Contents of management measures for STD prevention and treatment

Article 1 In order to prevent and control the spread of sexually transmitted diseases and protect human health, these Measures are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Infectious Diseases (hereinafter referred to as the Law on the Prevention and Control of Infectious Diseases) and the Regulations on the Prevention and Control of AIDS.

Article 2 Sexually transmitted diseases are diseases with sexual contact as the main route of transmission. The term "sexually transmitted diseases" as mentioned in these Measures includes the following categories:

(1) Syphilis and gonorrhea in Class B infectious diseases as stipulated in the Law on the Prevention and Control of Infectious Diseases;

(2) Genital chlamydia trachomatis infection, condyloma acuminatum and genital herpes;

(3) The Ministry of Health determines other sexually transmitted diseases that need to be managed according to the degree of disease harm, epidemic situation and other factors.

The management of AIDS prevention and control shall be implemented in accordance with the relevant provisions of the Regulations on AIDS Prevention and Control.

Article 3 The prevention and treatment of sexually transmitted diseases shall adhere to the principle of putting prevention first and combining prevention and treatment, and follow the principles of prevention and treatment according to law, scientific management, graded responsibility, professional guidance, departmental cooperation and social participation.

Article 4 The prevention and treatment of sexually transmitted diseases should be combined with the prevention and treatment of AIDS. The prevention and treatment of sexually transmitted diseases should be included in the coordination mechanism of AIDS prevention and treatment at all levels, and prevention resources should be integrated to implement comprehensive prevention and treatment of sexually transmitted diseases and AIDS.

Article 5 The Ministry of Health is responsible for the prevention and control of sexually transmitted diseases throughout the country. According to the need to develop a national STD prevention and control plan; Determine the list of sexually transmitted diseases that need to be managed, and decide and publish the sexually transmitted diseases that need to be included in the management of Class B and Class C infectious diseases.

The local health administrative departments at or above the county level shall be responsible for the prevention and control of sexually transmitted diseases within their respective administrative areas, and formulate and organize the implementation of the prevention and control plan of sexually transmitted diseases within their respective administrative areas according to these measures and the national plan for the prevention and control of sexually transmitted diseases, combined with the local epidemic situation and the need for prevention and control.

The administrative department of health shall, under the leadership of the people's government at the same level, establish and improve the management and service system for STD prevention and control, and gradually incorporate STD prevention and control into basic public health services; Strengthen the construction of STD prevention and control team, be responsible for arranging the funds needed for STD prevention and control, and organize the work of STD prevention and control.

Sixth health administrative departments should encourage and support social organizations to participate in the prevention and treatment of sexually transmitted diseases, and carry out activities such as publicity and education, behavioral intervention, psychological support and social care.

Encourage and support medical care, scientific research and other related institutions to carry out research and academic exchanges on STD prevention and control, and participate in public welfare activities on STD prevention and control.

Article 7 Medical colleges, medical personnel training institutions and medical examination institutions shall incorporate STD prevention and control policies and knowledge into the contents of medical college education, resident training, continuing education and other training and medical examination.

Article 8 No unit or individual may discriminate against patients with sexually transmitted diseases and their families. The legitimate rights and interests of patients with sexually transmitted diseases, such as medical treatment, enrollment, employment, marriage and childbirth, are protected by law. Ninth health administrative departments shall, according to the needs of local STD prevention and control work, designate disease prevention and control institutions to undertake the task of STD prevention and control, and rationally plan medical institutions to carry out STD diagnosis and treatment.

Tenth China Municipal Center for Disease Control and Prevention is responsible for the prevention and treatment of sexually transmitted diseases:

(a) to assist the Ministry of Health in formulating the national STD prevention and control plan;

(two) to guide the national STD prevention and control work, to carry out STD monitoring, epidemic analysis and management, training and supervision, prevention and control effect evaluation and other work;

(three) to organize the formulation and improvement of technical specifications for laboratory testing of sexually transmitted diseases, carry out quality management of sexually transmitted diseases laboratories, and regularly carry out quality evaluation of clinical application of diagnostic reagents for sexually transmitted diseases.

