Brief introduction to the main contents of crew management in China
Seafarers are the main force in the maritime industry. In order to protect the legitimate rights and interests of seafarers, relevant countries have formulated a large number of laws and regulations to protect them. The total number of crew members in China has now reached more than 6,543,800+0.5 million, ranking first in the world, but the protection of their rights and interests is far from meeting the practical needs of the healthy development of the shipping industry. Looking up the contents of laws and regulations on the protection of seafarers' rights and interests in China, it is found that although there are a few provisions in China's Maritime Law, Seafarers' Regulations, Labor Law and Trade Union Law, there are obviously scattered, chaotic and weak problems. Moreover, due to the backwardness of China's legislative content and technology, coupled with the defects in management system and jurisdiction division, the protection effect of China's crew rights protection system is not ideal. Based on the current situation of the protection of seafarers' rights and interests in China, compared with the relevant international conventions and other countries' relevant legal systems, and based on the theory of public management and public policy analysis, this paper makes a preliminary study on China's seafarers' wage system, repatriation system, relief system and supervision mechanism, in an attempt to explore the countermeasures to improve China's seafarers' rights and interests protection system from various aspects. We believe that on the one hand, efforts should be made to improve the professional quality of seafarers, raise their awareness of rights and obligations, enhance their ability to defend their rights, solve outstanding problems such as unequal and unclear rights and obligations between seafarers and maritime departments, and form a situation in which all parties actively participate in the whole process of supervision and protection of seafarers' rights and interests; On the other hand, it is also suggested to improve and perfect the crew management system and explore how to establish and realize the protection mechanism of crew rights and interests with maritime supervision, multi-party participation and efficient operation. This paper is divided into five chapters. 1 chapter expounds the background and significance of the topic, the research status at home and abroad, the research purpose, research methods and research ideas of this paper; The second chapter expounds the concepts of crew, rights and interests, crew rights and interests and related basic theories such as Scientific Outlook on Development theory, human resource management theory and public service-oriented government theory. The third chapter analyzes the present situation, existing problems and reasons of the protection of seafarers' rights and interests in China; The fourth chapter mainly combines the analysis of the third chapter, and puts forward some suggestions on safeguarding the rights and interests of seafarers in China in two parts. First, it is suggested to improve the system and clarify the responsibilities of various institutions in the protection of crew rights and interests; Secondly, it puts forward some suggestions on the management reform of crew rights protection from five aspects: perfecting the management system of crew rights protection, innovating the service concept of public managers, accurately positioning government functions, constructing a new mechanism for daily supervision and management of crew rights, and improving the quality of crew members. The fifth chapter puts forward some thoughts on improving the management of crew rights protection.
