It depends on the specific situation. It is not illegal not to sell or give your own brewed wine to others, but it is illegal to sell your own brewed wine.
According to Article 29 of the Food Safety Law, the state implements a licensing system for the production and operation of food. Those engaged in food circulation and catering services shall obtain food production licenses, food circulation licenses and catering service licenses according to law.
According to Article 26 of the Food Safety Law, food safety standards shall include the following contents:
(1) Provisions on the limits of pathogenic microorganisms, pesticide residues, veterinary drug residues, biotoxins, heavy metals and other pollutants harmful to human health in food, food additives and food-related products;

Therefore, as a kind of food, wine is also subject to the provisions of the Food Safety Law.
Second, is it illegal to sell bootleg liquor?
It is illegal and has been suspected of violating the provisions of the Regulations on Administration for Industry and Commerce. If you want to sell wine, you must apply for business license, tax registration certificate, employee health certificate and other relevant licenses in accordance with the regulations.
If you make your own wine for business, you must apply for a license (apply for a business license at the Industrial and Commercial Bureau), otherwise it may constitute illegal business.
Third, the certificate process of opening a winery
(a) with a copy of the housing lease contract and ID card, go to the industrial and commercial office in the area where the factory is located, pay the money to fill in the form, and fill it out as required;
(2) Find a place to deal with the winery. It would be better if you had your own place, which greatly saved the rent of the factory. You must pay attention to preparing the factory contract, because it will be used by the industrial and commercial bureau later;

(5) Registered trademarks, preferably with the same name as the enterprise name: both limited companies (business licenses of enterprise legal persons) and natural persons (business licenses of individual industrial and commercial households) can register trademarks.
Legal basis: Detailed Rules for Investigating and Handling Products without Production License Article 10 Units or individuals that produce or sell unlicensed products shall, when being investigated and dealt with, write written materials for unlicensed production or sales. The production enterprise shall provide the list of the name, model, specification, production date, inventory, product cost, ex-factory price, output value and profit of the unlicensed product, and the sales unit shall provide the name, model, specification, quantity, sales start date, purchase price, sales price, turnover, profit and name and address of the production enterprise of the unlicensed product.
