Violation of the provisions of this regulation, the construction unit of a residential property has not selected and hired a property service enterprise through bidding or, without approval, has adopted an agreement to select and hire a property service enterprise without authorization, the competent department of real estate administration of the people's government of the local government at or above the county level shall order rectification within a certain period of time, give a warning, and may be fined not more than 100,000 yuan fine.

In violation of the provisions of these Regulations, if a person engages in property management without obtaining a qualification certificate, the competent department of real estate administration of the local people's government at or above the county level shall confiscate the illegal income and impose a fine of not less than 50,000 yuan and not more than 200,000 yuan; and if a person causes losses to the owner, he shall be liable for compensation in accordance with the law. If a person obtains a qualification certificate by deception, he shall be punished in accordance with the first paragraph of this Article, and the qualification certificate shall be revoked by the department that issued the qualification certificate.
