Regulations of Shandong Province on Pension Services

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Law of the People's Republic of China on the Protection of the Rights and Interests of the Elderly and other laws and administrative regulations, combined with the actual situation of this province, in order to actively respond to the aging population, improve the old-age service system, meet the diversified and multi-level needs of the elderly, and promote the healthy development of the old-age service. Article 2 These Regulations shall apply to the aged care service and its supervision and management activities within the administrative area of this province.

The term "aged care service" as mentioned in these Regulations refers to the life care, medical care, rehabilitation care, recreation and sports, spiritual comfort, emergency assistance, hospice care and other services provided by the government and society for the elderly based on the maintenance obligations of family members. Article 3 Pension service is an important part of the social public service system. The development of old-age service should adapt to the level of economic and social development, and adhere to the basic principles of government-led, social participation, market operation and security. Article 4 The people's governments at or above the county level shall strengthen their leadership over the work of providing for the aged, incorporate the development of providing for the aged into the national economic and social development plan of the region, formulate the development plan of providing for the aged, establish and improve the system of providing for the aged which is coordinated by community institutions at home and combines medical care with nursing care, and ensure the development funds of providing for the aged.

Township people's governments and sub-district offices are responsible for the old-age services within their respective jurisdictions. Article 5 The civil affairs departments of the people's governments at or above the county level shall be in charge of the old-age services within their respective administrative areas.

The health department of the people's government at or above the county level is responsible for promoting the integration of medical and health services for the elderly; Development and reform, finance, natural resources, housing and urban construction, emergency management, market supervision and management, medical security and other departments shall, in accordance with their respective responsibilities, do a good job in the related work of old-age services. Article 6 Trade unions, the Communist Youth League, women's federations, disabled persons' federations, the Red Cross and other units shall give full play to their respective advantages and provide services for the elderly in coordination.

Residents' committees and villagers' committees should give full play to the role of grassroots mass autonomous organizations and do a good job in ensuring services for the elderly.

Encourage citizens, legal persons and other organizations to provide, participate in or support pension services in various ways. Article 7 The news media such as radio, television, newspapers and the Internet should practice the socialist core values, strengthen the public welfare propaganda of the old-age service, carry forward the traditional virtues of supporting the elderly, showing filial piety and respecting the elderly, and establish a social fashion of respecting, caring for and helping the elderly.

Encourage the news media to open channels or special topics and columns for the elderly, spread the knowledge of fitness, health care and rights protection suitable for the elderly, and enrich their spiritual and cultural life. Eighth units and individuals that have made outstanding contributions to the aged care service shall be commended and rewarded by the people's governments at or above the county level and relevant departments in accordance with the provisions. Chapter II Planning and Construction of Old-age Service Facilities Article 9 The civil affairs departments of the people's governments of cities and counties (cities) divided into districts shall, jointly with natural resources and other departments, formulate the layout plan of old-age service facilities according to the land spatial planning, the distribution and changes of the elderly in their respective administrative areas, and make clear the overall layout and land scale of old-age service facilities. Incorporate into the special planning of public service facilities, solicit public opinions and report to the people's government at the same level for approval and implementation.

Regulatory detailed planning, township planning and village planning should implement the relevant contents of the layout planning of old-age service facilities. Tenth provinces, districts, cities and counties (cities) people's governments shall incorporate the civil affairs departments into the land and space planning commission.

The people's governments at all levels shall, according to the land and space planning, guarantee the land for the construction of old-age service facilities.

The land for old-age service facilities such as nursing homes and welfare homes organized by the government is supplied by allocation; Other non-profit pension service facilities can be supplied by allocation upon approval according to law.

The land for the construction of for-profit pension service facilities can be supplied through transfer or lease.

Meet the requirements of national and provincial regulations, rural collective construction land can be used to build old-age service facilities. Eleventh new urban residential areas in accordance with the standard of not less than 20 square meters per 100 households supporting the construction of community pension service facilities.

If the completed urban residential area is not built or the supporting community pension service facilities do not meet the specified requirements, the local county (city, district) people's government shall configure the community pension service facilities through new construction, reconstruction, purchase, replacement and lease.

A number of small residential areas can co-ordinate the allocation of community pension service facilities. Twelfth natural resources departments of the people's governments at or above the county level shall, when proposing the planning conditions of residential land, make clear the synchronous planning and design requirements of supporting community pension service facilities, and determine the location, use nature and development intensity of the land; Before reviewing the design scheme of urban residential construction projects, the opinions of the civil affairs departments at the same level shall be sought. Article 13 The housing and urban construction department of the people's government of a city or county (city) divided into districts shall, jointly with the departments of civil affairs and natural resources, clarify the construction standards, investment sources, ownership of property rights, completion period, transfer methods and other contents of community pension service facilities in the opinions on the construction conditions of real estate development projects. Fourteenth construction units should be in accordance with the approved planning requirements, supporting the construction of community pension service facilities. Supporting community pension service facilities and residential construction projects are planned, constructed, accepted and delivered simultaneously.

The natural resources department of the people's government at or above the county level shall verify whether the construction of supporting community pension service facilities meets the planning conditions according to law. Without verification or unqualified verification, the construction unit shall not organize the completion acceptance.
