Regulations of Chaozhou Municipality on Prevention and Control of Dust Pollution

Chapter I General Provisions Article 1 In order to effectively prevent and control dust pollution, protect and improve the atmospheric environment, safeguard public health, and promote sustainable economic and social development, these Regulations are formulated in accordance with the Environmental Protection Law of People's Republic of China (PRC), the Law on Prevention and Control of Air Pollution of People's Republic of China (PRC) and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the prevention and control of dust pollution and its supervision and management activities within the administrative area of this Municipality.

The term "dust pollution" as mentioned in these Regulations refers to the pollution of the surrounding environment and atmosphere caused by dust particles from construction projects, material transportation and stacking, city appearance cleaning, greening operations, quarrying and earth borrowing, and mud exposure.

Construction projects include building construction, building (structure) demolition, road and pipeline laying, municipal public facilities construction, port construction, etc. Article 3 The prevention and control of dust pollution shall adhere to the principles of government leading, public participation, prevention first, combination of prevention and control, and comprehensive management. Article 4 The people's governments of cities and counties (districts) shall be responsible for the prevention and control of dust pollution within their respective administrative areas, and shall include the funds for the prevention and control of dust pollution in the fiscal budget to ensure the smooth development of the prevention and control of dust pollution.

The Town People's Government and the sub-district offices are responsible for the prevention and control of dust pollution within their respective jurisdictions, and assist the relevant competent departments of cities and counties (districts) to carry out the prevention and control of dust pollution.

Village (neighborhood) committees are responsible for assisting the relevant competent departments of cities and counties (districts) and the people's governments of towns and subdistrict offices to carry out dust pollution prevention and control work. Article 5 The competent department of ecological environment shall exercise unified supervision and management over the prevention and control of dust pollution within its jurisdiction, be responsible for coordinating and urging relevant departments to perform their management duties, and be responsible for the supervision and management of dust pollution prevention and control of industrial production enterprises and material yards (warehouses).

Urban management and comprehensive law enforcement departments are responsible for the supervision and management of dust pollution prevention and control in municipal engineering construction, urban road cleaning and urban greening operations.

The competent department of housing and urban and rural construction is responsible for the supervision and management of the prevention and control of dust pollution in housing construction and ready-mixed concrete production enterprises.

The competent department of transportation is responsible for the supervision and management of the prevention and control of dust pollution in roads, rail transit, port and dock construction demolition, demolition of buildings (structures) that violate highway management, highway cleaning and highway greening operations, and public parking lots, port and dock material storage yards, and traffic engineering construction land.

The traffic administrative department of the public security organ is responsible for investigating and dealing with road traffic violations of vehicles transporting sand and gravel, cement, coal, muck, mud, porcelain clay and other bulk and fluid materials.

The water administrative department is responsible for the supervision and management of the prevention and control of dust pollution in the construction of water conservancy projects, sand and gravel yards within the scope of river management and the demolition of buildings (structures) within the scope of water conservancy projects.

The competent department of natural resources is responsible for the supervision and management of the prevention and control of dust pollution such as mining, quarrying and earth borrowing, and demolishing buildings (structures) that violate land management.

Other departments responsible for the supervision and management of dust pollution prevention and control shall supervise and manage the prevention and control of dust pollution within the scope of their respective duties. Article 6 People's governments at all levels shall strengthen environmental protection publicity for the prevention and control of dust pollution.

The news media shall carry out public welfare publicity on laws and regulations on the prevention and control of dust pollution and scientific prevention and control knowledge, and supervise the illegal activities of dust pollution prevention and control by public opinion.

Encourage village (neighborhood) committees, social organizations and environmental protection volunteers to publicize the knowledge and laws and regulations on dust pollution prevention and control. Chapter II Preventive Measures Article 7 The environmental impact assessment documents submitted by the construction unit shall include the environmental impact prediction and assessment of dust pollution, and put forward effective environmental protection measures and preventive measures; Construction projects that belong to the environmental impact registration form shall put forward and implement effective environmental protection measures to prevent and control dust pollution. The construction unit shall include the cost of dust pollution prevention and control into the project cost; Clarify the responsibility of the construction unit for dust pollution prevention and control in the construction contract; In the construction contract, the bidder is clearly required to formulate the prevention and control plan of dust pollution on the construction site. Eighth construction units shall formulate specific implementation plans for the prevention and control of construction dust pollution. Construction units engaged in building construction, municipal infrastructure construction, river regulation and building (structure) demolition shall file with the competent department responsible for the supervision and management of dust pollution prevention and control.

The construction unit shall ensure that the funds for the prevention and control of dust pollution are earmarked. Ninth construction project supervision units should include the prevention and control of dust pollution in the scope of project supervision, and put forward supervision measures in the supervision plan in combination with the characteristics of the project. If the construction unit fails to carry out the construction according to the implementation plan of dust pollution prevention and control, it shall be required to correct it immediately and report to the construction unit in time. Tenth construction projects shall meet the following requirements for the prevention and control of dust pollution:

(a) the dust pollution prevention and control measures, responsible person, dust supervision and management departments, reporting methods and ways and other information posted on the periphery of the construction enclosure, accept social supervision.

(2) The construction site shall be equipped with dust pollution prevention and control management personnel to record the implementation of dust pollution prevention and control measures, including coverage area, car washing frequency and duration, water spraying frequency and duration, etc. Every day.

(3) Around the construction site, a continuous rigid enclosed enclosure or fence should be set up according to the specification requirements, and a hard anti-overflow seat of not less than 30 cm should be set at the bottom of the enclosure or fence. If the enclosure, fence and overflow prevention seat need to be removed, effective measures such as sprinkling water and spraying shall be taken to prevent and control dust pollution.

(4) Vehicle washing facilities shall be set inside the entrance and exit of the construction site to wash the motor vehicles leaving the construction site, and keep the entrance and exit channels of the construction site clean and free of dirt, mud and construction waste.

(5) Measures such as sprinkling water and spraying dust suppressant should be taken on the exposed ground of construction site operation; For the construction land that cannot be started temporarily, the land use right holder shall cover and pave the bare ground; More than three months, should be green.

(6) The entrances and exits of the construction site, material stacking and processing areas, living quarters, main roads and other areas should be hardened with concrete, and reef slag, gravel or other materials with equivalent functions should be laid, supplemented by water spraying, dust suppressant spraying, automatic spraying and spraying systems and other measures to prevent dust.

(seven) timely removal of bulk materials, construction earthwork, construction waste and muck in the construction site; If temporary storage is needed at the construction site, it should be piled up in the enclosure and covered with dust-proof net (cloth), or supplemented by measures such as regular watering and spraying dust suppressant.

(eight) earthwork, underground engineering, demolition, blasting and other projects that are easy to produce dust, measures such as sprinkling water to suppress dust and wet construction should be taken to prevent dust; If mud is produced during construction, mud pits and mud ditches shall be set up to ensure that the mud does not overflow.

(nine) in the construction site using bagged cement or on-site mixing concrete, effective measures such as sealing and dust reduction should be taken to prevent dust pollution.

(10) Effective dust pollution prevention and control facilities, such as dense mesh dustproof net (cloth) which meets the standard, should be set outside the construction scaffolding, and dust prevention measures such as sprinkling water and spraying should be taken when dismantling.
