Provisions on reporting and handling of employee casualty accidents in Inner Mongolia Autonomous Region

Chapter I General Provisions Article 1 In order to ensure timely and accurate reporting, statistics, investigation and handling of employee casualty accidents, these Provisions are formulated in accordance with the Labor Law of People's Republic of China (PRC) and the Provisions on Reporting and Handling of Employee Casualty Accidents in Enterprises, and in combination with the actual situation of the autonomous region. Article 2 These Provisions shall apply to the accidents of casualties among employees of enterprises and individual economic organizations engaged in production and business activities in the autonomous region.

State organs, institutions, social organizations and their employees who have established labor contract relations with them shall be subject to these provisions. Article 3 Casualty accidents of employees mentioned in these Provisions refer to personal injuries (including hidden poisoning) that occur when employees are assigned to work outside their own units due to unsafe equipment and facilities, poor working conditions and working environment and poor management. Article 4 The labor administrative departments of the people's governments at or above the county level shall comprehensively manage the reporting, statistics, investigation and handling of casualty accidents within their respective administrative areas, and implement state supervision. Article 5 The reporting, statistics, investigation, handling and examination and approval of casualty accidents must adhere to the principles of seeking truth from facts and respecting science. Chapter II Accident Report Article 6 After the casualty accident happens, the injured person or the relevant personnel on site shall immediately report directly or step by step to the person in charge of the employing unit. Article 7 After receiving the report of serious injury, death or acute poisoning accident, the person in charge of the employing unit shall immediately report the accident time, unit, accident category, casualty degree and cause to the competent department of the employing unit (hereinafter referred to as the competent department), the labor administrative department at the county level, the public security department, the people's procuratorate and the trade union. Acute poisoning accidents should be reported to the administrative department of health at the same time.

After receiving the report, the relevant person in charge of the employer and its competent department must rush to the scene in time to organize rescue work. Article 8 After receiving the accident report, the relevant departments and trade unions shall report according to the following provisions:

(a) the accident of serious injury or death of one or two people, report to the labor administrative department, the competent department and the union city;

(two) an accident that killed more than three people should be reported to the labor administrative department, the competent department and the trade union of the autonomous region.

The casualty report must be completed within 24 hours. Ninth labor administrative departments and competent departments shall report to the people's government at the same level after receiving the report of casualty accidents. Article 10 In case of serious injury, death or acute poisoning accident, the employer shall protect the site, and no one shall move or take away the articles on the site without authorization. In order to rescue people and property and prevent the accident from expanding, if it is really necessary to move part of the price, it is necessary to make signs, draw the scene map of the accident, record it by video and attach detailed instructions.

Cleaning up the scene of the accident must be approved by the accident investigation team. Chapter III Accident Investigation Article 11 An accident investigation team composed of production, technical and safety personnel and trade union members shall be organized by the employing unit to investigate minor injuries and serious injuries; When a serious injury accident occurs, the local labor administrative department may send personnel to participate in or organize an investigation as appropriate. Twelfth accidents in which one or two people died at a time shall be investigated by the competent department of the accident unit in conjunction with the labor administrative department of the Union City and other relevant departments and trade unions; An accident in which three to nine people died shall be investigated by the competent department in conjunction with the labor administrative department of the autonomous region and the trade union; An accident in which ten to forty-nine people died shall be investigated by the people's government of the autonomous region, which shall organize relevant departments and trade unions to form an investigation team.

If the accident unit has no competent department, the labor administrative department or the people's government of the autonomous region shall organize the investigation according to the principle mentioned in the preceding paragraph.

The people's government at the corresponding level (the Union Administrative Office) may directly organize relevant departments to organize accident investigation according to the severity of the accident. Thirteenth accidents shall be investigated by the relevant departments at lower levels, and the relevant departments at higher levels may send personnel to participate in or organize the investigation when they think it necessary. Accidents investigated by superior departments shall be handled by subordinate departments in coordination. If the relevant departments at higher levels are unable to participate in the investigation for some reason, they may authorize the corresponding departments at lower levels to participate in the investigation. Fourteenth members of the accident investigation team shall meet the following conditions:

(1) Having a certain professional knowledge required for accident investigation;

(2) Having no direct interest in the accident. Fifteenth accident investigation team has the following responsibilities:

(a) to find out the course, cause, casualties and economic losses of the accident, and to confirm the type and nature of the accident;

(two) to distinguish the responsibility of the accident, to determine the person responsible for the accident, and to put forward the handling opinions of the person responsible for the accident;

(three) put forward measures to prevent similar accidents;

(four) write the accident investigation report. Sixteenth accident investigation team has the right to know the situation from the accident unit or the relevant units and personnel, and no unit or individual may refuse.

No unit or individual may obstruct or interfere with the normal work of the accident investigation team. Seventeenth according to the needs of accident investigation, the accident investigation team may designate qualified units to carry out technical appraisal or inspection of the accident. If the accident unit and the parties concerned are dissatisfied with the appraisal or inspection conclusion, they may request re-inspection.

The cost of identification and inspection shall be borne by the accident unit.
