Measures for the Management of Residential Care Homes for the Elderly in Guangdong Province

Article 1 In order to strengthen the civilized management of residential care homes for the elderly, to protect the material and cultural life of the elderly inmates, and to promote the physical and mental health of the elderly, in accordance with the actual situation in the province, the formulation of these measures. Article 2 townships (towns), street-run homes for the elderly (old age building, the same below) is the grass-roots collective welfare institutions. Homes for the elderly to implement a combination of old age and recreation and the principle of thriftily run hospitals.

Township (township), street homes for the elderly, respectively, by the township (township) people's government and street offices, and accept the civil affairs departments of the operational guidance. Article 3 the object of adoption of the homes for the elderly are:

(1) rural households with five guarantees (including orphans), towns and cities with no dependents, no source of livelihood, no working ability of the elderly;

(2) urban and rural orphaned martyrs, orphaned veterans of the Red Army, orphaned old demobilized soldiers.

People suffering from infectious diseases or mental illness shall not be absorbed into the hospital. Article 4 the elderly admitted to the hospital adhere to the principle of their own voluntariness, the elderly by their own application to the home, by the local villagers' committee or residents' committee review and report to the township (township) people's government or the street office for approval of admission. Article 5 After an elderly person is admitted to a home, his or her original property still belongs to him or her, and may be kept by him or her or entrusted to a friend or relative or to a home for the aged. After the death of an elderly person, his/her property shall be handled in accordance with the relevant provisions of the Inheritance Law of the People's Republic of China. Article 6 The homes for the elderly shall provide good meals and ensure the supply of hot water for drinking and bathing. Article 7 The homes for the elderly shall improve the system of nursing care for the elderly and the system of hygiene work, improve the personal dietary hygiene of the elderly and environmental hygiene, and treat the sick elderly in a timely manner.

The homes for the aged that are in a position to do so shall set up medical rooms, and if they are not yet in a position to do so, they shall establish contact with nearby hospitals, so as to do a good job of preventing and treating the illnesses of the elderly and of conducting regular health check-ups, and to set up health files on the elderly. Article 8 The homes for the elderly shall organize the elderly to participate in useful learning activities, so as to make the elderly love the motherland, love the collective, unity and friendship, consciously abide by the law and implement the rules and regulations of the homes. Article 9 The homes for the elderly shall often carry out recreational activities to enliven the spiritual and cultural life of the elderly. Frugal and useful activities of condolence and birthday celebration may be held on the occasion of New Year's festivals and the birthdays of the elderly. Article 10 The homes for the elderly may, in accordance with the actual conditions of the locality, organize production and business projects such as farming, processing, service and small business, so as to increase economic income and improve the facilities of the homes and the lives of the elderly residents.

Economic entities run by the homes may absorb the elderly to take part in some labor or management work within their capacity. Article 11 The homes for the elderly shall have a director (or director and vice-director), a doctor (hygienist) and a number of staff members (hereinafter collectively referred to as management personnel), according to the total number of elderly people in the home, fifteen to twenty percent of the total number of staff members.

Managers shall be selected from among those who are law-abiding and eager to serve the elderly. The leadership of the home should be a high ideological awareness, style of work, strong sense of enterprise, have a certain management ability to pen cultural level of personnel.

Managers shall be appointed on a contractual basis, and may be dismissed if they do not perform well or do not adapt to the requirements of their work. Article 12 The homes for the elderly shall be democratically managed, and a democratic management committee or a democratic management group shall be established, consisting of representatives of the dean and management personnel, and representatives of the elderly, of whom one-third or more shall be representatives of the elderly.

Democratic management organizations, under the leadership of the dean, assist in the management of the home's food, health, recreation, learning, production, financial income and expenditure, etc., check and supervise the implementation of the management personnel of the various systems, and put forward criticisms and suggestions on the work of the home.

Homes for the aged with a large number of elderly people may set up self-governing groups of elderly people in accordance with the accommodation areas, with the elderly as the heads of the groups. Article 13 The managers of the homes for the elderly shall improve the rules and regulations centering on the job responsibility system, and clearly define the division of labor, tasks and duties of the managers. A sound system of examination, evaluation, reward and punishment shall be established.

The homes for the aged shall establish a sound financial and material management system. Accounting, cashier, custodian, general affairs by the management personnel or representatives of the elderly. Financial income and expenditure accounts should be cleared on a monthly basis, and monthly lists should be published, and materials should be registered and accepted in and out of the warehouse. Article 14 The standard of living of the elderly in the homes for the elderly shall be equivalent to the general standard of living of the local people, and shall be adjusted gradually with the improvement of the standard of living of the people.

The elderly in the homes for the township (township) five guaranteed households, its food and oil and the cost of support (including food, clothing, medical, recreation, pocket money, etc., hereinafter the same), the people's government of the township (township) co-ordination of the supply of the elderly, is an urban street orphans, the cost of their living support, according to the government's regular quantitative relief and the streets of the collective subsidies for the combination of the supply of the method.

Elderly people who are admitted to the homes and receive pensions shall pay the basic living expenses to the homes from their pensions. Article XV the infrastructure of the homes for the elderly, equipment costs, management fees and management personnel wages and benefits, by the township (town), the streets included in the financial budget at this level. Article 16 The county (district), township (town) government or street office shall educate and mobilize the cadres of all units and the masses to support the construction of the homes for the elderly, improve hygiene and green the environment.

Society should support the homes for the elderly to run a good economic entity, in terms of policy, venues, funding, technology, production, supply and marketing to be taken care of. Article XVII of the civil affairs departments shall strengthen the business guidance to the homes for the elderly, to help the homes to create a good living environment, improve the quality of management personnel, improve the level of service and management. Article 18 For violation of the provisions of these measures, dereliction of duty, resulting in accidents, by the homes for the elderly or the competent authorities, respectively, the situation of the directly responsible person shall be criticized or punished. Violation of criminal law, the judicial organs shall be punished according to law.