Eleventh provincial, municipal and county-level disease prevention and control institutions are responsible for the prevention and control of sexually transmitted diseases, and their duties are:

(a) to organize relevant institutions and experts to assist the health administrative departments at the same level to formulate plans for the prevention and control of sexually transmitted diseases in their respective administrative areas, and to carry out STD monitoring, epidemiological investigation, epidemic analysis and management, training and supervision;

(two) to organize and guide the lower disease prevention and control institutions and social organizations to carry out publicity and education on the prevention and treatment of sexually transmitted diseases, and to intervene in people at risk of contracting sexually transmitted diseases;

(3) Organizing the quality management of sexually transmitted diseases laboratories within their respective administrative areas.

Twelfth medical institutions should actively provide STD diagnosis and treatment services to facilitate patients to seek medical treatment.

Medical institutions that carry out the diagnosis and treatment of sexually transmitted diseases shall obtain the diagnosis and treatment subjects related to the diagnosis and treatment of sexually transmitted diseases, determine the corresponding departments, and shall meet the following conditions:

(1) Having corresponding consultation rooms, including consultation rooms, treatment rooms and laboratories;

(2) Necessary equipment, facilities and medicines for diagnosis, treatment, disinfection and sterilization of sexually transmitted diseases;

(three) persons who have obtained professional qualifications according to law and passed the examination of STD diagnosis and treatment training.

Thirteenth medical institutions to carry out the diagnosis and treatment of sexually transmitted diseases are:

(a) in accordance with the diagnostic standards and technical specifications for sexually transmitted diseases, diagnosis and treatment of patients with sexually transmitted diseases or suspected patients, and report the epidemic situation in accordance with the provisions;

(two) to carry out publicity, health education, consultation and necessary intervention on the prevention and treatment of sexually transmitted diseases;

(three) to assist the health administrative department to carry out business training of STD diagnosis and treatment;

(four) to carry out quality control of laboratory testing;

(five) to assist the disease prevention and control institutions to carry out the investigation of missed reports of sexually transmitted diseases and epidemiological investigation.

Fourteenth provincial health administrative departments shall regularly organize professionals engaged in the diagnosis, treatment, prevention and control of sexually transmitted diseases to conduct on-the-job training and assessment.

Health administrative departments and trade associations shall train doctors in dermatology, obstetrics and gynecology, urology and other related disciplines, and the training content shall include knowledge of STD prevention and professional technical training.

Fifteenth medical institutions to carry out the business of diagnosis and treatment of sexually transmitted diseases, should obtain professional qualifications according to law, and should regularly receive knowledge of STD prevention and treatment and professional and technical post training.

The personnel of disease prevention and control institutions shall regularly receive knowledge of STD prevention and control and professional and technical post training.

Sixteenth local health administrative departments at or above the county level shall promptly publish the information of medical institutions that have obtained the relevant subjects of STD diagnosis and treatment.

Medical institutions engaged in the diagnosis and treatment of sexually transmitted diseases shall publish relevant medical advertisements according to law. Seventeenth disease prevention and control institutions and medical institutions engaged in the diagnosis and treatment of sexually transmitted diseases shall, according to the local epidemic characteristics of sexually transmitted diseases, determine the contents of sexually transmitted diseases publicity and health education, and publicize the knowledge of sexually transmitted diseases to the public.

Article 18 Disease prevention and control institutions at all levels shall publicize the knowledge of STD prevention and control in places where people with STD risk behaviors are concentrated through various forms, advocate safe sex, and encourage people with STD risk behaviors to regularly go to medical institutions with STD diagnosis and treatment qualifications for STD examination.

Nineteenth medical institutions engaged in the diagnosis and treatment of sexually transmitted diseases should provide education on sexually transmitted diseases and reproductive health, counseling and testing and referral services for other diseases.

