Donations of public welfare, can not be revoked arbitrarily. In general, the donor can revoke the gift before the transfer of the right to the gifted property, but the gift contract with the nature of public welfare and moral obligations such as disaster relief, poverty alleviation, and assistance to the disabled shall not be revoked.
Legal Objective:Article 657 of the Chinese People's *** and National Code, a gift contract is a contract in which the donor gives his property to the donee without compensation and the donee expresses his acceptance of the gift. Article 658 of the People's Republic of China Code allows the donor to revoke the gift before the transfer of the right to the gifted property. The provisions of the preceding paragraph shall not apply to a gift contract that has been notarized or a gift contract of a public welfare or moral obligation nature, such as disaster relief, poverty alleviation or assistance to the disabled, which cannot be revoked in accordance with the law. Article 659 of the Chinese People's *** and Nationality Code stipulates that where registration or other formalities are required by law in respect of a gift of property, the relevant formalities shall be carried out. Article 660 of the Chinese People's *** and Nationality Code: If the donor does not deliver the gifted property in the case of a notarized gift contract, or in the case of a gift contract with the nature of public welfare or moral obligation such as disaster relief, poverty alleviation or assistance to the disabled which is irrevocable in accordance with the law, the recipient may request for the delivery of the gifted property. According to the provisions of the preceding paragraph shall be delivered to the gift of property due to the donor's willfulness or gross negligence resulting in damage, loss, the donor shall bear the responsibility for compensation.
