article III of the city of dog ownership to implement strict management, limit the combination of management policy, government departments to enforce the law, grass-roots organizations involved in the management, public supervision, dog owners self-discipline.

Article 4 The people's governments at all levels are responsible for the organization and implementation of these provisions.

The city and district, county, township people's governments and street offices, should be established by the public security, industrial and commercial administration, animal husbandry and veterinary medicine, health and other administrative departments and urban management and law enforcement organizations to coordinate the management of dog management work mechanism.

The public security organs are the competent authorities of the management of dog-raising work, fully responsible for the management of dog-raising work, and specifically responsible for dog-raising registration and annual inspection, investigation and handling of unlicensed dog-raising, illegal dog outing and other acts.

The relevant administrative departments and urban management and law enforcement organizations in accordance with the division of responsibilities, each responsible for:

(a) animal husbandry and veterinary administrative departments responsible for dog immunization, quarantine and other related management work;

(b) urban management and law enforcement organizations are responsible for the street flow of unlicensed sale of dogs and dog ownership and damage to the city environment and health behavior of the investigation and handling; to assist the public security organs to investigate and deal with the unlicensed dog breeding. Public security organs to investigate and deal with unlicensed dog breeding, illegal to go out with dogs and other acts;

(C) industrial and commercial administration is responsible for the supervision and management of business activities engaged in dog;

(D) health administrative departments are responsible for human rabies vaccination and rabies patient diagnosis and treatment of management.

Residents' committees, villagers' committees and other grass-roots organizations shall assist the people's governments at all levels in the city to do a good job of dog management.

Article 5 street offices, township people's governments and residents' committees, villagers' committees, residents and villagers shall carry out in accordance with the law, civilized dog breeding publicity, education and training.

Radio, television, newspapers and other news media, should do a good job of dog management laws and regulations, as well as publicity and education on health and epidemic prevention.

Article 6 The residents' committee, the villagers' committee, the owners' committee can convene residents' meetings, villagers' meetings, owners' meetings, the residential area of the provisions of the dog management matters in accordance with the law to formulate a convention, and organize and supervise the implementation. Residents, villagers, owners shall comply with the convention.

Article VII of the city's Dongcheng District, Xicheng District, Chongwen District, Xuanwu District, Chaoyang District, Haidian District, Fengtai District, Shijingshan District for the focus of management, other districts and counties for the general management.

Rural areas within the key management area, decided by the district people's government, can be managed in accordance with the general management area. The towns and cities in the general management area and the special areas where the population gathers can be managed according to the key management area by the decision of the people's government of the district or county.

Article 8 The hospitals and schools within the administrative area of the city teaching area, student dormitory area prohibited to raise dogs.

Tiananmen Square, as well as East and West Chang'an Street and other major roads are prohibited to walk dogs. The list of major roads is determined by the Municipal People's Government and announced to the public.

The Municipal People's Government can designate areas during major holidays or major events to prohibit the walking of dogs.

District and county people's governments can designate specific areas within their administrative regions to prohibit the raising of dogs, prohibit walking dogs.

Residents' meetings, villagers' meetings, owners' meetings, after discussion and decision, can be in the residential area to designate the area prohibited walking dogs.

Article IX of the city to implement the dog registration and annual inspection system. Without registration and annual inspection, any unit or individual shall not raise dogs.

Article 10 in the key management area, each household is allowed to keep only one dog, shall not keep strong dogs, large dogs. The specific breeds of prohibited dogs and body height and length standards, determined by the animal husbandry and veterinary administrative departments, announced to the community.

State-level cultural relics protection units, dangerous goods storage units and other special work needs to raise dogs, must be to the unit where the public security organs for dog registration.

Article 11 Individuals raising dogs, shall have the following conditions:

(a) legal identification;

(b) have full capacity for civil behavior;

(c) have a fixed abode and live in a single-family household;

(d) residence outside the prohibited areas of the dog.

Article 12 Individuals shall obtain the consent of the residents' committee or villagers' committee before raising dogs. If the conditions for raising dogs are met, the residents' committee or villagers' committee shall issue a certificate of compliance with the conditions for raising dogs, and shall sign a bond with them on the obligation to raise dogs.

The dog owner shall obtain the residents' committee, the villagers' committee issued a certificate of compliance with the conditions of dog-raising within 30 days from the date of the certificate to the residence of the district or county public security organs of dog-raising registration, dog-raising registration card.

After obtaining the dog registration certificate, the dog owner shall bring the dog to the animal clinic approved by the animal husbandry and veterinary administrative department for a health check of the dog, free rabies vaccination, and receive the animal health immunization certificate issued by the animal epidemic prevention and supervision agency.

The dog registration card annual inspection, dog owners in the annual inspection should show a valid dog registration card and animal health immunization certificate. The public security organs shall announce the time, place and requirements of the annual inspection of the dog registration certificate.

Article 13 The dog shall pay management service fees.