Article 20 Grassroots medical and health institutions and social organizations engaged in the prevention and treatment of sexually transmitted diseases shall, under the unified planning and guidance of local health administrative departments and disease prevention and control institutions, carry out knowledge propaganda and behavioral intervention on sexually transmitted diseases and reproductive health for people susceptible to sexually transmitted diseases, and provide consulting services.

Twenty-first AIDS voluntary counseling and testing institutions and community drug maintenance treatment clinics should incorporate free counseling and testing of syphilis into their daily services; Syphilis-positive patients found in counseling and testing should be informed to go to medical institutions that carry out STD diagnosis and treatment.

Article 22 Medical institutions providing maternal and child health care and midwifery technical services shall provide syphilis screening and testing, consultation, necessary diagnosis and treatment or referral services for pregnant women to prevent the occurrence of congenital syphilis.

Twenty-third patients with sexually transmitted diseases should take necessary protective measures to prevent infection to others, and shall not intentionally spread sexually transmitted diseases in any way.

Twenty-fourth in areas where sexually transmitted diseases are prevalent, the administrative department of health may, according to local conditions, take preventive measures for specific groups through general survey and treatment. Article 25 Medical institutions engaged in the diagnosis and treatment of sexually transmitted diseases shall implement the responsibility system of first-time doctors, establish outpatient logs, register patients case by case, and timely check patients who may be infected with sexually transmitted diseases or have suspicious symptoms and signs of sexually transmitted diseases, and shall not shirk for any reason. When patients with sexually transmitted diseases are accompanied by diseases that seriously endanger their health and life, they can be referred to experts with diseases for diagnosis and treatment, and given support for the diagnosis and treatment of sexually transmitted diseases.

Medical institutions or departments that do not have the conditions to carry out STD diagnosis and treatment shall promptly refer suspected or confirmed STD patients to medical institutions or departments with STD diagnosis and treatment conditions. When patients have been accompanied by diseases that seriously endanger their health and life, they can be arranged to continue their diagnosis and treatment in the specialist with diseases, and medical institutions or departments that carry out STD diagnosis and treatment services should give support to STD diagnosis and treatment.

Twenty-sixth medical institutions and their medical staff should follow the principle of informed consent when conducting STD-related examinations for patients.

Twenty-seventh medical institutions engaged in the diagnosis and treatment of sexually transmitted diseases should provide sexually transmitted diseases treatment services in accordance with the principles of safety, effectiveness, economy and convenience, and give priority to the use of basic drugs.

Medical institutions engaged in the diagnosis and treatment of sexually transmitted diseases shall publicize the prices of services such as diagnosis and treatment, examination and medicines and medical devices, and collect fees in accordance with relevant regulations.

The basic drugs for the treatment of sexually transmitted diseases will be included in the list of essential drugs, and the proportion of reimbursement will be gradually increased, and the cost of basic diagnosis and treatment services for sexually transmitted diseases will be included in the scope of reimbursement.

Twenty-eighth medical personnel engaged in the diagnosis and treatment of sexually transmitted diseases should collect a complete medical history, and carry out physical examination, clinical examination, diagnosis and treatment in strict accordance with the requirements of the diagnostic standards for sexually transmitted diseases and related norms issued by the Ministry of Health.

Twenty-ninth medical personnel engaged in the diagnosis and treatment of sexually transmitted diseases should standardize the writing of medical records, accurately fill in the infectious disease report card to report the epidemic situation, review the patients with sexually transmitted diseases, provide health education and consultation and other preventive services, and record them.

Thirtieth medical staff to carry out the business of diagnosis and treatment of sexually transmitted diseases should inform patients with sexually transmitted diseases and inform those who have sex with them to seek medical treatment as soon as possible.

Article 31 Medical institutions that carry out diagnosis and treatment of sexually transmitted diseases and provide health care and midwifery technical services during pregnancy shall provide timely treatment for pregnant women infected with syphilis in accordance with the national recommendation scheme, and provide necessary preventive treatment, follow-up and syphilis-related testing services for their babies. Children diagnosed with congenital syphilis should be treated or referred according to the treatment scheme recommended by the state.

