Regulations of Hebei Province on Developing Circular Economy (202 1 Revision)

Chapter I General Provisions Article 1 In order to develop circular economy, save resources and protect the environment, promote the construction of ecological civilization and realize the sustainable development of economy and society, these Regulations are formulated in accordance with the Law of the People's Republic of China on the Promotion of Circular Economy and other laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to activities related to the development of circular economy and its management and services in the process of production, circulation, consumption and waste disposal within the administrative region of this province. Article 3 Circular economy as mentioned in these Regulations refers to the activities of reduction, reuse and recycling in the process of production, circulation and consumption.

The term "reduction" as mentioned in these Regulations refers to the reduction of resource consumption and waste generation in the process of production, circulation and consumption.

The term "reuse" as mentioned in these Regulations refers to the direct use of waste as a product or its continued use as a product after repair, renovation and remanufacturing, or the use of all or part of waste as a component of other products.

The term "recycling" as mentioned in these Regulations refers to the direct use of waste as raw materials or the recycling of waste. Article 4 The concept of innovation, coordination, green, openness and enjoyment shall be implemented in the development of circular economy, and the principles of government promotion, market guidance, enterprise implementation and public participation shall be followed. Article 5 People's governments at or above the county level shall strengthen their leadership over the development of circular economy, incorporate the development of circular economy into national economic and social development plans and annual plans, formulate and implement policies and measures for the development of circular economy, establish a joint meeting system, and coordinate and solve major problems in the development of circular economy. Article 6 The development and reform department of the people's government at or above the county level is the comprehensive management department for the development of circular economy, and is responsible for organizing, coordinating, supervising and managing the development of circular economy within its administrative area. The development and reform department may entrust its subordinate units to be responsible for the daily supervision and management of developing circular economy according to law.

Relevant departments such as ecological environment, industry and informatization, natural resources, finance, agriculture and rural areas, commerce, housing and urban and rural construction, market supervision and management, science and technology, water administration, etc. shall be responsible for the supervision and management of developing circular economy according to their respective responsibilities. Article 7 People's governments at or above the county level and their relevant departments shall encourage and guide relevant enterprises to strengthen independent research and development of science and technology, carry out various forms of Industry-University-Research cooperation with universities and scientific research institutions, develop and apply advanced technologies such as reduction, recycling and recycling, and improve the technical support and innovation ability of circular economy. Article 8 People's governments at all levels and their relevant departments shall organize publicity and education on circular economy, advocate the concept of green, low-carbon and circular development, and encourage and guide social forces to participate in the development of circular economy.

Preschool education, primary and secondary schools, institutions of higher learning, all kinds of vocational schools and vocational training institutions should educate students and trainees about the concept and knowledge of circular economy.

Newspapers, radio, television, internet and other news media should intensify public welfare propaganda, popularize the laws, regulations and scientific and technological knowledge of developing circular economy to the public, and create a good social environment for developing circular economy. Article 9 State organs, enterprises, institutions and other organizations shall, in accordance with the relevant provisions of the state and this province on developing circular economy, establish and improve management systems, take measures to reduce resource consumption, reduce waste generation and discharge, and improve the level of resource recycling.

Citizens should consciously fulfill their obligations of saving resources and protecting the environment, rationally consume, and reduce resource consumption and waste generation. Article 10 Any unit or individual has the right to report acts of wasting resources and damaging the environment to the relevant departments of people's governments at all levels. The department that receives the report shall promptly investigate and deal with it, and keep the informer confidential. Chapter II Planning and Management Article 11 The development and reform departments of the people's governments of provinces and cities divided into districts shall, jointly with relevant departments, organize the preparation of circular economy development plans for their respective administrative regions, which shall be implemented after being approved by the people's governments at the corresponding levels. The circular economy development plan of a city divided into districts shall be reported to the development and reform department of the people's government at the next higher level for the record.

The development plan of circular economy should make clear the planning objectives, scope of application, main contents, key tasks and safeguard measures, and stipulate indicators such as resource output rate, waste reuse and resource utilization rate. Article 12 The development and reform department of the people's government at the county level shall, according to the development plan of circular economy in the city divided into districts, formulate the implementation plan of circular economy in this administrative region, report it to the people's government at the same level for approval before implementation, and report it to the development and reform department of the municipal people's government divided into districts for the record.

The relevant departments in charge of industry and information technology, agriculture and rural areas, commerce, housing and urban and rural construction of the provincial people's government shall, according to the development plan of circular economy in this province, formulate the implementation plan of circular economy in this industry and organize its implementation.

All kinds of industrial parks shall formulate the park implementation plan according to the local circular economy development plan, and report it to the development and reform department of the local people's government and the competent department of the park for the record. Article 13 People's governments at or above the county level and their relevant departments shall establish and improve the resource recovery management system for fixed assets investment projects, take resource recovery measures such as improving resource output rate and comprehensive utilization rate of wastes as important contents of application reports and feasibility study reports for fixed assets investment projects of enterprises and institutions, and supervise and inspect the resource recovery during the project implementation.
