The domestic garbage referred to in these regulations refers to solid waste generated in daily life or activities providing services for daily life, as well as solid waste that is regarded as domestic garbage under laws and regulations.
The management of solid wastes such as hazardous wastes, medical wastes, waste electrical and electronic products, and construction wastes shall be governed by laws, regulations and rules where they already exist. Article 3 Domestic garbage is divided into the following four categories:
(1) Recyclables, meaning items suitable for recovery and recycling;
(2) Organic and perishable garbage, meaning food and drink garbage, household food waste, and discarded vegetables, fruits and vegetables, flowers and trees, and other organic and perishable substances;
(3) Hazardous garbage, meaning substances that pose a direct or potentially harmful substances;
(4) other garbage, refers to the domestic garbage other than the first three items. Article 4 The management of domestic garbage shall follow the principles of government-led, universal participation, urban and rural integration, and local responsibility, and implement a mandatory classification system of separate placement, separate collection, separate transportation, and separate disposal, and gradually realize the reduction, resourcefulness, and harmlessness of domestic garbage. Article 5 municipal, county (city, district) people's governments shall coordinate the management of urban and rural living garbage in the administrative region, the management of living garbage into the national economic and social development planning at this level, a clear goal of living garbage disposal, the implementation of living garbage sweeping, classification, placement, collection, transportation, disposal of security measures.
Township people's governments, street offices are responsible for the organization and implementation of the daily management of domestic garbage under their jurisdiction, to carry out publicity, education and training in the reduction and classification of domestic garbage, and to guide the village (neighborhood) committee to organize and do a good job of classifying domestic garbage for placement, collection and other work. Article 6 the municipal, county (city, district) people's government department in charge of environmental health is responsible for the supervision and guidance of the management of living garbage as well as the supervision and management of living garbage sweeping, classification, putting, collection, transportation and disposal.
Other relevant departments in accordance with the following responsibilities, in collaboration with the management of domestic waste:
(1) the competent department for development and reform is responsible for the construction of domestic waste disposal facilities into the national economy and social development planning, and to do a good job in the project approval of the project of the facilities for the classification of domestic garbage, drop-off, collection, transportation and disposal, etc.
(2) the competent department of urban and rural planning is responsible for incorporating the relevant contents of the special planning for the management of domestic garbage into the urban and rural planning of this administrative region, and doing a good job of reserving the planning of the relevant land, etc.
(3) The competent department of housing and urban-rural construction is responsible for the construction of equipment and facilities for the classification of domestic garbage for collection and disposal, etc., and guides the implementation of classification of domestic garbage by the property service enterprises and the construction engineering construction units;
(4) The competent department of land and resources is responsible for such work as securing land for the construction of domestic garbage classification and disposal facilities;
(v) The competent department of commerce is responsible for promoting the construction of recyclables recycling system, and formulating and publicizing the recycling norms and standards to the society;
(vi) The department of industrial and commercial administration is responsible for the provision of plastic shopping bags in supermarkets, shopping malls, markets and other retail places of commodities Supervision and management, etc.
(vii) the competent department of environmental protection is responsible for the centralized transfer of domestic waste, terminal treatment facilities, supervision and management of pollutant emissions, etc.
(viii) the public security organs of the traffic management department is responsible for auditing and determining the routes and times of the transport of domestic waste vehicles, as well as road safety, etc.;
(ix) the competent department of education is responsible for the (ix) the competent department of education is responsible for primary and secondary schools, kindergartens, the popularization of knowledge of domestic waste reduction and classification of publicity and other work;
(x) the competent department of finance is responsible for the development of financial policies to support the management of urban and rural household waste, and the implementation of financial security and other work;
(xi) transportation, water, agriculture, culture, radio and television news and other departments in accordance with the laws, rules and regulations, as well as the people's government at the level of the responsibilities identified and do the work related to the management of domestic garbage. Article 7 The duties related to environmental sanitation management and law enforcement, in accordance with the requirements of the functional transformation and institutional reform transferred to the urban management and comprehensive law enforcement departments, the original competent departments no longer exercise.
The administrative penalties provided for in these regulations and the administrative coercive measures related to administrative penalties shall be centrally exercised by the departments of urban management and comprehensive law enforcement in the areas where comprehensive law enforcement is implemented. Article 8 city, county (city, district) people's government shall establish and improve by the environmental sanitation, environmental protection, housing and urban-rural construction, commerce and other relevant departments to participate in the joint meeting system, to coordinate and solve the major problems in the management of domestic garbage in the administrative region. Article 9 The village (neighborhood) committee shall do a good job in the village (community) cleaning, classification, collection of domestic garbage organization, guidance and supervision, and to assist the people's government and the relevant departments to do a good job in the management of domestic garbage. Article 10 units and individuals shall consciously abide by the provisions of the reduction and classification of household garbage, and do a good job of cleaning, classification and placement of household garbage.
City, county (city, district) people's government shall formulate relevant incentives to guide the promotion of units and individuals actively participate in the classification of domestic waste reduction.
