Interim provisions on the operation and management of civil airports are as follows: Chapter I General Provisions
Article 1 In order to ensure the normal operation and flight safety of civil airports, promote the construction and development of airports, clarify the responsibilities, rights and obligations of airport management agencies, and safeguard their legitimate rights and interests, these Interim Measures are formulated in accordance with the Interim Provisions on the Administration of Civil Airports issued by the State Council and other relevant decisions.
Relevant regulations: Article (1) of the administrative regulations of the State Council.
Article 2 These Interim Measures shall apply to the civil part of civil airports and military-civilian airports (hereinafter referred to as civil airports).
Article 3 The General Administration of Civil Aviation of China (hereinafter referred to as CAAC) is the competent government department in charge of civil aviation affairs in the State Council, and implements the industry management of civil airports throughout the country. Its main contents are as follows:
(1) Formulating and promulgating various rules, decisions, standards and norms for airport construction, management and operation, and supervising and inspecting airport operation and service quality according to law.
(two) to formulate the national airport layout plan, and to prepare the national long-term airport construction plan.
(three) to examine and approve the naming and renaming of the names of civil airports and the names of management institutions.
(four) to participate in the site selection of the new airport and put forward opinions on the site selection.
(5) Examining and approving the master plan of the civil airport, as well as the layout of the flight area, the technological process of the terminal building and the security facilities.
(six) to conduct a preliminary examination of the project proposal for the construction and expansion of the airport, and report it to the relevant state departments for examination and approval according to the prescribed procedures.
(seven) to participate in the airport completion acceptance.
(eight) to examine and approve the airport security plan.
(nine) the approval, issuance, suspension and revocation of the airport use license, the airport business license and the production license for airport special equipment and special vehicles.
(ten) in conjunction with the national price management department to develop airport charges.
(eleven) to examine and approve the application of civil air transport enterprises for wet lease of foreign civil aircraft for commercial flights and the use of civil airports.
(twelve) to examine and approve the application of foreign civil aircraft operators to use our airports.
(thirteen) unified release and provision of airport technical information.
(fourteen) arrange special and emergency air support tasks such as special plane, emergency rescue and disaster relief, and issue instructions to ensure flight safety, search and rescue, anti-hijacking, etc.
(fifteen) to accept the work reports, statistical data and statements of the airport management agencies.
(sixteen) to provide consulting and information services.
(seventeen) to supervise and inspect the implementation of the airport rules and regulations, and to reward and punish the airport management agencies in accordance with the provisions.
(eighteen) according to the situation, send representatives to the airport management agencies to perform the duties of supervision, inspection and coordination of industry management.
(nineteen) China Regional Civil Aviation Administration (hereinafter referred to as the Regional Civil Aviation Administration) shall exercise the functions of supervision and management of civil airports within its jurisdiction in accordance with the relevant provisions and the authorization of the General Administration of Civil Aviation.
(twenty) the relevant staff of the Civil Aviation Administration of China and its regional administrations can carry out inspection tasks at the airport with special certificates.
Chapter II Management Functions of Airport Management Agencies
Article 4 According to the rules and decisions of the General Administration of Civil Aviation of China, local regulations and decisions of local people's governments, specific provisions on the management of this airport are formulated. When necessary, it can also be reported to CAAC, local government or local legislature for approval and promulgation, and supervise the implementation. The specific provisions of the airport shall not contravene the laws and regulations of the state and the rules and decisions of the Civil Aviation Administration of China. Any unit and anyone at the airport must abide by these specific regulations. In violation of these regulations, the airport management agency may be punished according to the authorization.
Article 5 The airport master plan shall be compiled and implemented by the Regional Administration of Civil Aviation and the General Administration of Civil Aviation after examination and approval. All units stationed at the airport must meet the overall planning and safety requirements of the airport, obtain the consent of the airport management agency according to the regulations, and organize the construction according to the relevant regulations of the airport. Airport management agencies have the right to conduct supervision and inspection.
Sixth according to the relevant provisions of the state and the approved airport master plan, coordinate the land management in the airport. All units stationed at the airport shall carry out construction within the airport, and the required land shall be used with compensation according to regulations (except for the transfer of land use rights and special provisions).
Article 7 In order to ensure the normal operation of the airport, the airport management agency or through the Airport Management Committee shall be responsible for coordinating the relationship between the various units stationed at the airport.
