The disposal of waste hazardous chemicals shall be carried out in accordance with environmental protection laws, administrative regulations and relevant state regulations. Article 3 Hazardous chemicals mentioned in these Regulations refer to highly toxic chemicals and other chemicals that are toxic, corrosive, explosive, combustible and combustion-supporting, and are harmful to people, facilities and the environment.
The catalogue of hazardous chemicals shall be determined and published by the safety production supervision and management department of the State Council in conjunction with the competent departments of industry and information technology, public security, environmental protection, health, quality supervision, inspection and quarantine, transportation, railways, civil aviation, agriculture, etc. of the State Council, and adjusted in a timely manner according to the identification and classification standards of hazardous characteristics of chemicals. Article 4 The safety management of hazardous chemicals shall adhere to the principles of safety first, prevention first and comprehensive management, and strengthen and implement the main responsibility of enterprises.
The main person in charge of the unit that produces, stores, uses, manages and transports dangerous chemicals (hereinafter referred to as the dangerous chemicals unit) shall be fully responsible for the safety management of dangerous chemicals in this unit.
Hazardous chemicals units shall meet the safety requirements stipulated by laws, administrative regulations, national standards and industry standards, establish and improve safety management rules and regulations and post safety responsibility system, and conduct safety education, legal education and post technical training for employees. Employees should receive education and training, and work after passing the examination; For positions with qualification requirements, personnel who have obtained corresponding qualifications according to law shall be provided. Article 5 No unit or individual may produce, trade or use dangerous chemicals prohibited by the state.
Where the state has restrictions on the use of dangerous chemicals, no unit or individual may use dangerous chemicals in violation of the restrictions. Article 6 The relevant departments that implement safety supervision and management on the production, storage, use, operation and transportation of hazardous chemicals (hereinafter referred to as the safety supervision and management departments of hazardous chemicals) shall perform their duties in accordance with the following provisions:
(1) The safety production supervision and management department is responsible for the overall work of the safety supervision and management of hazardous chemicals, organizing the determination, publication and adjustment of the catalogue of hazardous chemicals, reviewing the safety conditions of construction projects that are newly built, rebuilt, expanded for production and storage of hazardous chemicals (including the use of long-distance pipelines to transport hazardous chemicals, the same below), issuing hazardous chemicals safety production licenses, hazardous chemicals safety use licenses and hazardous chemicals business licenses, and being responsible for the registration of hazardous chemicals.
(2) The public security organ shall be responsible for the public safety management of hazardous chemicals, issue the purchase license and road transport pass for highly toxic chemicals, and be responsible for the road traffic safety management of vehicles transporting hazardous chemicals.
(3) The quality supervision, inspection and quarantine department is responsible for issuing production licenses for industrial products of enterprises that produce dangerous chemicals and their packages and containers (except large fixed storage tanks for storing dangerous chemicals, the same below), supervising the quality of their products according to law, and inspecting the import and export of dangerous chemicals and their packages.
(4) The competent department of environmental protection is responsible for the supervision and management of the disposal of discarded hazardous chemicals, organizing the identification of environmental hazards of hazardous chemicals and the assessment of environmental risks, determining hazardous chemicals subject to key environmental management, and being responsible for the environmental management registration of hazardous chemicals and new chemicals; Investigate environmental pollution accidents and ecological damage incidents related to hazardous chemicals according to the division of responsibilities, and be responsible for emergency environmental monitoring at the scene of hazardous chemicals accidents.
(5) The competent department of transportation is responsible for the license of road transport and waterway transport of dangerous chemicals and the safety management of means of transport, supervising the safety of waterway transport of dangerous chemicals, and determining the qualifications of drivers, crew members, loading and unloading management personnel, escorts, declaration personnel and on-site inspection personnel of dangerous chemicals road transport enterprises and waterway transport enterprises. The railway supervision department is responsible for the safety management of railway transportation of dangerous chemicals and their means of transport. The competent civil aviation authority is responsible for the air transport of dangerous chemicals and the safety management of air transport enterprises and their means of transport.
(six) the competent health department is responsible for the management of toxic identification of dangerous chemicals, and is responsible for organizing and coordinating the medical and health rescue work for the injured in dangerous chemical accidents.
(7) The administrative department for industry and commerce shall, according to the permission of the relevant departments, issue business licenses to enterprises that produce, store, manage and transport dangerous chemicals, and investigate and deal with the illegal procurement of dangerous chemicals by dangerous chemicals management enterprises.
(eight) the postal administration department is responsible for investigating and handling the delivery of dangerous chemicals according to law. Seventh departments responsible for the safety supervision and management of dangerous chemicals to carry out supervision and inspection according to law, can take the following measures:
(a) to enter the workplace of dangerous chemicals for on-site inspection, to understand the situation from the relevant units and personnel, and to consult and copy the relevant documents and materials;
(two) found that the hidden dangers of dangerous chemicals accidents, shall be ordered to eliminate immediately or within a time limit;
(3) Ordering facilities, equipment, devices and means of transport that do not conform to laws, administrative regulations, rules or national or industrial standards to stop using immediately;
(4) With the approval of the principal person in charge of the department, seal up the places where hazardous chemicals are illegally produced, stored, used and transported, and detain hazardous chemicals illegally produced, stored, used and transported, as well as raw materials, equipment and means of transport used for illegal production, use and transport of hazardous chemicals;
(five) found illegal acts affecting the safety of dangerous chemicals, corrected on the spot or ordered to make corrections within a time limit.
When the department responsible for the safety supervision and management of hazardous chemicals conducts supervision and inspection according to law, the number of supervision and inspection personnel shall not be less than 2, and the law enforcement certificates shall be produced; The relevant units and individuals shall cooperate with the supervision and inspection conducted according to law, and shall not refuse or hinder them.
