The Regulations on Motor Vehicle Registration stipulates that:
Article 18 Where the ownership of a registered motor vehicle is transferred, the owner of the motor vehicle shall apply to the motor vehicle management office for transfer registration within 30 days from the date of delivery of the motor vehicle.
Before applying for transfer registration, the owner of a motor vehicle shall deal with the illegal acts of road traffic safety and traffic accidents involving the vehicle.
Nineteenth to apply for transfer registration, the current motor vehicle owner shall fill in the application form, submit the motor vehicle for inspection, and submit the following documents and vouchers:
(a) the identity certificate of the current motor vehicle owner;
(2) Certificates and vouchers of the transfer of ownership of motor vehicles;
(3) Motor vehicle registration certificate;
(4) Motor vehicle driving license;
(five) the customs supervision of motor vehicles shall also submit the "Certificate of Deregulation of Vehicles under Customs Supervision in People's Republic of China (PRC)" or the transfer certificate approved by the customs;
(six) motor vehicles that have exceeded the validity period of the inspection shall also submit the certificate of motor vehicle safety and technical inspection and the compulsory insurance certificate for traffic accident liability.
If the current motor vehicle owner lives in the jurisdiction of the vehicle management office, the vehicle management office shall, within one day from the date of accepting the application, confirm the motor vehicle, check the rubbing film of the vehicle identification code, review the submitted documents and vouchers, recover the license plate and driving license, determine the new motor vehicle license plate number, endorse the transfer matters on the motor vehicle registration certificate, and reissue the license plate, driving license and inspection mark.
If the domicile of the motor vehicle owner is not within the jurisdiction of the vehicle management office, it shall be handled by the vehicle management office in accordance with the provisions of Article 13 of these Provisions.
Twentieth in any of the following circumstances, the transfer registration shall not be handled:
(1) The contents recorded in the archives of motor vehicles and vehicles are inconsistent;
(2) Motor vehicles subject to customs supervision have not been deregulated or approved for transfer by the customs;
(3) The motor vehicle is in the period of mortgage registration and pledge filing;
(four) the circumstances specified in items (1), (2), (7), (8) and (9) of Article 9 of these Provisions.
Article 21 If the original motor vehicle owner fails to provide the current motor vehicle owner with the motor vehicle registration certificate, license plate or driving license when it is confiscated or auctioned by the people's court, the people's procuratorate or the administrative law enforcement department according to law, or arbitrated by an arbitration institution according to law, or the people's court mediates, judges or adjudicates the transfer of motor vehicle ownership, the notice of assistance in execution issued by the people's court shall be submitted, and if the motor vehicle registration certificate, license plate or driving license is not obtained, it shall be submitted to the people's procuratorate. The vehicle management office shall announce that the original motor vehicle registration certificate, license plate or driving license is invalid, and reissue the motor vehicle registration certificate while handling the transfer registration.
mortgage registration
Twenty-second motor vehicle owners who use motor vehicles as collateral shall apply for mortgage registration at the vehicle management office where they are registered; If the mortgage right is extinguished, it shall apply to the vehicle management office at the place of registration for cancellation of mortgage registration.
Article 23 To apply for mortgage registration, the motor vehicle owner shall fill in the application form, which shall be jointly applied by the motor vehicle owner and the mortgagee, and submit the following documents and vouchers:
(a) the identity certificate of the motor vehicle owner and the mortgagee;
(2) Motor vehicle registration certificate;
(three) the main contract and mortgage contract concluded by the motor vehicle owner and the mortgagee according to law.
The vehicle management office shall, within one day from the date of acceptance, review the submitted documents and vouchers, and annotate the contents and date of mortgage registration on the motor vehicle registration certificate.
Article 24 Apply for cancellation of mortgage registration
(a) the identity certificate of the motor vehicle owner and the mortgagee;
(2) Motor vehicle registration certificate.
If the people's court mediates, makes a judgment or orders to cancel the mortgage, the owner or mortgagee of the motor vehicle shall fill in the application form and submit the motor vehicle registration certificate, the effective mediation, ruling or judgment issued by the people's court, and the corresponding notice of assistance in execution.
The vehicle management office shall, within one day from the date of acceptance, review the submitted documents and vouchers, and annotate the contents and date of cancellation of mortgage registration on the motor vehicle registration certificate.
Twenty-fifth motor vehicle mortgage registration date, mortgage registration cancellation date can be available for public inquiry.
Article 26 In case of any of the circumstances specified in Item (1), (7), (8) and (9) of Article 9 or Item (2) of Article 20, mortgage registration shall not be handled. Do not apply for mortgage cancellation registration.