Article 8 Manage all commercial activities in airports and terminal buildings. These activities should be approved by the airport management agency. Without the approval of the airport management agency, no unit or individual may conduct any form of commercial activities anywhere in the airport.
Article 9 Maintain airport public order and manage airport control areas. Issue passes to vehicles and personnel entering the airport control area.
Article 10 In addition to the provisions of the air traffic control department, the operation of aircraft involved in airport security order shall be responsible for the management of aircraft engine start-up, aircraft operation and parking.
Article 11 According to the civil aviation agreements signed between the government of China and foreign governments, airport management agencies may sign ground service agency agreements with designated foreign airlines. Without approval, local people's governments and airport management agencies shall not allow foreign airlines to use the airport.
Chapter III Main Tasks and Duties of Airport Management Agencies
Article 12 The main tasks of airport management agencies are to build and manage airports, ensure the safe and normal operation of airports, and provide services for the flight activities of air transport enterprises, general aviation enterprises and other departments; Provide services for passengers; Provide work and living services for all units stationed in the airport.
Airport management agencies must ensure the normal use of various facilities and equipment according to the conditions of the airport.
Airport management agencies must ensure the safe, normal and efficient operation of aircraft in the airport activity area. According to the situation of airlines using the airport and the growth of passenger and cargo throughput, we will continue to expand the airport, purchase and update various facilities and equipment, improve the airport security service function, and meet the needs of airlines' use and development and the growing needs of passengers.
Article 13 Specific responsibilities of airport management agencies
(1) The airport management agency shall open the airport for use within the scope specified in the airport use permit issued by the Civil Aviation Administration of China or the approval document for the open use of civil aircraft. Airports must ensure all routes approved by CAAC and announced flight times, including alternate airports approved by CAAC.
(2) Regularly inspect and maintain the facilities in the flight area (including runway, runway end safety zone, taxiway, apron, passenger apron, navigation lights and other visual AIDS and fence facilities), and promptly remove rubber attachments, accumulated water, ice and snow on the runway; Eliminate hidden dangers that hinder safety; Protect airport clearance and all kinds of signs and markers in good condition and clearly visible; Ensure that the flight area is in good and normal condition.
(3) To be responsible for the safety inspection of luggage, articles and mails carried by passengers and aircraft on board and the monitoring of aircraft to prevent articles endangering air defense safety from entering the aircraft.
(4) manage the apron. Responsible for the allocation and parking of aircraft seats, as well as the management of vehicles, equipment and personnel entering the passenger apron, maintaining order and safety and preventing the passenger apron from being blocked.
(five) the management of passenger stations, to provide passengers with safe, comfortable and convenient waiting environment and conditions.
Manage and maintain various facilities and equipment in the terminal building, including lighting, dynamic display, TV monitoring, broadcasting, air conditioning, cold and warm air, water supply system; Electronic clock and its control, automatic doors, luggage conveyor belts, walkways, fire prevention devices, emergency exits and other facilities and equipment.
Formulate the general layout of the terminal building; Determine the process route and the location of various facilities and equipment for passengers to go through various check-in procedures; Manage various signs.
Provide passengers with drinking water, public telephones, trolleys, medical assistance, airport lost and found claims, small luggage storage, inquiries and other services.
(six) to manage the operation of motor vehicles in the airport, stipulate the driving route, speed and parking position, and formulate signs. Manage public parking lots.
(seven) responsible for environmental protection (including noise, bird damage, sewage, etc.). ), cleaning and sanitation of public areas, garbage disposal and environmental beautification.
(8) Maintaining public order and ensuring airport safety.
(9) Fire fighting and rescue in airports and designated places; According to the provisions of the Civil Aviation Administration of China, formulate and organize the implementation of emergency rescue plans, and organize regular drills as required. Representatives of relevant local government departments, CAAC and regional administrations shall be invited to observe and give their opinions during regular drills.
(ten) to provide effective information on the operation of the airport, and submit statistical data and statements in accordance with the provisions.
(eleven) unified management and construction of water supply, power supply, gas supply, roads and other airport non-profit public infrastructure, through the recovery of investment fees, to maintain normal operation.
(twelve) to provide reasonable paid living services for employees of foreign units.
When performing the above duties, the airport management agency may bid for some projects and contract them to a certain unit for operation. However, in any case, the airport management agency should be responsible for management.
