Postal administration should make full use of computer networks, big data and other information technology to enhance the express delivery business license management service effectiveness. Article operating express business, shall obtain express business license, and accept the postal administration and other relevant departments of supervision and management; without permission, no unit or individual shall not operate express business. Chapter II Application and Acceptance Article 6 The application for express delivery business license shall comply with the "Chinese People's *** and the State Postal Law" Article 52 of the provisions. Article 7 The application for express delivery business license shall have the following service capabilities:
(1) with the application for the operation of the geographical scope, business scope of the service network and letters, parcels, printed matter, and other mailed articles (hereinafter collectively referred to as express) delivery capacity;
(2) able to provide business consulting for the delivery of express delivery, telephone inquiries, and Internet information query service;
(3) the ability to provide express business consulting, telephone inquiries, and Internet information query service. p>
(C) the collection and delivery of express mail, delivery of express mail, with the application of the geographical scope of operation, business scope of the site or facilities;
(D) through the Internet and other information networks to operate express business, with the application of the geographical scope of operation, business scope of the information processing capacity, able to save the express delivery service information for not less than three years;
(E) express mail to the Sorting, sealing, storage, exchange, transit and other processing, there is a closed, suitable area of the processing site, configure the appropriate equipment, and in line with the postal administration and national security organs to perform their duties in accordance with the requirements of the law.
In the provinces, autonomous regions and municipalities directly under the Central Government, specializing in express mail collection and delivery services, should have the first to the fourth of the preceding paragraph of the service capacity; should also be cooperating with the operation of express delivery business enterprises to sign a written agreement or letter of intent. Article 8 to apply for a license to operate express delivery services, should have the following service quality management system and business practices:
(a) the type of service, service time limits, service prices and other service commitments to publicize the management system;
(b) complaint acceptance, compensation and other management systems;
(c) business inquiries, collection and mailing, sorting, delivery and other operational specifications. Article IX application for express business license, according to the scope of business it applies for, shall have the following security systems and measures:
(a) the safety of employees, user information security and other security systems;
(b) emergency response plan;
(c) receipt and delivery inspection, real-name acceptance and mailing system;
(d) express mail safety inspection system;
(v) equipped with monitoring, security checks and other equipment and facilities in line with national regulations;
(vi) equipped with a unified computer management system, configured in line with the postal administration of the data interface, able to provide express delivery service-related data;
(vii) monitoring, recording computer management system operational status of technical measures;
(viii) Express service information data backup and encryption measures. Article 10 The application for international express delivery business, should also be able to provide the relevant departments to send express customs data, located in airports and import and export banks belonging to the Customs supervision of the processing site, facilities, equipment should be in line with the Customs requirements for the performance of their duties in accordance with the law. Article 11 to apply for a license to operate express delivery services, shall be submitted to the "Chinese People's *** and the State Postal Law" Article 53, paragraph 1 of the Postal Administration to submit the following materials:
(a) express delivery business license application;
(b) pre-approved business name or business license of the enterprise;
(c) meet the conditions set out in Article 7 to (C) meet the conditions set forth in Article 7 to Article 10 of the conditions of the situation;
(D) other materials provided by laws and administrative regulations.
Applications for licenses to operate express delivery services can be made through the information system of the postal administration. Article XII of the postal administration of the applicant's application for a license to operate express business, shall be processed in accordance with the provisions of Article 32 of the "Chinese People's *** and State Administrative Licensing Law". Chapter III Review and Decision Article 13 The postal administration shall accept the express delivery business license application within 45 working days from the date of review, to make a decision to approve or disapprove. To be approved, the issuance of "express business license" and announcement; not approved, written notice to the applicant and the reasons.
Postal administration to review the express delivery business license application, shall take into account factors such as national security, and seek the views of relevant departments. Article XIV of the State Council postal administration within the region, the customs declaration data and processing sites, facilities and equipment conditions stipulated in Article 10 of these Measures, the applicant in the application for a license to operate express delivery business is not actually available, but promised to be able to meet the agreed period of time, the acceptance of the application of the postal administration can be recognized that the applicant meets the relevant conditions. The agreed period shall not exceed six months from the date of the administrative licensing decision by the postal administration.
The postal administration shall check whether the licensee has fulfilled its commitment within the agreed period. Found that the licensee's actual situation is inconsistent with the content of the commitment, the postal administration shall revoke the express business license.
