The following circumstances do not apply to these measures:
(1) the production and operation of the production and management of goods held separately to promote the production and operation of the enterprise ordering, transfer, exhibition, etc.
(2) the State Council, the relevant competent departments, the people's government directly organized by the people's government at or above the county level;
(3) the competent departments of the relevant industries for the implementation of the national plan for the organization of the professional ordering fairs, etc. Article 3 The exhibition referred to in these measures, refers to one or several organizers to organize, by more than one or a large number of operators to participate in the designated place and a certain period of time to focus on trading business activities, including fairs, exhibitions, trade fairs, transfers, exchanges and other centralized trade activities. Article 4 the people's governments at or above the county level administrative organs for industry and commerce is the registration and management of trade fairs. Article 5 in accordance with the law to enjoy civil rights and civil obligations of enterprises, legal persons, public organizations and legal persons may apply for the exhibition.
Individually organized exhibitions, the organizer is the applicant; *** with the exhibition, the organizer should be clear by agreement with an organizer for the applicant. Article 6 The applicant shall have the following conditions:
(1) in line with the provisions of Article 5 of the Scheme;
(2) with the scale of the exhibition and trade fair held in the business premises and facilities;
(3) with the corresponding organization and service institutions, personnel and measures. Article 7 The enterprise legal person shall apply for organizing the fair, and the original enterprise business registration authority shall be responsible for the examination and registration; the enterprise legal person and the social organization legal person shall apply for organizing the fair, and the business administration authority at the same level of the registration authority shall be responsible for the examination and registration; the organ legal person shall apply for organizing the fair, and the business administration authority at the same level of the organ shall be responsible for the examination and registration.
Transcending city and county administrative areas to organize exhibitions, in accordance with the provisions of the preceding paragraph by the corresponding industry and commerce administrative organs to issue a certificate of off-site exhibitions, by the exhibition of the city and county administration for industry and commerce is responsible for the examination and registration.
Superior industrial and commercial administrative organs responsible for the examination and registration of the fair can be entrusted to the lower level of industrial and commercial administrative organs for examination and registration. Article VIII of foreign units to the province to organize exhibitions, shall be approved by the people's government of the province at or above the county level or industrial and commercial administrative organs, and to the exhibition of municipal and county industrial and commercial administrative organs to apply for registration. Article 9 The applicant for the exhibition shall, before the date of the exhibition, apply to the administrative organ for industry and commerce for registration and submit the following materials:
(1) the application signed by the legal representative of the applicant unit, the application shall set out the purpose of the exhibition, name, duration, location, content, form and person in charge;
(2) the organization and implementation of the exhibition;
(ii) identification of the person in charge of the fair;
(v) approval documents in line with the relevant provisions of these Measures.
The applicant is an enterprise legal person, shall submit a copy of the business license of the enterprise legal person; *** with the organization of the fair, shall be submitted to the organizing parties *** with the signing of the agreement. Article 10 to apply for international exhibitions or exhibitions bearing the words "China", "national" and other national exhibitions, subject to the approval of the relevant departments of the State Council and the provincial people's government. Apply for the title "Southwest", "Sichuan Province" and other words of the inter-provincial and provincial exhibitions, subject to the approval of the provincial people's government or the relevant provincial authorities. Article XI of the application for personal safety and other special commodities (such as drugs, medical equipment, health products, cosmetics, gold and silver jewelry, etc.) exhibition, subject to the approval of the competent authorities of the relevant industries. Article XII of the exhibition for award activities, shall be approved by the people's government or its authorized departments. Article XIII of the administrative organs for industry and commerce after receiving the application materials of the exhibition, to meet the prescribed conditions, shall be issued within seven days of the exhibition registration certificate; does not meet the prescribed conditions, not approved for registration, shall be notified in writing within seven days and set out the reasons. Article XIV Exhibition Registration Certificate shall contain the following matters:
(1) the name of the exhibition;
(2) the person in charge of the exhibition;
(3) the name of the applicant, the organizer;
(4) the location of the exhibition;
(5) the starting and ending time;
(6) the scope of business commodities. Article 15 The name of the exhibition, the person in charge of the exhibition, the name of the organizer, the location, the start and end time and the scope of business commodities change, the applicant shall apply to the administrative organ for industry and commerce to change.
Administration for industry and commerce shall, within seven days of the application for change to make a decision on the examination and approval of the change in the registration of the written notice. Article XVI of the exhibition organizers are responsible for the organization and management of the exhibition, and exhibitors to enter into a written agreement to clarify the rights and obligations of both parties, as well as fees, liability for breach of contract. Article XVII of the exhibition organizers should be the exhibitors of the main situation to the industrial and commercial administrative organs for the record.
Exhibitors should bring a copy of the business license to participate in the exhibition, the exhibits should be in line with the business license approved business scope. Article 18 The business activities of the exhibitors must comply with the provisions of relevant laws and regulations, and shall not engage in unfair competition and harm the legitimate rights and interests of consumers.
