A production safety accident refers to a sudden occurrence of a production and operation unit during its production and operation activities (including activities related to production and operation) that harms personal safety and health, or damages equipment and facilities, or causes economic losses. Unexpected events that cause the original production and business activities (including activities related to production and business activities) to be temporarily suspended or permanently terminated.
Refer to the relevant provisions of the "Regulations on Reporting, Investigation and Handling of Production Safety Accidents" and determine according to the following procedures:
1. Cause less than 3 deaths, or serious injuries to less than 10 people, or 10 million Accidents with direct economic losses of less than 1 yuan shall be initially identified by the county-level people's government and reported to the districted city people's government for confirmation.
21 Accidents that cause the death of more than 3 but not more than 10 people, or serious injuries of more than 10 but not more than 50 people, or direct economic losses of not less than 10 million yuan but not more than 50 million yuan, shall be initially determined by the people's government of the districted municipality. Identification shall be reported to the provincial people's government for confirmation.
3. Accidents that cause the death of more than 10 but not more than 30 people, or serious injuries of more than 50 but not more than 100 people, or direct economic losses of not less than 50 million yuan but not more than 100 million yuan, shall be initially determined by the provincial people's government. Report to the State Administration of Work Safety for confirmation.
4. Accidents that cause more than 30 deaths, or more than 100 serious injuries, or direct economic losses of more than 100 million yuan, shall be initially determined by the State Administration of Work Safety and reported to the State Council for confirmation.
5. Accidents that have been filed for investigation by the public security organs shall be reported as production safety accidents. If the case is determined to be a criminal case or a public security management case after the investigation is completed, it will be treated as a public security incident based on the case closure certificate issued by the public security organ.
To sum up, the identification of safety accidents refers to accidents caused by force majeure or unforeseen irregular operations. Force majeure includes natural disasters such as floods, mudslides, lightning strikes, earthquakes, avalanches, typhoons, tsunamis and tornadoes.