The first year for each dog in the key management area is 1000 yuan, and 500 yuan for each subsequent year.

For blind people to raise guide dogs and people with severe physical disabilities to raise assistance dogs, management service fees are exempted. For sterilized dogs or widows and widowers who have difficulties in raising dogs, the management service fee for the first year will be reduced by half.

The fees for the general management area shall be determined by the people's governments of the districts and counties according to the actual situation.

The fees paid by the dog centralized to the state treasury, into the financial budget management. Dog management work and the cost of services incurred in the management of the relevant departments into the departmental budget.

Article 14 of the change of domicile of the dog breeder shall, within 30 days from the date of change, with the dog registration card to the new domicile registration authority for change registration.

The dog keeper will be registered in the general management area of the dog, transferred to the key management area to keep, shall comply with the key management area of the conditions of the dog, and within 30 days from the date of transfer, with the dog registration card to the place of keeping the registration authority to apply for changes in the registration, and make up for the difference in management service fees.

If the dog keeper transfers the dog to another person, the transferee shall register the change with the registration authority.

Article 15 of the dog keeper lost the registration card, should be lost within 15 days from the date of the original registration authority to apply for reissue.

Article 16 The death or disappearance of the dog, the dog owner shall go to the registration authority for cancellation procedures. Failure to cancel the formalities, shall not keep dogs.

If a dog owner needs to give up his dog for any reason, he shall send the dog to the dog retention and inspection center and go to the public security organs for cancellation procedures.

Article 17 The dog keeper shall comply with the following provisions:

(1) No dog shall be allowed to enter the market, stores, commercial districts, hotels, parks, public **** green space, schools, hospitals, exhibition halls, theaters, stadiums, community **** fitness places, playgrounds, waiting rooms and other public **** places;

(2) No dog shall be allowed to ride on public **** places, except for small-size **** taxis. Taxi other than public **** transportation; with a dog to take a small taxi, should obtain the consent of the driver, and for the dog to wear a muzzle, or put the dog into a bag, cage, or embrace;

(c) with a dog to take the elevator, should be avoided to take the elevator at peak hours, and for the dog to wear a muzzle, or put the dog into a bag, cage; Residents' committees, villagers' committees, property owners' committees Can be based on the actual situation to determine the specific time prohibited to take the elevator with a dog;

(d) with a dog out of the house, the dog should be harnessed leash, led by an adult, the person with the dog should carry a dog registration card, and should avoid the elderly, disabled, pregnant women and children;

(e) the implementation of tethering of potent dogs, large dogs or captive, shall not be out of the house to walk the dog; due to registration, annual inspection, immunization, medical treatment, etc. out of the house, the dog shall be kept in a cage, and the dog should be placed in a bag.

(vi) When a dog is taken out of the house, the person who carries the dog shall immediately remove any feces excreted by the dog outdoors;

(vii) Keeping a dog shall not interfere with the normal life of other people; when the barking of a dog affects the rest of other people, the person who keeps the dog shall take effective measures to stop it;

(viii) Regularly vaccinating the dog for preventive medicine shall be provided to prevent the dog from being infected by the vaccine. ) Regular vaccination of dogs against rabies;

(ix) shall not abuse or abandon the dog;

(x) strictly fulfill the other obligations set out in the guarantee of the obligation to raise dogs.

Article 18 If a dog injures another person, the owner of the dog shall immediately send the injured person to a medical institution for treatment and advance payment of medical expenses.

Due to the fault of the dog keeper or a third party. Causing the dog to injure others, the dog owner or the third party shall bear all the medical expenses of the injured person, and compensate the injured person for other losses according to law.

Article 19 of the injured dog or suspected rabies dog, the dog keeper shall be promptly sent to the public security organs of the establishment of the canine retention inspection by the animal epidemic prevention and supervision institutions for quarantine; confirmed rabies dog, animal epidemic prevention and supervision institutions shall take extermination measures according to law, and harmless disposal.

Units and individuals who find rabies and other epidemics should promptly report to the district and county animal husbandry and veterinary medicine, health administrative departments; city and district and county people's governments receive the report, should be based on the epidemic to delineate the epidemic point, the epidemic area, and to take emergency extermination and other prevention and control measures. Public security organs to assist in the work.

Article 20 engaged in dog breeding, sales, dog exhibitions, animal clinics or engage in other canine business activities, shall obtain permission from the animal husbandry and veterinary administrative departments, according to law, business registration, and to the public security organs for the record.

The personnel engaged in animal diagnosis and treatment should have veterinary qualifications, and after the practice of registration.

Prohibited areas, key management areas are prohibited to engage in dog breeding, sales and organization of dog exhibitions.

Article 21 The units and individuals who breed and sell dogs must comply with the following provisions:

(1) The breeding dogs shall be vaccinated against canine rabies, and the animal health immunization certificate shall be issued by the animal epidemic prevention and supervision agency after the vaccination;

(2) The dogs for sale have animal health immunization certificates and quarantine certificates;

(3) Breeding dogs shall not be taken out of the breeding site.