Airlines can lease airport venues, and undertake the broadcasting, inquiry, dynamic display and the command of aircraft arriving at the parking space of their own companies and other airlines. Airlines should have a clear agreement with the airport when undertaking these tasks.
Chapter IV Business Activities of Airport Management Agencies
Article 14 An airport shall provide catering, accommodation, shopping, post and telecommunications, banking, parking and other service places for passengers. In order to introduce competition mechanism, these services are leased and contracted to qualified enterprises through bidding. Airport management agencies are responsible for providing venues or facilities and putting forward service standards and requirements. Those who violate the agreement can terminate the agreement and order them to stop operating and exit the airport. Airport management agencies should set up business entities to conduct independent accounting and compete with other enterprises on an equal footing when they directly operate these businesses.
Fifteenth airport management agencies can rent warehouses, check-in counters, various passenger lounges, office buildings and related facilities and equipment to airlines and relevant units free of charge according to regulations.
Article 16 Upon approval, the airport management agency may transport and sell on behalf of airlines.
Seventeenth airport management agencies can be entrusted by airlines to provide air transport ground services.
Eighteenth airport management agencies shall not set up or cooperate in air transport and general aviation enterprises.
Nineteenth in accordance with the provisions of the State Council and the Civil Aviation Administration of China, other tertiary industries related to air transport can be established, and efforts can be made to generate income and increase financial resources.
Article 20 All paid services provided by airport management agencies, except those specially approved by the Civil Aviation Administration, shall be implemented in accordance with the charging standards for civil airports formulated by the Civil Aviation Administration, the Ministry of Finance and the Price Bureau and other charging items and standards formulated by the Civil Aviation Administration.
Twenty-first airport management agencies must carry out business activities in accordance with the business scope stipulated in the airport business license issued by the General Administration of Civil Aviation or the Regional Administration of Civil Aviation.
Chapter V Relationship between Airport Management Organization and Foreign Work
Twenty-second airport management agencies and air traffic control departments have a close working relationship and must cooperate with each other.
Airport management agencies shall, according to the overall planning of the airport, cooperate with the implementation of air traffic control, meteorology, communication, navigation and other projects, and give priority to ensuring the land use of the above projects within the airport.
The airport management agency shall dynamically organize and implement flight support work according to the flight plan issued by the air traffic control department, and the fire, ambulance, vehicle and other departments shall carry out emergency rescue work according to the instructions of the air traffic control department.
Airport management agencies must provide all kinds of relevant information and intelligence of the airport to the air traffic control department in a timely manner according to the regulations, and the air traffic control department will issue a navigation notice.
Article 23 The relationship between airport management agencies and airlines is a cooperative relationship between enterprises, and also a relationship between agents and carriers in air transport sales and ground service agency business.
(1) If a newly established airline needs to be stationed at the airport, it shall obtain the consent of the airport management agency and report it to the airport management agency (local people's government, CAAC and CAAC) for approval. When approved by the higher authorities, the airport management agency must provide relevant guarantees.
(two) airlines operating routes to use the airport (including alternate airport), must sign an airport use agreement with the airport management agency, clear the rights, obligations and responsibilities of both parties.
(3) As the agent of airlines in sales and ground services, the airport management agencies establish their respective rights, obligations and responsibilities through agreement. When acting as an agent for airline sales and ground services, in addition to observing the relevant provisions of the General Administration of Civil Aviation, it should also abide by the relevant provisions of airlines and accept the supervision and inspection of airlines.
(four) the airport management agencies must treat all airlines equally, and it is strictly forbidden to exclude or discriminate against airlines that do not entrust the airport management agencies to carry out sales or ground services.
(five) airlines to open up new routes, such as airport management agencies have special vehicles and other equipment, airport management agencies can provide paid agency services. If there is no such equipment, airlines will provide their own equipment, which can be rented to airport management agencies or managed by themselves.
(6) Under the premise of obeying the overall planning of the airport, airlines can build special terminals, hangars, aprons and other facilities within the airport. The specific measures for the construction and management of the above facilities shall be implemented in accordance with the relevant provisions of the Civil Aviation Administration of China.
Chapter VI Supplementary Provisions
Article 24 The General Administration of Civil Aviation of China shall be responsible for the interpretation of these Provisions.
