(a) the general contracting tender, that is, the survey and design of construction projects, the supply of materials and equipment. Organize the whole process of contract bidding from construction to delivery;
(2) Bidding for survey and design, that is, bidding for survey, survey, planning and construction drawing design of construction projects;
(3) Construction bidding, that is, bidding for earthwork, civil engineering, equipment installation, pipeline laying and decoration of construction projects;
(four) equipment supply bidding, that is, the supply bidding of complete sets of equipment, supporting equipment, special equipment and non-standard equipment required for construction projects;
(5) Bidding for the construction of supervision bidding, that is, supervision and management of survey and design, construction and warranty of construction projects. Article 4 The construction administrative department of the people's government at or above the county level shall be in charge of the bidding and tendering of construction projects, and shall guide and supervise the bidding and tendering of construction projects according to the examination and approval authority of construction applications. Its main responsibilities are:
(1) Examining the qualifications of the tenderee;
(two) review the tender application and tender documents;
(three) to organize the relevant units to examine and approve the pre-tender estimate and bid evaluation and calibration methods;
(four) to supervise the bid opening, evaluation and selection;
(five) to supervise the signing of the contract;
(six) to investigate and deal with illegal acts in bidding. Article 5 Bidding activities must follow the principles of openness, fairness, fair competition and merit selection, and are not restricted by regions or departments.
No unit or individual may bribe or accept bribes in any way in bidding activities. Chapter II Bidding Article 6 Bidding shall be conducted for construction projects whose investment or construction area is above the limit set by the provincial construction administrative department and whose application for construction has been approved. However, the following construction projects and construction projects with investment or construction area specified by the provincial construction administrative department shall be decided by the investors themselves:
(a) wholly foreign-owned, domestic private investment, overseas donations, migrant workers to build ground, to work for relief;
(two) confirmed by the provincial construction administrative department, the construction unit has the construction qualification certificate corresponding to the construction project;
(three) the people's governments at or above the county level confirm that it belongs to confidentiality, emergency rescue and disaster relief;
(4) Small and medium-sized water conservancy and small hydropower projects. Article 7 A bid inviting unit shall have the legal person status or other organizations established according to law, and hold a project management qualification grade certificate suitable for the project subject to tender; Do not have the corresponding management qualifications, should be entrusted with the corresponding qualifications of construction engineering consulting, supervision and other units to tender. Article 8 A bid inviting unit shall enjoy the following rights:
(a) the preparation of tender documents, pre-tender estimate, bid evaluation and calibration methods;
(2) Selecting qualified tendering units;
(3) Organizing a bid evaluation team;
(four) presided over the bidding activities, according to the opinions of the evaluation team to determine the winning unit;
(5) Other rights enjoyed according to law. Ninth construction project bidding can take the following ways:
(a) public bidding, the tender notice issued by the tender unit;
(2) Inviting tenders, in which the tenderee issues invitations to bid to more than three units with corresponding qualification grades;
(3) Bidding negotiation: For special construction projects with strong technicality and professionalism and urgent construction period, which are not suitable for public bidding and inviting bidding, with the approval of the construction administrative department, three or more units with corresponding qualification levels may be invited to negotiate bidding. Tenth construction project bidding according to the following procedures:
(a) the tenderer shall fill in the tender application form, prepare the tender and report it to the construction administrative department for examination;
(two) the tender unit issued a tender announcement or invitation;
(3) The tendering unit shall submit a bid application to the tendering unit;
(4) The tenderee selects qualified bidders;
(5) The tenderee holds a tender meeting, distributes the tender documents to the bidders, and organizes the bidders to conduct on-site inspection and answer questions when necessary;
(6) The tendering unit submits the tender to the tendering unit;
(seven) the tender units to prepare the pre-tender estimate and bid evaluation and calibration methods, submitted to the construction administrative department to organize the relevant units for approval;
(8) The bid inviting unit shall organize a bid evaluation team;
(nine) the tender unit held a bid opening meeting;
(ten) after the composition of the evaluation team, the tender unit shall determine the winning bidder according to the opinions of the evaluation team;
(eleven) the tender unit issued a bid-winning notice to the successful bidder certified by the construction administrative department. Eleventh construction administrative departments to review the tender application, tender and bid-winning notice, should be completed within seven days from the date of acceptance.
After the tender is issued, it shall not be changed without authorization. If it is really necessary to change some contents, it shall notify the tenderee in time after reporting to the construction administrative department for examination and approval, and re-determine the deadline for bidding. If direct economic losses are caused to the tenderer, the tenderer shall be liable for compensation.
