Chapter IV of the Regulations on Radiation Protection of Radioisotopes and Radiation Devices Emergency Response to Radiation Accidents

Article 40 According to the nature of radiation accidents, severity, controllability and the scope of the impact of factors such as radiation accidents, from heavy to light radiation accidents are divided into four levels of radiation accidents of particularly significant radiation accidents, significant radiation accidents, larger radiation accidents and general radiation accidents.

Extraordinary major radiation accidents are those in which Class I or Class II radioactive sources are lost, stolen or out of control, resulting in serious radiation contamination on a wide scale, or in which the loss of control of radioisotopes and radiation devices leads to the acute deaths of more than three people (including three people).

Major radiation accidents, refers to Class I, Class II radioactive sources lost, stolen, out of control, or radioisotopes and radiation devices out of control resulting in acute death of less than 2 people (including 2 people) or more than 10 people (including 10 people) acute severe radiation sickness, local organ disability.

Larger radiation accidents are those in which Class III radioactive sources are lost, stolen, or out of control, or in which radioisotopes and radiation devices are out of control resulting in acute severe radiation sickness or localized organ disability in less than 9 people (including 9 people).

General radiation accidents, refers to the loss, theft, loss of control of Class Ⅳ, Ⅴ radioactive sources, or radioisotopes and radiation devices out of control resulting in personnel exposure to more than the annual dose limit.

Article 41 The competent department of environmental protection of the people's government at or above the county level shall, in conjunction with the same level of public security, health, finance and other departments to prepare an emergency response plan for radiation accidents, reported to the people's government at this level for approval. Radiation accident emergency plan shall include the following:

(1) emergency response agencies and division of responsibilities;

(2) emergency personnel organization, training, and emergency response and rescue equipment, funds, and materials preparation;

(3) radiation accident classification and emergency response measures;

(4) radiation accidents, investigation, reporting and handling procedures. Units that produce, sell or use radioisotopes and radiation devices shall formulate their own emergency response programs and make emergency preparations in accordance with the risks of possible radiation accidents.

Article 42 In the event of a radiation accident, a unit that produces, sells or uses radioisotopes and radiation devices shall immediately activate its own emergency plan, take emergency measures and immediately report to the local competent department of environmental protection, public security department and competent department of health.

After receiving the report of the radiation accident, the competent environmental protection department, the public security department, and the competent health department shall immediately send someone to the scene, conduct an on-site investigation, take effective measures to control and eliminate the impact of the accident, and at the same time report the information of the radiation accident to the people's government of their own level and the competent environmental protection department, the public security department, and the competent health department of the people's government of a higher level.

Local people's governments at or above the county level and their relevant departments receive reports of radiation accidents, should be in accordance with the provisions of the accident hierarchical reporting of radiation accidents in a timely manner to report information on the people's governments at higher levels and their relevant departments. After the occurrence of particularly significant radiation accidents and major radiation accidents, the people's governments of the provinces, autonomous regions and municipalities directly under the Central Government where the accidents occur and the relevant departments of the State Council shall report to the State Council within four hours; in special circumstances, the people's governments of the places where the accidents occur and the relevant departments thereof may report directly to the State Council and at the same time report to the people's governments of the higher levels and the relevant departments thereof.

It is prohibited to delay, conceal, falsely report or omit to report radiation accidents.

Article 43 In the event of a radiation accident or evidence that a radiation accident may occur, the competent department for environmental protection of the people's government at or above the county level shall have the right to take the following temporary control measures:

(1) ordering the cessation of operations that lead to, or are likely to lead to, radiation accidents;

(2) organizing the control of the accident site.

Article 44 After the occurrence of a radiation accident, the people's government at or above the county level concerned shall, in accordance with the level of the radiation accident, initiate and organize the implementation of the corresponding emergency plan. People's governments above the county level, the competent departments of environmental protection, public security departments, the competent departments of health, in accordance with the division of responsibilities to do the corresponding emergency response to radiation accidents:

(a) the competent departments of environmental protection is responsible for radiation accidents, the emergency response, investigation and treatment, and characterization of the work of grading, to assist the public security departments to monitor the recovery of lost and stolen radioactive sources;

(b) the public security departments are responsible for the lost, Stolen radioactive sources of the investigation and recovery of cases;

(c) the competent health department is responsible for radiation accidents and medical emergencies.

The competent departments of environmental protection, public security, and health shall promptly notify each other of the emergency response, investigation and treatment, characterization and classification, case investigation and medical emergency of radiation accidents. The department designated by the State Council shall be responsible for the relevant international information notification work according to the nature and level of the radiation accident determined by the competent department of environmental protection.

Article 45 The unit in which a radiation accident occurs shall immediately send the persons who may be harmed by radiation to the hospitals designated by the local health authorities or hospitals that are in a position to treat patients with radiation injury for examination and treatment, or request the hospitals to immediately send people to the scene of the accident to take rescue measures.
