(1) the setting up of first-class hospitals as well as health stations in rural management areas shall be approved by the health administrative departments of the counties in which they are located;
(2) the setting up of second-class hospitals and the medical institutions of units or individuals with fewer than 100 beds shall be applied for by the health administrative departments of the counties in which they are located, and shall be reported to the health administrative departments of the municipalities (excluding the county-level municipalities) for approval;
(3) the setting up of third-class hospitals and the medical institutions of units or individuals with more than 100 beds above the unit or individual medical institutions, as well as provincial units set up medical institutions, military units set up outside the establishment of medical institutions, to the county where the health administrative department to apply for approval of the provincial health administrative department (of traditional Chinese medicine, traditional Chinese and Western medicine and ethnic medical institutions, by the Provincial Administration of Traditional Chinese Medicine is responsible for the approval and supervision and management). The people's government at all levels of planning to set up medical institutions, the administrative department of health will be the same level of planning and finance departments before approval. Article 11 No application shall be made for the establishment of a medical institution under any of the following circumstances:
(1) a unit which cannot independently assume civil responsibility and an individual who does not have the full capacity for civil behavior;
(2) medical personnel who are in service, retired from service due to illness, or retained in their posts without pay;
(3) a medical staff member who has been involved in a medical accident of grade two or above for less than five years;
(4) a medical staff member who is Medical personnel who are over 65 years of age for men and over 60 years of age for women;
(v) Medical personnel who have had their Physician's License revoked;
(vi) Legal representatives or persons in charge of medical institutions who have had their License to Practice in Medical Institutions revoked;
(vii) Medical personnel who have been dismissed from their official positions or left their jobs without authorization for less than five years;
(viii) Medical personnel who have left their jobs without the consent of their original institutions for less than five years;
(ix) Medical personnel who have been dismissed from their official positions for less than five years; and (H) retired physicians without the consent of the original unit. Article XII of the application for the establishment of outpatient clinics, clinics, health clinics (rooms) of individuals, must be qualified by the technical examination of physician practice, after obtaining the "Physician's License", in the first class hospitals engaged in the same specialty for more than five years of continuous clinical work, with a local household registration. Article 13 Individuals applying for setting up a health station in a rural management area must have obtained the Certificate of Practice for Rural Doctors and have a local hukou. Article 14 An application for setting up a medical institution, a feasibility study report on the setting up and a report on site selection shall be submitted. The feasibility study report includes the following contents:
(1) the name and basic situation of the applicant unit or individual;
(2) an overview of the population, economic and social development of the region where it is located;
(3) the health status of the population in the region and the prevalence of diseases and the prevalence of the diseases concerned;
(4) the distribution and utilization of medical resources in the region as well as an analysis of the demand for medical services;
(5) a report of the feasibility of setting up a medical institution. analysis of the demand for medical services;
(v) the name, location, functions, tasks, service radius, area and floor space of the proposed medical institution, mode of service, service hours, diagnostic and treatment subjects, departmental settings, bed establishment, organizational structure, staffing, instrumentation, and equipment;
(vi) sewage, dirt and fecal matter treatment plan of the proposed medical institution, communication, power supply, Sewerage, sanitary facilities, fire fighting facilities set up program, the source of funds, investment methods, total investment, registered capital, investment budget and cost-benefit analysis within five years;
(vii) the proposed medical institution in the service radius of the relationship with other health care institutions and the mutual influence of the situation;
(viii) the applicant's credibility certificate.
The site selection report includes the following:
(i) the basis for the site selection;
(ii) the environment and utilities of the site location;
(iii) the relationship between the site and the layout of the surrounding child care institutions, primary and secondary schools, food production and operation units, etc.
(iv) the area of land occupied and the floor area;
(v) the site selection Azimuth map and architectural design plan.