Article 22 prohibits the fraudulent use, alteration, forgery, sale and purchase of documents and certificates related to raising dogs and engaging in dog business activities.

Article 23 Any unit or individual has the right to criticize, discourage, or reflect to the residents' committee or villagers' committee, or report to the relevant administrative departments, and the residents' committee, villagers' committee and the relevant departments shall deal with the violation of the provisions of the dog-raising behavior in a timely manner.

Article 24 Disputes arising from dog ownership interfering with the normal life of others, the parties may apply to the People's Conciliation Commission for mediation, or directly to the People's Court; the parties did not apply for mediation, the People's Conciliation Commission can also take the initiative to mediate.

The people's conciliation committee under the auspices of the mediation agreement, the parties shall fulfill.

Article 25 The public security organs shall establish a record of violations of the dog record file, the dog breeder has been reported or punished repeatedly to focus on management.

The dog breeder in violation of these provisions, the public security organs confiscated its dog, revoke the dog registration certificate, within five years will not apply for dog registration.

Residents' committees and villagers' committees shall disclose to residents and villagers the registration and annual inspection of dogs in their residential areas.

Article 26 For violation of the provisions of Article 8, Article 10, paragraph 1, Article 22, in the prohibited areas to raise dogs or in the key management areas to keep potent dogs, large dogs, as well as fraudulent use, alteration and forgery of the dog registration card dog, the public security organs confiscate their dogs, and may impose a fine of 10,000 yuan on the unit, 5,000 yuan on the individual fine.

Article 27 For violation of Article 9 of these provisions, without registration, annual inspection of dog breeding, the public security organs confiscate their dogs, or the unit imposed a fine of 5,000 yuan, a fine of 2,000 yuan for individuals.

Article 28 In violation of the provisions of Article 14, Article 15, overdue for the change of registration of dog breeding or lost dog registration card overdue replacement, the public security organs shall order a period of time to make corrections, and may impose a fine of 2,000 yuan on the unit, a fine of 500 yuan on the individual.

Article 29 One of the following acts, the public security organs shall be warned, and may impose a fine of 2,000 yuan on the unit, the individual shall be fined 500 yuan; the circumstances are serious, the confiscation of its dog, revocation of the dog registration certificate:

(a) violation of the provisions of Article VIII, in the prohibited walking area to walk the dog;

(b) violation of the provisions of Article 17, paragraph 1, (2) Entering a public **** place, taking a public **** transportation or a small rental car with a dog;

(3) Taking an elevator in violation of the third item of Article 17 of these regulations;

(4) Taking a dog out of the house in violation of the fourth and fifth items of Article 17 of these regulations;

(5) Bringing a bred dog out of the of the breeding site.

Article 30 For the violation of the provisions of Article 17, paragraph 6, the person with the dog on the dog in the outdoor excretion of feces is not immediately removed, damage to the city's environmental health, by the urban management and law enforcement organizations ordered to make corrections, and may impose a fine of 50 yuan.

Article 31 of the violation of the provisions of Article 20, Article 21, paragraph 1 and 2, Article 22, illegal dog business activities, by the administration for industry and commerce or animal husbandry and veterinary administration department shall be dealt with according to law; the street flow of unlicensed sale of dogs, by the urban management of the comprehensive law enforcement organization shall be dealt with according to law.

Article 32 The administrative departments and urban management and law enforcement organizations with responsibility for the management of dog breeding and their staff shall implement the law enforcement responsibility system, in accordance with the legal procedures to actively perform their management duties, civilized law enforcement.

The administrative departments and urban management and law enforcement organizations with dog management responsibilities for the staff, one of the following acts, by their units or higher authorities to give criticism and education ordered to correct; the circumstances are serious, given administrative sanctions:

(a) the conditions of the dog breeder does not meet the requirements of the dog breeder registration, annual inspection, or intentional delays;

p> (B) the problems found in the law enforcement inspection or received reports, not dealt with in accordance with the law or shirking responsibilities;

(C) other abuse of power, dereliction of duty, favoritism and malpractice.

Article 33 The municipal public security organs to set up a dog retention inspection center, responsible for sheltering and dealing with dog breeders to give up breeding dogs, confiscated dogs and ownerless dogs.

The public security organs of the establishment of the dog retention inspection center sheltered dogs, from the date of sheltering within seven days can be claimed, adopted; unclaimed, adopted by the public security organs are responsible for the disposal of sick and dead dogs, should be carried out pollution-free treatment.

Article 34 The municipal people's government and the relevant administrative departments shall formulate supporting regulations and normative documents for the implementation of these provisions.

Article 35 The provisions of this October 15, 2003 shall come into force.

The Provisions on Strict Restrictions on Dog-Raising in Beijing adopted at the 14th Meeting of the Standing Committee of the 10th Beijing Municipal People's Congress on November 30, 1994 shall be repealed at the same time.