Thirty-second medical institutions engaged in the diagnosis and treatment of sexually transmitted diseases should formulate inspection standard operation and quality control procedures, conduct inspection according to technical specifications and report the results, participate in the quality evaluation of sexually transmitted diseases among laboratories, and strengthen the biosafety management of laboratories.

Thirty-third medical institutions should take measures to prevent iatrogenic infection of sexually transmitted diseases and strengthen the occupational safety protection of medical personnel. Thirty-fourth China Center for Disease Control and Prevention shall formulate a national STD surveillance plan. Provincial disease prevention and control institutions shall, according to the national STD surveillance plan and the local STD epidemic situation, formulate the implementation plan for STD surveillance in this administrative region; Organize STD surveillance and special investigation to understand the characteristics and epidemic trend of sexually transmitted diseases in different populations.

Thirty-fifth medical institutions engaged in the diagnosis and treatment of sexually transmitted diseases are responsible reporting units for sexually transmitted diseases, and medical personnel engaged in the diagnosis and treatment of sexually transmitted diseases are responsible reporting persons for sexually transmitted diseases.

The reporting unit of STD epidemic responsibility shall establish and improve the registration and reporting system of STD epidemic; The person in charge of reporting the epidemic situation of sexually transmitted diseases shall report the epidemic situation in a timely manner as required when discovering the cases that should be reported.

Article 36 Medical institutions engaged in the diagnosis and treatment of sexually transmitted diseases shall make a diagnosis according to the epidemiological history, clinical manifestations and laboratory test results, and report the epidemic situation in accordance with the provisions, and shall not conceal, falsely report or delay reporting the epidemic situation.

AIDS voluntary counseling and testing institutions and community drug maintenance treatment clinics shall collect and report relevant information as required.

Medical and health institutions shall not disclose relevant information and materials concerning the personal privacy of patients with sexually transmitted diseases.

Thirty-seventh health administrative departments at all levels are responsible for the construction of STD epidemic reporting network within their respective administrative areas, and provide necessary guarantee conditions for the normal operation of the network.

Thirty-eighth disease prevention and control institutions are responsible for the business management and technical guidance of STD information reporting within their respective administrative areas, collecting, verifying, analyzing, reporting and feeding back STD information, predicting epidemic trends, and checking the quality of STD information reporting. Article 39 The Ministry of Health shall be responsible for the supervision and management of the prevention and control of sexually transmitted diseases throughout the country, and organize the performance evaluation and effect evaluation of the prevention and control of sexually transmitted diseases.

Fortieth local health administrative departments at or above the county level shall be responsible for the supervision and management of the prevention and control of sexually transmitted diseases within their respective administrative areas, and regularly conduct performance appraisal, supervision and inspection of the prevention and control of sexually transmitted diseases. The contents of supervision and inspection include:

(a) to implement the duties of STD prevention and control institutions;

(two) to carry out the duties of medical institutions to carry out the diagnosis and treatment of sexually transmitted diseases;

(3) Referral of suspected STD patients found by medical institutions that do not have the qualification to carry out STD diagnosis and treatment;

(four) STD prevention and control institutions and medical institutions engaged in STD diagnosis and treatment training.

Forty-first health administrative departments should include the diagnosis and treatment of sexually transmitted diseases in the verification and evaluation of medical institutions that carry out STD diagnosis and treatment services.

Forty-second health administrative departments shall accept the reports of individuals or organizations that violate these measures and deal with them according to law.

Article 43 When conducting supervision and inspection according to law, the staff of the administrative department of health shall show their certificates; The inspected unit shall cooperate, truthfully report the situation and provide necessary information, and shall not refuse, obstruct or conceal it.

