Interim Measures of Chengdu Municipality on the Administration of Rural Drug Supervision and Supply Network

Article 1 (Purpose)

In order to strengthen the construction of rural drug supervision network, guide and standardize the development of rural drug supply network, and ensure the safety, effectiveness, economy and convenience of farmers' drug use, these measures are formulated in accordance with relevant laws and regulations and combined with the actual situation in Chengdu. Article 2 (Scope of Application)

These Measures shall apply to the construction of rural drug supervision network and supply network (hereinafter referred to as "two networks") within the administrative area of this Municipality. Article 3 (Management System)

The Municipal People's Government leads the construction of the "two networks" in the city, and its subordinate institutions are responsible for the daily specific work. District (city) county people's government leads the construction of "two networks" within its administrative area, and its subordinate institutions are responsible for daily specific work. Article 4 (Bidding and Distribution Scope)

Medical institutions in rural townships (towns) and villages within the administrative area of this Municipality (hereinafter referred to as "rural medical institutions") are centralized in the distribution of drugs by pharmaceutical trading enterprises determined by public bidding. Chemicals, Chinese patent medicines, Chinese herbal pieces and disposable sterile medical devices used in rural medical institutions should be included in the centralized distribution scope. The supply of preventive biological products, blood products and specially managed drugs shall be implemented in accordance with the provisions of laws, regulations and rules. Article 5 (Distribution Catalogue)

The municipal public health administrative department shall, jointly with the municipal drug supervision and administration department, formulate the Catalogue of Centralized Distribution of Drugs in Rural Medical Institutions in Chengdu (hereinafter referred to as the Catalogue), and make provisions on the procurement, use and distribution services of drugs listed in the Catalogue. Article 6 (Tendering Agency)

District (city) county people's government shall establish a bidding mechanism for centralized drug distribution in rural areas, and be entrusted by rural medical institutions to determine a drug trading enterprise through public bidding to undertake centralized drug distribution in rural medical institutions within the administrative area of this district (city) county.

Members of the tendering agency shall include NPC deputies, CPPCC members, representatives of relevant government departments, rural medical institutions and relevant experts. Article 7 (Production and Release of Bidding Documents)

The district (city) county people's government shall, in accordance with the provisions of the relevant laws, regulations and rules on bidding, formulate detailed rules for the implementation of bidding for rural drug centralized distribution enterprises, and report them to the municipal "two networks" construction organization for examination and approval, and the district (city) county people's government shall publish them.

The tender announcement of centralized drug distribution enterprises (hereinafter referred to as "distribution enterprises") shall be announced to the public through newspapers, radio stations, television stations, public information networks or other media, and the tender announcement shall specify the scope of implementation, time limit, tendering agency and the way to obtain the tender documents. The tender documents shall include all substantive requirements and conditions such as technical requirements of the project subject to tender, bidder qualification standards, drug quality and distribution service requirements, bid evaluation standards, time limit for submission of tender documents, main clauses of the distribution contract to be signed, etc.

District (city) and county bidding agencies may, according to the requirements of centralized drug distribution in local rural areas, require potential bidders to provide relevant qualification documents and performance, and conduct qualification examination on potential bidders. Article 8 (Bidding Results)

The result of winning the bid shall be announced. Within 7 working days after the end of the bidding work, the district (city) county people's government shall report the bidding enterprises and the winning enterprises to the municipal "two networks" construction institutions for the record. Within 30 working days after the announcement of the bidding results, rural medical institutions and the winning distribution enterprises shall sign a centralized distribution contract for rural drugs. Article 9 (Conditions for Distribution Enterprises)

A pharmaceutical trading enterprise undertaking centralized distribution of drugs in rural areas shall meet the following conditions:

(a) through the "drug quality management standards" certification;

(2) Having a good credit record;

(3) According to the catalogue and relevant regulations, the variety and scale of drugs can meet the drug demand of rural medical institutions;

(four) have the ability to provide quality and cheap drugs, disposable sterile medical devices and distribution services to all rural medical institutions within the administrative area of the bidding area (city) county;

(5) Other conditions that should be met for undertaking centralized drug distribution in rural areas. Article 10 (Mode of Distribution)

The centralized distribution of drugs and disposable sterile medical devices can be directly prepared or purchased, and direct preparation is preferred.

Township (town) hospitals for village clinics (stations) to purchase drugs and disposable sterile medical devices, shall hold a power of attorney issued by the village clinics (stations), with reference to the provisions of Article 13 of these measures to fulfill the procurement obligations, and shall not charge fees or increase prices to the village clinics (stations) for any reason; Drug purchasing qualification shall not be subcontracted to individuals or other units. Article 1 1 (lead time)

The distribution cycle of the winning distribution enterprise is 4 years, and the tender will be re-invited 60 days before the expiration.

When bidding again, the original distribution enterprise should be given priority under the same conditions. Article 12 (Voluntary Withdrawal of Distribution Enterprises)

During the validity period of the distribution contract, if the distribution enterprise needs to withdraw from distribution for its own reasons, it shall notify the district (city) county people's government in writing. The district (city) county people's government shall, within 60 days from the date of receiving the written notice, reorganize the bidding to determine the distribution enterprise. Before the termination of the original contract, the original distribution enterprise shall still perform its distribution obligations according to the contract.

Under the supervision of the district (city) county people's government, the distribution enterprises determined by re-tendering shall properly handle the relevant handover matters with the original distribution enterprises and township medical institutions according to law. Article 13 (Requirements for Distribution Services)

The distribution service of a distribution enterprise shall meet the following requirements:

(a) the quality of the drugs sold shall meet the standards stipulated in the Pharmacopoeia of People's Republic of China (PRC) or National Medical Products Administration; The quality of disposable sterile medical devices shall meet the standards set by the state.

(two) for the commonly used drugs listed in the catalogue, the distribution enterprise shall deliver the drugs to the designated place with good quality and quantity within 72 hours after receiving the drug procurement plan; In case of major epidemic, public health emergency or clinical emergency, it shall be delivered in time without delay. For the special drug varieties listed in the catalogue, the distribution enterprise may appropriately extend the delivery time.

(3) For the drugs produced by the specific production enterprises designated by rural medical institutions, when it is difficult for the distribution enterprises to supply them in time, they can choose similar drugs from other pharmaceutical production enterprises to replace them under the principle of high quality and low price.

(four) for drugs not listed in the catalogue, rural medical institutions are in urgent need for the time being and the distribution enterprises have no substitute varieties, and the distribution enterprises organize drugs to meet the clinical needs; If the required drugs are not organized, rural medical institutions can purchase them from other legal channels after consultation with distribution enterprises.

(5) Providing product price information and accompanying services as agreed in the contract.
