Regulations of Shandong Province on Promoting Small and Medium-sized Enterprises

Chapter I General Provisions Article 1 In order to improve the development environment of small and medium-sized enterprises, safeguard their legitimate rights and interests, and promote their healthy development, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Promotion of Small and Medium-sized Enterprises and other relevant laws and regulations, combined with the actual situation of this province. Article 2 The term "small and medium-sized enterprises" as mentioned in these Regulations refers to enterprises of various ownership and forms established within the administrative region of this province in accordance with the national standards for small and medium-sized enterprises. Article 3 The people's governments at or above the county level shall, in accordance with the principles of actively supporting, strengthening guidance, improving services, standardizing according to law and safeguarding rights and interests, incorporate the development of small and medium-sized enterprises into the national economic and social development plan, formulate corresponding measures, improve the coordination mechanism for promoting the development of small and medium-sized enterprises, and create a good development environment for small and medium-sized enterprises.

The township (town) people's government shall provide guidance and services for small and medium-sized enterprises according to law. Article 4 The departments responsible for the work of small and medium-sized enterprises of the people's governments at or above the county level shall comprehensively coordinate and guide the work of small and medium-sized enterprises within their respective administrative areas, study and put forward the development strategies, plans, encouragement policies and management measures for small and medium-sized enterprises in accordance with the national guidelines, policies and laws and regulations for the development of small and medium-sized enterprises, and supervise the implementation together with relevant departments.

Other relevant departments of the people's governments at or above the county level shall, in accordance with their respective responsibilities, provide guidance and services for the work of small and medium-sized enterprises. Article 5 The provincial statistics department shall, jointly with the provincial departments responsible for the work of small and medium-sized enterprises and the departments of industry and commerce, taxation, quality and technical supervision, establish the statistical index system of small and medium-sized enterprises in the province according to the classification standards of small and medium-sized enterprises, and formulate the statistical system of small and medium-sized enterprises. Article 6 The legitimate rights and interests of small and medium-sized enterprises are protected by law, and no unit or individual may infringe upon them. Article 7 Small and medium-sized enterprises shall operate legally, pay taxes in accordance with the law, be honest and trustworthy, and abide by national laws and regulations on safety in production, environmental protection, occupational health, comprehensive utilization of resources, labor and social security, product quality, etc. , shall not harm the interests of the state and society.

Small and medium-sized enterprises should protect the legitimate rights and interests of employees according to law, sign labor contracts with employees in accordance with regulations, pay wages on time, and handle social insurance for employees such as pension, unemployment, medical care, work injury and maternity. Chapter II Entrepreneurship Support Article 8 People's governments at all levels shall, in accordance with the principles of equal access and fair treatment, guarantee the rights of small and medium-sized enterprises to participate in fair competition and transactions. Small and medium-sized enterprises can enter fields that are not explicitly prohibited by laws and administrative regulations on an equal footing. Article 9 People's governments at all levels should increase their support for entrepreneurship, formulate and improve policies and measures to encourage entrepreneurship, improve the entrepreneurial environment, encourage independent entrepreneurship, and guide the establishment of small and medium-sized scientific and technological enterprises, comprehensive utilization of resources, environmental protection and energy conservation, and modern services. And focus on supporting newly established and growing SMEs. Article 10 The departments of the people's governments at or above the county level responsible for the work of small and medium-sized enterprises shall strengthen entrepreneurship counseling and provide entrepreneurs and small and medium-sized enterprises with information and services such as industrial policies, entrepreneurship training, management consulting, financing guidance, technological innovation and risk prevention. Eleventh to encourage the use of private capital and overseas capital to set up small and medium-sized enterprises according to law.

Encourage the establishment of small and medium-sized enterprises with intangible assets such as intellectual property rights. Where small and medium-sized enterprises are established with intangible assets, the proportion of capital contribution to the registered capital of the enterprise can be agreed upon by all investors through consultation. Where laws and regulations provide otherwise, such provisions shall prevail. Twelfth provinces, districts, cities and counties (cities) people's governments shall arrange the necessary land for the construction of small and medium-sized enterprises in urban and rural construction planning.

Encourage small and medium-sized enterprises to gather and develop, and support the transformation and construction of small and medium-sized enterprise entrepreneurship bases by using existing construction land and idle factories. Encourage the construction and lease of multi-storey standard factory buildings. Thirteenth laid-off workers, unemployed people, disabled people, high (middle) school graduates, retired soldiers, returned overseas students, scientific research personnel and other state organs and institutions established small and medium-sized enterprises. With the approval of the tax authorities, income tax and business tax may be reduced or exempted.

Unemployed people who start small and medium-sized enterprises during the period of receiving unemployment insurance benefits can receive unemployment insurance benefits for no more than 12 months during the remaining enjoyment period. Those who meet the conditions of employment fund subsidies may enjoy employment subsidies as required. Chapter III Technological Innovation Article 14 People's governments at all levels shall encourage small and medium-sized enterprises to give full play to the main role of independent innovation, develop new products, adopt advanced technologies, processes and equipment, promote technological progress and improve their independent innovation ability in accordance with national industrial policies and market demand. Fifteenth people's governments at all levels and relevant departments should support the construction of R&D institutions and public technical service institutions in Industry-University-Research, and provide basic conditions and public services for scientific research and development and the transformation of scientific and technological achievements.

Encourage industry associations or enterprises with strong independent research and development capabilities to establish or drive small and medium-sized enterprises to establish research and development institutions to provide technical services for small and medium-sized enterprises.

People's governments at all levels and relevant departments shall give priority support to various R&D institutions and public technical service institutions established by small and medium-sized enterprises in terms of construction funds, construction land, talent introduction and scientific and technological projects. Sixteenth people's governments at all levels and relevant departments should encourage domestic and foreign enterprises, scientific research institutions and scientific and technological personnel to set up all kinds of scientific and technological enterprise incubation bases and small and medium-sized scientific and technological enterprises.

Small and medium-sized enterprises to carry out technological transformation and adopt new technologies, new processes and new materials to develop new products, as well as equipment and expenses for technological research and development, enjoy relevant support policies stipulated by the state and the province.