Article 44 Disease prevention and control institutions and medical institutions engaged in the diagnosis and treatment of sexually transmitted diseases should strengthen the management of their own STD prevention and control work, and give criticism and education or corresponding disciplinary sanctions to the staff of their own institutions who violate the provisions of these measures according to the seriousness of the case. Forty-fifth health administrative departments at or above the county level shall promptly correct and deal with violations of these measures found in the supervision and inspection or received reports; Informed criticism should be given to medical and health institutions and their staff who are ineffective in their work and have irregular management; The responsible person in charge and other directly responsible personnel may be punished according to the circumstances.

Forty-sixth health administrative departments at or above the county level in violation of the provisions of these measures, resulting in the spread of sexually transmitted diseases, shall be dealt with in accordance with the relevant provisions of the Law on the Prevention and Control of Infectious Diseases; If a crime is constituted, criminal responsibility shall be investigated according to law.

Forty-seventh without obtaining the "practice license of medical institutions" to carry out STD diagnosis and treatment activities, in accordance with the relevant provisions of the "Regulations on the Administration of Medical Institutions".

Forty-eighth medical institutions in violation of the provisions of these measures, beyond the scope of registered diagnosis and treatment subjects to carry out STD diagnosis and treatment activities, in accordance with the relevant provisions of the "Regulations" and its implementation details.

If a medical institution, in violation of the provisions of these measures, fails to report the epidemic situation in accordance with the relevant provisions, or conceals, falsely reports or delays reporting the epidemic situation of infectious diseases, or divulges relevant information and materials concerning the personal privacy of patients with sexually transmitted diseases, it shall be handled in accordance with the relevant provisions of the Law on the Prevention and Control of Infectious Diseases.

Forty-ninth medical institutions in providing STD diagnosis and treatment services in violation of the norms of diagnosis and treatment, the health administrative department at or above the county level shall order it to make corrections within a time limit and give a warning; If no change is made within the time limit, a fine of not more than 30 thousand yuan may be imposed according to the seriousness of the case.

Fiftieth doctors in the diagnosis and treatment of sexually transmitted diseases in violation of the provisions of these measures, one of the following circumstances, by the health administrative department at or above the county level in accordance with the relevant provisions of Article 37 of the "Medical Practitioners Law":

(a) in violation of the norms of STD diagnosis and treatment, causing serious consequences;

(2) divulging the patient's privacy, causing serious consequences;

(three) failing to report the epidemic situation of sexually transmitted diseases in accordance with the provisions, causing serious consequences;

(four) in violation of other provisions of these measures, causing serious consequences.

Fifty-first nurses who disclose patients' privacy in violation of these measures or find that doctors' orders violate laws, regulations, rules and technical specifications for diagnosis and treatment shall be dealt with in accordance with the relevant provisions of Article 31 of the Nurses Regulations.

Fifty-second medical institutions in violation of the relevant provisions of the medical advertisements related to the diagnosis and treatment of sexually transmitted diseases, the health administrative departments at or above the county level shall be dealt with in accordance with the provisions of relevant laws and regulations of the state.

Fifty-third patients with sexually transmitted diseases in violation of regulations, resulting in the spread of sexually transmitted diseases, causing personal and property damage to others, should bear civil liability for compensation according to law; If a crime is constituted, criminal responsibility shall be investigated according to law. Article 54 The health administrative departments of provinces, autonomous regions and municipalities directly under the Central Government may, in accordance with the provisions of these Measures and in light of local actual conditions, formulate detailed implementation rules.

Article 55 The quality control of STD testing in laboratories of medical institutions shall be managed and controlled in a unified way according to the relevant regulations of clinical laboratories of medical institutions.

Article 56 The meanings of the following terms in these Measures:

Disease prevention and control institutions that undertake the task of STD prevention and control refer to disease prevention and control centers or hospitals, research institutes and stations at all levels that undertake the responsibility of STD prevention and control in accordance with the requirements of the administrative department of health.

People at risk of sexually transmitted diseases refer to people who have sex outside marriage, multiple sexual partners, same-sex sex behavior and so on.
