Disputes over the right to health belong to tort disputes. The right to life and health is one of the basic civil rights of China citizens. According to the relevant provisions of the Civil Code, those who infringe upon civil rights and interests shall bear tort liability in accordance with this Law. The civil rights and interests mentioned in this Law include personal and property rights and interests such as the right to life, health, name, reputation, honor and portrait.

Legal persons and unincorporated organizations enjoy the right of name, reputation and honor.