Cancel registration
Twenty-seventh motor vehicle owners who meet the national compulsory scrapping standards shall fill in the application form when selling motor vehicles to motor vehicle recycling enterprises. Scrapped school buses, buses, trucks and other operating vehicles shall be disintegrated under the supervision of the vehicle management office.
A motor vehicle recycling enterprise shall submit an application form, a motor vehicle registration certificate, a license plate, a driving license and a copy of the scrap motor vehicle recycling certificate to the vehicle management office within seven days after the disintegration of the motor vehicle, and handle the cancellation of registration.
Twenty-eighth in addition to the circumstances stipulated in Article 27 of these regulations, if a motor vehicle has one of the following circumstances, the owner of the motor vehicle shall apply to the vehicle management office for cancellation of registration:
(1) The motor vehicle is lost;
(two) the motor vehicle is not used in China for some reason;
(3) Due to quality problems.
In any of the following circumstances, the registered motor vehicle shall be deregistered at the vehicle management office:
(a) the motor vehicle registration is revoked according to law;
(two) motor vehicles that meet the national compulsory scrapping standards shall be confiscated and compulsory scrapping according to law.
In case of any of the circumstances specified in Items (2) and (3) of the first paragraph of this article, the owner of a motor vehicle shall deal with the road traffic safety violations and traffic accidents involving the vehicle before applying for cancellation of registration.
Twenty-ninth motor vehicle owners who apply for cancellation of registration under the circumstances specified in the first paragraph of Article 28 of these Provisions shall fill in the application form and submit the following documents and vouchers:
(1) Motor vehicle registration certificate;
(2) Motor vehicle driving license;
(three) if the vehicle is lost, it shall also submit the identity certificate of the owner of the vehicle and the certificate of the loss of the vehicle;
(four) if the motor vehicle is not used in China for some reason, it shall also submit the identity certificate and exit certificate of the owner of the motor vehicle. Motor vehicles under customs supervision shall also submit the Notice of Entry (Exit) License of Vehicles under Customs Supervision of People's Republic of China (PRC) and the State.
(5) If the car is returned due to quality problems, the identity certificate of the owner of the motor vehicle and the certificate of returning the car issued by the motor vehicle manufacturer or dealer shall also be submitted.
The vehicle management office shall, within one day from the date of acceptance, review the submitted documents and vouchers, recover the motor vehicle registration certificate, license plate and driving license, and issue a cancellation certificate.
Article 30 If a motor vehicle cannot drive back to its registered place due to damage, the owner of the motor vehicle may sell the scrapped motor vehicle to the motor vehicle recycling enterprise where the vehicle is located. Sales of motor vehicles, should fill in the application form, submit the motor vehicle registration certificate, license plate and driving license. Motor vehicle recycling enterprises shall confirm and disassemble motor vehicles, and issue a certificate of recycling scrapped motor vehicles to the owners of motor vehicles. Scrapped school buses, buses, trucks and other operating vehicles shall be disintegrated under the supervision of the vehicle management office.
A motor vehicle recycling enterprise shall, within seven days after the disintegration of a motor vehicle, submit an application form for recycling scrapped motor vehicles, a motor vehicle registration certificate, a license plate, a driving license and a copy of the certificate of recycling scrapped motor vehicles to the vehicle management office for cancellation of registration.
The vehicle management office of the scrapped place shall, within one day from the date of acceptance, review the submitted documents and vouchers, recover the motor vehicle registration certificate, license plate and driving license, and transmit the motor vehicle scrapping information to the vehicle management office of the registered place through the computer registration system.
The vehicle management office at the place of registration shall handle the cancellation of registration within one day from the date of receiving the scrapping information of motor vehicles and issue a cancellation certificate.
Article 31 If a registered motor vehicle is under any of the following circumstances, the vehicle management office shall announce the invalidation of the motor vehicle registration certificate, number plate and driving license:
(1) Having reached the national compulsory scrapping standard, and the owner of the motor vehicle fails to cancel the registration within the time limit;
(two) after the motor vehicle registration is revoked according to law, the motor vehicle registration certificate, license plate and driving license are not obtained;
(three) motor vehicles that meet the national compulsory scrapping standards are confiscated and compulsory scrapping according to law;
(four) the motor vehicle owner fails to return the motor vehicle registration certificate, license plate and driving license when canceling the registration.
Article 32 In case of any of the circumstances specified in Item (1), (8) and (9) of Article 9 or Item (1) and (3) of Article 20, cancellation of registration shall not be handled.
